HomeMy WebLinkAboutResolutionCity of Miami Resolution Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 6518 Final Action Date: 1/23/2020 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S RECOMMENDATION AND WRITTEN FINDING, ATTACHED AND INCORPORATED AS EXHIBIT "A," PURSUANT TO SECTION 18-86 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING METHODS AS NOT BEING PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI ("CITY") FOR THE PLACEMENT OF A SIGN OR ADVERTISING, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "B" OF THE DONATION AGREEMENT, FROM SIMPLY HEALTHCARE PLANS, INC., A FOR -PROFIT CORPORATION ("SIMPLY"), WITHIN HADLEY PARK, A CITY -OWNED PROPERTY LOCATED AT 1350 NORTHWEST 50 STREET, MIAMI, FLORIDA ("HADLEY PARK"); FURTHER AUTHORIZING THE CITY MANAGER TO ACCEPT A DONATION FROM SIMPLY AT AN ESTIMATED VALUE OF $21,179.00 IN THE FORM OF EQUIPMENT AND IMPROVEMENTS AT HADLEY PARK; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A DONATION AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR THE PLACEMENT OF THE SIGN OR ADVERTISING AND THE ACCEPTANCE OF THE EQUIPMENT AND IMPROVEMENTS; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER NECESSARY DOCUMENTS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, IN ORDER TO IMPLEMENT THE ACCEPTANCE OF SAID DONATION. WHEREAS, the City of Miami ("City") owns the property located at 1350 Northwest 50 Street, Miami, Florida, known as Hadley Park ("Hadley Park"); and WHEREAS, Simply Healthcare Plans, Inc., a for -profit corporation ("Simply"), wishes to donate equipment and improvements to the City for Hadley Park at an estimated value of $21,179.00; and WHEREAS, Simply also request to place a sign or advertising at Hadley Park related to the donation; and WHEREAS, the City desires to enter into an agreement for the acceptance of equipment, whereby Simply shall grant and donate certain equipment to the City to be utilized at Hadley Park and for the placement of a sign or advertisement therein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 6518 (Revision: C) Printed On: 4/29/2025 File ID: 6518 Enactment Number: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference incorporated as if fully set forth in this section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's recommendation and written finding, attached and incorporated as Exhibit "A," pursuant to Section 18-86 of the Code of the City of Miami, Florida, as amended, are ratified, confirmed, and approved and the requirements for competitive sealed bidding methods are waived as not practicable or advantageous to the City to use for the placement of a sign or advertising, as more particularly described in Exhibit "B" of the Donation Agreement, from Simply within Hadley Park. Section 3. The City Manager is authorized' to accept a donation from Simply at an estimated value of $21,179.00 in the form of equipment and improvements at Hadley Park. Section 4. The City Manager is further authorized to negotiate and execute a donation agreement, in a form acceptable to the City Attorney, with Simply for the placement of a sign or advertisement and the acceptance of the equipment and improvements at Hadley Park. Section 5. The City Manager is further authorized' to negotiate and execute any and all other necessary documents, all in a form acceptable to the City Attorney, in order to implement the acceptance of said donation. Section 6. This Resolution shall become effective immediately upon its adoption.
