A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AMENDING THE ANTI -POVERTY INITIATIVE ("API") GUIDELINES TO ALLOW
FOOD DISTRIBUTIONS DURING TIMES OF CRISIS; FURTHER CLARIFYING
THAT IN ADDITION TO CITY OF MIAMI ("CITY") DEPARTMENTS, THE
OFFICES OF CITY ELECTED OFFICIALS SHALL QUALIFY AS ELIGIBLE
RECIPIENTS OF API FUNDS; AUTHORIZING THE CITY MANAGER TO
EXECUTE ANY AND ALL NECESSARY DOCUMENTS, ALL IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; RATIFYING,
CONFIRMING, AND APPROVING THAT PURSUANT TO SECTION 18-
72(B)(20) OF THE CODE OF THE CITY OF MIAMI, FLOIRDA, AS AMENDED,
ALLOCATIONS OF API FUNDS IN AN AGGREGATE AMOUNT OF FIFTY
THOUSAND DOLLARS ($50,000.00) OR LESS IN ANY SINGLE CITY FISCAL
YEAR TO ANY SINGLE ENTITY PURSUANT TO THE API GUIDLEINES SHALL
NOT REQUIRE CITY COMMISSION APPROVAL.

WHEREAS, pursuant to Resolution No. 14-0362 adopted on September 23, 2014, the
City Commission established the Anti -Poverty Initiative Program ("API") to address poverty
through a strategy of focusing the provision of support towards the goal of having City of Miami
("City") residents achieve self-sufficiency; and
WHEREAS, pursuant to Resolution No. 15-0106 adopted on March 12, 2015, the City
determined that the most effective means of allocating API funding among the City districts
should be based on the level of poverty within each district; and
WHEREAS, pursuant to Resolution No. 16-0044 adopted January 28, 2016, all API
funding recipients are required to execute an agreement with the City that addresses the scope
of services, performance measures, invoicing, conflicts of interest, and other material terms that
may be applicable for the use of any funds; and
WHEREAS, the Novel Coronavirus ("COVID-19") pandemic and the related economic
impacts have brought to light the need to expand the allowable uses of API funds to include
food distributions consistent with the needs identified by this Resolution; and
WHEREAS, during a declared State of Emergency or natural disaster to allow for
essential supplies that may be necessary; and
WHEREAS, due to the urgent need of these funds and to ensure the efficiency of future
allocations the City Commission finds it necessary to clarify the application of Section 18-
72(b)(20) of the Code of the City of Miami, Florida, as amended ("City Code"), to API funds; and
WHEREAS, the Miami City Commission finds it in the best interest of the City and its
residents to henceforth permit the allocation and expenditure of API funds for food distribution in
City of Miami

WHEREAS, the API guidelines already include City Departments as eligible recipients
and the City Commission wishes to clarify that the offices of City Elected Officials shall also be
included;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated herein as if fully set forth in this Section.
Section 2. The City Commission hereby amends the API Guidelines to allow food
distributions.
Section 3. The City Commission hereby amends the API guidelines to allow for essential
supplies during a State of Emergency, natural disaster, or economic crisis.
Section 4. The City Commission hereby amends the API Guidelines to clarify that the
offices of City Elected Officials shall be eligible recipients of API funding.
Section 5. The City Manager is further authorized to execute any and all necessary
documents, all in a form acceptable to the City Attorney, for said purpose.
Section 6. The City Commission hereby ratifies, confirms, and approves that, pursuant
to Section 18-72(b)(20) of the City Code, allocations of API funds in an aggregate amount of
Fifty Thousand Dollars ($50,000.00) or Tess in any single City fiscal year to any single entity
pursuant to the API Guidleines shall not require City Commission approval.
Section 7. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective

Anti -Poverty Initiative Program Guidelines
Background:
On September 23, 2014, the Miami City Commission approved Resolution No. 14-0362 esta• shing the
Anti -Poverty Initiative ("API") program. The following Anti -Poverty Initiative guidelines w- e passed on
May 23, 2019, per Resolution No. 19-0202, to ensure the accountability and utilization .f the program
funds meets the intent of Resolution No. 15-0106 and Resolution No. 16-0044 as wI as anti -poverty
related Sunshine meetings held in 2014. Funding allocation is based on pov rty rates for each
commission district.
Purpose:
The purpose of the Anti -Poverty Initiative is to reduce poverty within the ity of Miami communities and
funding shall be utilized to meet the needs of poor residents. The City Miami created the Anti -Poverty
Initiative to address poverty based on a strategy of focusing the prision of support towards the City's
residents achieving self-sufficiency.
Anti -Poverty Initiative focuses on projects and progra providing services directly benefitting
disadvantaged City of Miami residents in the following priity areas:
• Educational Programs for children, youth and a '. Its
• Crime Prevention
• Elderly meals, transportation, recreationand health/wellness related activities
• At -risk youth or youth summer job pro ams
• Transportation services and progra
• Job development, retention and t' fining programs
• Homeless Services
• Food distributions
• Essential supplies, during State of Emergency, natural disaster, or economic crisis.
The expenditure of Anti-Pov- y funds allocated under this Initiative shall only be expended to benefit
the interest of disadvanta: d residents of the City of Miami.
Eligible Entities an Organizations:
Anti -Poverty Initia ' e fund recipients must be an active and registered State of Florida entity:
(1) For Profit; ( Not -for profit organizations {501(3)(c)}; (3) Governmental units;
(4) Educatio►.I and academic institutions; (5) City of Miami departments, offices of City
Electe• Officials, agencies, and boards
Addi onal Program Guidelines and Requirements
Any organization considered for or selected to receive Anti -Poverty Initiative funds must comply
with any and all local, state and federal laws, rules, regulations, or guidelines associated with the
programs funded, and such allocations may be revoked at the sole discretion of the City

Anti -Poverty Initiative Program Guidelines
• Organization must complete an Anti -Poverty Initiative funding request form.
• API program is subject to commission approval and funding availability.
• API fund recipients will use funds for a program or initiative that reaches a significan umber of
individuals or significantly impacts Miami's disadvantage communities.
• Recipients will be required to enter into a grant agreement with the City of Mii prior to any
funding being disbursed. Said agreement shall include program/activity information and
language regarding:
o Resolution stating who is authorized to execute agreement with
o Scope of Services including but not limited to number of resid
Miami District/Location where services are being provided,
frequency of service, performance measures and any othe
relevant to the program priority area
o Budget detailing how funding will be utilized to provid
City/District residents as described in the Scope ofS
o Invoicing for activities and services provided and
o Conflict of Interest
o Insurance as required by the City of Miami

for the provision of API related rvices. The City, from time to time, will conduct on -site

o Lobbying Activities
o Traveling for non ogram participants
o Meals for non-• .gram participants
o Pay bad debt
o Defense a prosecution of criminal and civil proceedings
o Donatio . or fund raising activities
o Indivi•.al or Personal expenses
o Pay me expense charged to other funding source (e.g. CDBG funds)
o S• • nsorship of events and activities
o ny other expenditures deemed ineligible by the City of Miami
• Orgizations that discriminate based on race, color, sex, religion, national origin, age or
di . bility will not be recommended for funding. Administrative/Indirect expenses cannot exceed
0% of the budget allocation.
The attached Funding Request Form (pages 1-5) must be completed in its entirety and submitted to the
Office of Grants Administration before the entity may added to the Commission Agenda for approval.
