A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENTS,
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A
ROADWAY TRANSFER AGREEMENT WITH THE FLORIDA DEPARTMENT
OF TRANSPORTATION ("FDOT") TO ACCOMMODATE CONSTRUCTION OF
A CITY OF MIAMI ENHANCED PEDESTRIAN BRIDGE AS PART OF THE
REBUILDING BY FDOT OF THE I-395/SR 836/1-95 DESIGN -BUILD PROJECT,
MIAMI, FLORIDA ("PROJECT"); FURTHER AUTHORIZING THE CITY
MANAGER TO TAKE ANY AND ALL ACTIONS NECESSARY TO
ACCOMPLISH SAID TRANSFERS FROM THE CITY OF MIAMI'S STREET
SYSTEM TO FDOT'S STATE HIGHWAY SYSTEM, AS STATED HEREIN AND
MORE GENERALLY DEPICTED IN EXHIBIT "A"; ADOPTING THE BASIS OF
DESIGN ATTACHED HEREIN AS EXHIBIT "B" AS THE GUIDING DOCUMENT
FOR DEVELOPMENT OF THE OPEN SPACE UNDERNEATH THE PROJECT
AND URGING FDOT TO UTILIZE THE SAME; DIRECTING THE CITY CLERK
TO TRANSMIT THIS A COPY OF THIS RESOLUTION TO THE OFFICIALS
STATED HEREIN.
WHEREAS, the Florida Department of Transportation ("FDOT") is in the process of
constructing a roadway project along Interstate 395 ("1-395") from Interstate 95 ("1-95") to the
West channel bridge of the Mac Arthur Causeway, Miami, Florida; and
WHEREAS, the project includes rebuilding the 1-395 corridor with new elevated ramps,
updating the alignment, upgrading the roadway surface, and creating a new signature bridge
with higher structures that will improve its visual quality; and
WHEREAS, the transfer of several City of Miami ("City") roadways to FDOT's State
Highway System are necessary to accommodate the rebuilding of the 1-395 corridor and a City -
requested enhanced pedestrian bridge ("Pedestrian Bridge"); and
WHEREAS, pursuant to Resolution No. 14-0288 adopted July 24, 2014, the City
Commission transferred several roadways to FDOT for the proposed improvements; and
WHEREAS, the City has identified and requested the transfer to FDOT's State Highway
System of portions of two (2) additional roadways for the proposed improvements: a portion of
Northwest 1St Court from north of Northwest 13th Street to south of Northwest 14th Street and a
portion of Northwest 13th Street from east of Northwest 1 St Court to west of Northwest 1 St
Avenue, as more generally depicted in Exhibit "A," attached and incorporated; and
WHEREAS, the City has developed a basis of design for FDOT to use in design
coordination with its contractors for development of the 33 acres of public open space beneath
1-395 which includes the Pedestrian Bridge ("Basis of Design"); and

WHEREAS, the removal of earthen berms by FDOT beneath 1-395 will provide for
additional open space and the new Pedestrian Bridge will provide greater connectivity between
the adjacent neighborhoods and unite the entire 33 acres of public open space to be developed
by FDOT; and
WHEREAS, the City is adopting the Basis of Design, attached and incorporated as
Exhibit "B," and encourages FDOT to develop the open space with it as a guide; and
WHEREAS, the Basis of Design builds on the previous FDOT plan by enhancing the
elements FDOT has committed to the community to build such as the Pedestrian Bridge, a
heritage trail, programming elements including a dog play area, opportunities for entrepreneurs
to vend goods, water features, performance space, and other flexible programming elements;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to negotiate and execute the Roadway
Transfer Agreement, in a form acceptable to the City Attorney, with FDOT to accommodate
construction of the Pedestrian Bridge as part of the rebuilding by FDOT of the I-395/State Road
836/1-95 Design -Build Project, Miami, Florida.
Section 3. The City Manager is further authorized' to take any and all actions necessary
to accomplish said transfers from the City's Street System to FDOT's State Highway System.
Section 4. The City Commission hereby adopts the Basis of Design, attached and
incorporated as Exhibit "B", for 1-395 and urges FDOT to use it as a guide to develop the open
space beneath 1-395.
Section 5. The City Clerk is directed to transmit a copy of this Resolution to the FDOT
Director.
Section 6. This Resolution shall become effective immediately upon its adoption.
