Background of Item: Effective October 1, 1999, Section 8 of the United States Housing Act of 1937 was amended by the Quality Housing and Work Responsibility Act of 1998, requiring public housing agencies to develop an annual Public Housing Agency ("PHA") plan. The City of Miami ("City") has been designated as the PHA to administer the Section 8 Housing Choice Voucher Program and Moderate Rehabilitation programs. Submission of a five (5) year PHA Plan to the United States Department of Housing and Urban Development ("U.S. HUD") is required to ensure the City's continued participation in the Section 8 Housing Choice Voucher and Moderate Rehabilitation programs. The Administration recommends approving the City's five (5) year PHA plan for Fiscal Year 2020-2024, and the Administrative Plan, in connection with the implementation and administration of the City's Section 8 Housing Choice Voucher and Moderate Rehanilitation program. The Administration also recommends submitting the five (5) year PHA Plan, attached and incorporated, for review and approval by U.S. HUD for the City's continued participation in said programs. WHEREAS, effective October 1, 1999, Section 8 of the United States Housing Act of 1937 was amended by the Quality Housing and Work Responsibility Act of 1998 requiring public housing agencies to develop an annual Public Housing Agency ("PHA") plan; and WHEREAS, the City of Miami ("City") has been designated as the PHA to administer the Section 8 Housing Choice Voucher and Moderate Rehabilitation programs ("Programs"); and WHEREAS, submission of a five (5) year PHA Plan to the United States Department of Housing and Urban Development ("U.S. HUD") is required to ensure the City's continued participation in the Programs; and WHEREAS, the City's Administration recommends approving the City's five (5) year PHA plan for Fiscal Years 2020-2024 and the administrative plan in connection with the implementation and administration of the Programs ("Administrative Plan"); and WHEREAS, the City's Administration also recommends submitting the five (5) year PHA plan, attached and incorporated as Exhibit "A", and the Administrative Plan, attached and incorporated as Exhibit "B", for review and approval by U.S. HUD for the City's continued participation in the Programs; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this section. Section 2. The City's five (5) year PHA plan for Fiscal Years 2020-2024 and the Administrative Plan in connection with the implementation and administration of the Programs are approved. Section 3. The City Manager is authorized' to submit the five (5) year PHA plan, attached and incorporated as Exhibit "A", and the Administrative Plan, attached and incorporated as Exhibit "B", for review and approval by U.S. HUD for the City's continued participation in the Programs. Section 4. The City Manager is authorized' to negotiate and execute any and all necessary documents and certifications, all in forms acceptable to the City Attorney, for said purposes. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City Attor ey 4/14/2020 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
