Background of Item:
As directed by City Code 54-16(h) to prohibit vehicular access, the Department of
Resilience and Public Works solicited written comments and recommendations of the
proposed permanent restrictions to vehicular access from the Department of Solid
Waste, Fire Rescue Department, and Police Department

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AFTER AN ADVERTISED PUBLIC HEARING, RECOMMENDING TO THE DIRECTOR
OF THE MIAMI-DADE COUNTY DEPARTMENT OF TRANSPORTATION AND
PUBLIC WORKS ("DTPW') THE PERMANENT RESTRICTION OF VEHICULAR
ACCESS AND THE VACATION OF TWO (2) ROADWAY SEGMENTS AT
NORTHWEST 1ST COURT FROM NORTH OF NORTHWEST 13TH STREET TO
SOUTH OF NORTHWEST 14TH STREET AND NORTHWEST 13TH STREET FROM
EAST OF NORTHWEST 1ST COURT TO WEST OF NORTHWEST 1ST AVENUE
FOR THE CONSTRUCTION OF A CITY OF MIAMI ("CITY") REQUESTED
ENHANCED PEDESTRIAN BRIDGE AS PART OF THE FLORIDA DEPARTMENT OF
TRANSPORTATION'S INTERSTATE 395/STATE ROAD 836/INTERSTATE 95
DESIGN -BUILD PROJECT, SUBJECT TO ANY REQUIREMENTS OR CONDITIONS
THAT MAY BE IMPOSED BY THE CITY'S RESILIENCE AND PUBLIC WORKS
DEPARTMENT, FIRE -RESCUE DEPARTMENT, SOLID WASTE DEPARTMENT, AND
POLICE DEPARTMENT; FURTHER RECOMMENDING TO DTPW THAT
PEDESTRIAN ACCESS BE PROVIDED AT ALL TIMES ACROSS SAID STREETS
UNTIL SUCH TIME AS THE SAME ARE VACATED; DIRECTING THE CITY CLERK
TO TRANSMIT A COPY OF THIS RESOLUTION TO DIRECTOR OF DTPW.
WHEREAS, Section 54-16(a) of the Code of the City of Miami, Florida, as amended
("City Code"), permits the City Commission to recommend to the Director of the Miami -Dade
County Department of Transportation and Public Works ("DTPW'), following an advertised
public hearing, that vehicular access to a particular street be restricted when found to be in the
best interest of the public; and
WHEREAS, as required by Section 54-16(d) of the City Code, the Department of
Resilience and Public Works solicited written comments and recommendations of the proposed
permanent restrictions to vehicular access from the City of Miami's ("City") Solid Waste
Department, Fire -Rescue Department, and Police Department; and
WHEREAS, the City Commission finds that it is in the best interest of the public to
prohibit vehicular access to Northwest 1st Court from north of Northwest 13th Street to south of
Northwest 14th Street and Northwest 13th Street from east of Northwest 1st Court to west of
Northwest 1st Avenue, generally depicted in Exhibit "A", attached and incorporated, for the
construction of a Florida Department of Transportation ("FDOT") roadway project along
Interstate 395 ("1-395") from Interstate 95 ("1-95") to the West channel bridge of the MacArthur
Causeway, Miami, Florida along with an enhanced pedestrian bridge requested by the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission, after an advertised public hearing, recommends to the
Director of DTPW the permanent restriction of vehicular access and the vacation of two (2)
roadway segments at Northwest 1st Court from north of Northwest 13th Street to south of
Northwest 14th Street and Northwest 13th Street from east of Northwest 1st Court to west of
Northwest 1st Avenue, generally depicted in Exhibit "A", attached and incorporated, for the
construction of a City -requested enhanced pedestrian bridge as part of the FDOT's Interstate
395/State Road 836/Interstate 95 design -build project and recommends to DTPW that
pedestrian access be provided at all times across said streets until such time as the same are
vacated.
Section 3. The recommendation of prohibition of vehicular access shall be subject to
any requirements or conditions that may be imposed by the City's Resilience and Public Works
Department, Fire -Rescue Department, Solid Waste Department, and Police Department.
Section 4. The City Clerk is directed to transmit a copy of this Resolution to the Director
of DTPW.
Section 5. This Resolution shall become effective immediately upon its adoption.
