A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
MANAGER TO TAKE ANY AND ALL STEPS NECESSARY, INCLUDING THE
WAIVER OF FEES, IF ANY, TO TEMPORARILY REPURPOSE PORTIONS OF
CITY OF MIAMI ("CITY") RIGHTS -OF -WAY, INCLUDING PARKING LANES
AND VEHICULAR TRAVEL LANES, WHERE DEEMED FEASIBLE BY THE
CITY'S DEPARTMENT OF RESILIENCE AND PUBLIC WORKS AND THE
MIAMI POLICE DEPARTMENT, TO ALLOW FOR INCREASED PEDESTRIAN
USAGE FOR RESIDENTS AND ADDITIONAL SIDEWALK CAFE SEATING,
INCLUDING PARKLETS SIMILAR IN NATURE TO THOSE ALLOWED BY THE
PARKLET PILOT PROGRAM ADOPTED SEPTEMBER 27, 2018, PURSUANT
TO RESOLUTION NO. 18-0427, TO ASSIST STRUGGLING BUSINESSES DUE
TO THE NOVEL CORONAVIRUS CRISIS UNTIL AUGUST 20, 2020; URGING
MIAMI-DADE COUNTY, THROUGH ITS DEPARTMENT OF
TRANSPORTATION AND PUBLIC WORKS, TO ASSIST THE CITY IN
ACCOMPLISHING SUCH A GOAL TO THE EXTENT NECESSARY;
DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED COPY OF THIS
RESOLUTION TO THE OFFICIALS NAMED HEREIN.
SPONSOR(S): Commissioner Ken Russell, Commissioner Manolo Reyes
WHEREAS, under the provisions of law and Sections 252.31 - 252.60, Florida
Statutes, Mayor Francis X. Suarez ("Mayor") of the City of Miami ("City") declared on March 12,
2020 that a State of Local Emergency exists within the City in response to the Novel
Coronavirus ("COVID-19"); and
WHEREAS, in accordance with the provisions of Section 252.38(3)(a), Florida Statutes,
the Mayor has extended the State of Local Emergency for additional seven (7) day periods,
most recently on May 12, 2020; and
WHEREAS, as a result of the State of Local Emergency, many businesses have been
closed and residents have been directed to stay at home; and
WHEREAS, as the City begins to reopen, the City Commission wishes to assist
businesses negatively affected by the COVID-19 crisis and provide additional sidewalk space
for pedestrians by authorizing the City Manager to identify feasible portions of City rights -of -way
that may be repurposed for pedestrian and sidewalk cafe usage and to take any and all steps
necessary to effectuate such repurposing until August 20, 2020; and
WHEREAS, pursuant to Section 2-33(e) of the Code of the City of Miami, Florida, as
amended, the City Commission, by a majority vote, deems this Resolution to be of an
emergency nature in order to immediately protect the health, welfare, and safety of the City's
residents;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the Preamble to this Resolution are
hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section.
Section 2. The City Manager is directed to take any and all steps necessary, including
waiver of fees, if any, to temporarily repurpose portions of City rights -of -way, including parking
lanes and vehicular travel lanes, where deemed feasible by the City's Department of Resilience
and Public Works and the Miami Police Department, to allow for increased pedestrian usage for
residents and additional sidewalk cafe seating to assist struggling businesses due to the
COVID-19 crisis until August 20, 2020. This may include allowing parklets similar in nature to
those allowed by the parklet pilot program adopted September 27, 2018 by Resolution No. R-
18-0427.
Section 3. The City Manager is urged to collaborate with the Miami Parking Authority,
the Miami Police Department, and the Coconut Grove Business Improvement District, the
Wynwood Business Improvement District, and any other relevant and necessary entities to
accomplish the goals set forth in this Resolution.
Section 4. The City Commission urges Miami -Dade County ("County"), through its
Department of Transportation and Public Works, to assist the City to the extent necessary to
accomplish the goals set forth in this Resolution.
Section 5. The City Clerk is directed to transmit a certified copy of this Resolution to the
County Board of County Commissioners, the County Mayor, and the Director of the County's
Department of Transportation and Public Works.
Section 6. The Resolution shall become effective immediately upon its adoption.
