HomeMy WebLinkAboutR-20-0088City of Miami Resolution R-20-0088 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 7271 Final Action Date: 4/9/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE ACCEPTANCE OF FLORIDA STATE HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS ("HOPWA") PROGRAM FUNDS FOR FISCAL YEAR 2020-2021 IN AN AMOUNT NOT TO EXCEED $950,000.00 TO BE UTILIZED FROM JULY 1, 2020 TO JUNE 30, 2021 AND AN ADDITIONAL AMOUNT NOT TO EXCEED $950,000.00 TO BE UTILIZED FROM JULY 1, 2021 TO JUNE 30, 2022 FOR THE PURPOSE OF IMPLEMENTING PROGRAMS FOR PEOPLE WITH HIV/AIDS THAT HELP SUSTAIN AND/OR TRANSITION INDIVIDUALS AND FAMILIES TO STABLE HOUSING; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL NECESSARY DOCUMENTS INCLUDING AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS. WHEREAS, the Florida State Housing Opportunities For Persons With AIDS ("HOPWA") program was created to prevent homelessness from occurring to individuals and families living with HIV/AIDS, to transition individuals and families back into stable housing as soon as possible, and to create a strategy for long-term housing stability for persons living with HIV/AIDS; and WHEREAS, on February 21, 2020, the Department of Housing and Community Development ("DHCD") was informed by the State of Florida ("State") that the City of Miami ("City") will receive an allocation of HOPWA program funds in an amount not to exceed $950,000.00 for the State's Fiscal Year ("FY") 2020-2021 and an additional amount not to exceed $950,000.00 for FY 2021-2022; and WHEREAS, the funding is provided for the purpose of implementing programs that help sustain and/or transition individuals and families to stable housing in Miami -Dade County; and WHEREAS, the City's Administration recommends accepting the Florida State HOPWA program funds in an amount not to exceed $950,000.00 for FY 2020-2021 and an amount not to exceed $950,000.00 for FY 2021-2022; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The acceptance of Florida State HOPWA program funds in an amount not to exceed $950,000.00 for FY 2020-2021 to be utilized from July 1, 2020 to June 30, 2021 and an City of Miami Page 1 of 2 File ID: 7271 (Revision:) Printed On: 5/1/2025 File ID: 7271 Enactment Number: R-20-0088 additional amount not to exceed $950,000.00 for FY 2021-2022 to be utilized from July 1, 2021 to June 30, 2022 for the purpose of implementing programs for people with HIV/AIDS that help sustain and/or transition individuals and families to stable housing in Miami -Dade County is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents including amendments, extensions, and modifications, all in forms acceptable to the City Attorney, for said purpose, subject to all federal, state, and local laws that regulate the use of such funds. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity Attor ey 3/24/2020 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
