Background of Item: There are natural and man-made challenges faced by the Miami Police Department ("MPD") and other municipal police departments that are, or are likely to be, beyond the control of the services, personnel, equipment, or facilities of the municipal police departments. The City of Miami ("City") and Miami Shores Village, City of Doral, City of Miami Springs, City of Florida City, Bal Harbour Village, City of Hialeah Gardens, Town of Surfside, Town of Bay Harbor Island, Village of Indian Creek, Village of Virginia Gardens, Town of Medley and the City of Sunny Isles (collectively, the "Participating Municipalities") wish to enter into a Mutual Aid Agreement ("MAA") to ensure that preparation and resources from their law enforcement agencies will be adequate to address natural and manmade challenges, to protect the public peace and safety and to preserve the lives and property of the people of the City and the Participating Municipalities. The City and the Participating Municipalities have the authority under the Florida Mutual Aid Act, Chapter 23, Part 1, Sections 23.12-23.127, of the Florida Statutes, to enter into mutual aid agreements. The City and the Participating Municipalities have the authority under the Florida Interlocal Cooperation Act of 1969, promulgated under Section 163.01, Florida Statutes, to enter into interlocal agreements for a purposes of permitting local governmental units to make the most efficient use of their powers by enabling them to cooperate with other localities on a basis of mutual advantage and thereby to provide services and facilities in a manner and pursuant to forms of governmental organization that will accord best with geographic, economic population, and other factors influencing the needs of the local communities. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute Mutual Aid Agreement, in substantially the attached form, with the Participating Municipalities to receive and extend mutual aid in the form of law enforcement services and resources to ensure public safety and the ability to adequately respond to intensive situations, including but not limited to natural or man-made disasters or emergencies as defined in Chapter 23, Part 1, Florida Statutes. Section 3. This Resolution shall become effective immediately upon its adoption.
