Background of Item: As per the Code of Federal Regulation 24 CFR 91.105, HUD requires the City to adopt a CPP that sets forth the policies and procedures for citizen participation. On July 11, 2019, pursuant to Resolution No. 19-0278 the Miami City Commission approved the CPP. pursuant to the declaration of a national emergency beginning March 1, 2020, the State of Florida Executive Order 20-52 , and the City of Miami State of Emergency tied to COVID-19, the Department of Housing and Community Development ("HCD") has to make a Substantial Amendment to its CPP to be able to conduct a public hearing that takes into account all the Executive Orders and the Center for Disease Control and Prevention ("CDC") Guidelines on public meetings. Guidance from the US Department of Housing and Urban Development recommends the use of Virtual Public Hearings (VPH) when neighborhood -level public meetings (in person) are not possible. The City Administration recommends the approval of the Substantial Amendment to the City of Miami's Citizen Participation Plan ("CPP"), as indicated in Exhibit "A", attached and incorporated, to reflect changes in the public hearing process. WHEREAS, pursuant to the Code of Federal Regulations under 24 CFR 91.105, the United States Department of Housing and Urban Development ("HUD") requires the City of Miami ("City") to adopt a Citizen Participation Plan ("CPP") that sets forth the policies and procedures for citizen participation; and WHEREAS, on July 11, 2019, pursuant to Resolution No. 19-0278, the Miami City Commission approved the City's CPP; and WHEREAS, pursuant to the declaration of a national emergency beginning March 1, 2020, the State of Florida Executive Order 20-52, and the City's State of Emergency related to Novel Coronavirus ("COVID-19"), the City's Department of Housing and Community Development ("HCD") must make a substantial amendment to its CPP in order to be able to conduct public hearings that take into account all applicable executive orders and the Center for Disease Control and Prevention ("CDC") guidelines regarding public meetings; and WHEREAS, guidance from HUD recommends the use of Virtual Public Hearings ("VPH") when neighborhood -level public meetings (in person) are not possible; and WHEREAS, the City's Administration recommends the approval of the substantial amendment to the City's CPP, as more particularly described in Exhibit "A," attached and incorporated, to reflect changes in the citizen participation process; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The substantial amendment to the City's CPP, as more particularly described in Exhibit "A," attached and incorporated, reflecting changes in the citizen participation process due to COVID-19 is approved. Section 3. The City Manager is authorized to negotiate and execute any and all necessary documents, including amendments, extensions, and modifications, all in forms acceptable to the City Attorney, for said purpose, subject to all federal, state, and local laws that regulate such documents. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity Attor ey 4/27/2020 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
