HomeMy WebLinkAboutR-20-0092City of Miami Resolution R-20-0092 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 7262 Final Action Date: 4/9/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION WITH ATTACHMENT(S), PURSUANT TO SECTION 18-112 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR MEDICAL DIRECTION SERVICES FOR THE CITY OF MIAMI'S ("CITY") DEPARTMENT OF FIRE - RESCUE ("FIRE") WITH THE PUBLIC HEALTH TRUST OF MIAMI-DADE COUNTY, FLORIDA, AN AGENCY AND INSTRUMENTALITY OF MIAMI-DADE COUNTY ("HEALTH TRUST"), FOR A PERIOD OF FIVE (5) YEARS; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER DOCUMENTS, INCLUDING ANY AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, PRIOR BUDGETARY APPROVALS, COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE. WHEREAS, pursuant to Section 401.265, Florida Statutes, as amended, the City of Miami's ("City") Department of Fire -Rescue ("Fire") is required to have medical direction services to supervise and provide medical oversight for the medical performance of Fire's paramedics and emergency medical technicians ("EMTs"); and WHEREAS, pursuant to Section 18-112 of the Code of the City of Miami, Florida, as amended ("City Code"), the City seeks to enter into an Interlocal Agreement, in a form acceptable to the City Attorney, for said medical direction services for Fire with the Public Health Trust of Miami -Dade County, Florida, an agency and instrumentality of Miami -Dade County ("Health Trust"); NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Pursuant to Section 18-112 of the City Code, the City Manager is authorized' to execute an Interlocal Agreement, in a form acceptable to the City Attorney, for medical direction services for Fire with the Health Trust for a period of five (5) years. Section 3. The City Manager is further authorized' to negotiate and execute any and all other documents, including any amendments, renewals, and extensions, subject to all allocations, appropriations, prior budgetary approvals, compliance with all applicable provisions of the City Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with all applicable laws, rules, and regulations as may be deemed necessary for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption.
