The undersigned represents Doral New Holdings, Inc., 1632 Investments, Inc. and R A
Data, Inc. (collectively, Owner and/or Applicant), the owners of the properties located at 1628,
1632 and 1642 SW 7th Street, Miami (collectively, the Property) in connection with a request for
Zoning Change from T5-O to T6-O. The rezoning requested does not require a Future Land Use
Map amendment.
The Property consists of 3 platted lots located on the south side of SW 7 Street, between
SW 16 Avenue and SW 17 Avenue. In total, the Property consists of 23,850 square feet (±0.54
acres). The aerial below shows the Property location.

This request meets the criteria for Amendments in Section 7.1.2.8.c.1., Miami 21 Co
Specifically, "the proposal for the rezoning of property involves an extension of an existing
Transect boundary." The Property abuts property zoned T6-O, and approval of this application
will extend the existing T6-O zoning transect abutting to the south of the Property, while
maintaining the successional principles of the Miami 21, since the properties to the north, across
S.W. 7t" Street, are zoned T5-O. The transect successions will be maintained and, more
importantly, established residential areas in the vicinity will not be affected. Below is a map
image of the proposed rezoning of the Property.
In support of our request, we submit the following additional information and analysis:
1. The Property is designated "Restricted Commercial" in the Future Land Use Plan Map
of the Miami Neighborhood Comprehensive Plan. The T6-O Transect Zoning is consistent with
the current FLUM designation for not only this segment of S.W. 7t" Street, but the entire city
blocks to the north, south, east and west of the Rezoning Property.

2. The Property is not historically designated nor located within a historic district.
Further, the Property is not located within an archaeological conservation area.
3. The Property abuts property that is zoned T6 —0, along S.W. 8th Street, and that
is developed and used for commercial uses.
4. The Property is located on US Highway 41 (the "Tamiami Trail"), a major arterial
connector road with existing public facilities, including several Metro Dade Transit stops for
several north/south and east/west bus routes.
5. Westbound US Highway 41, which runs along the Property's only frontage, is an
established City of Miami Transit Corridor.
6. The closest T3-R zone to the Property is located approximately 410 feet away,
across SW 8th Street. There is negligible impact on established single family residential
neighborhoods as a result of rezoning the Rezoning Property to T6-0.

and the closest T3-R zoned property, was generated using the City's Zoning GIS map

7. The T6-O Transect allocates the same Uses as T5-O, with exception of increased
Height, FLR and residential Density. The Property's existing T5-O designation will only permit
a maximum of 35 units. The rezoning of the Property to T6-O will permit the development of an
additional 46 units for a maximum total of 81. The additional residential density, height and
FLR of the T6-O Transect will permit the design and development of a mixed use multifamily
project that will provide much needed housing opportunities.
On January 18, 2018, the City Commission approved an FLUM and rezoning application
for properties on S.W.7th Street and SW 7th Avenue (Ordinance 13732) from T5-O to T6-O.
Much like the properties subject to Ordinance 13732, the Property is located in an area begging
for redevelopment and higher density entitlement. And while that application contemplates the
redevelopment of the property with auto -related facilities, this application contemplates mixed
use multi -family development to serve the pressing City of Miami housing needs near
employment, education and community services.

Section 7.1.2.8(c)(1): Except where the proposal for the rezoning of property involves an
extension of an existing Transect boundary, no rezoning of land shall be considered which
involves less than 40,000 square feet of land area or 200 feet of street Frontage on one street.
Criteria 1 Support: The request would extend an existing Transect boundary.
Criteria 2
Section 7.1.2.8(0(2) for rezoning: A change may be made only to the next intensity Transect
Zone or by Special Area Plan, and in a manner which maintains the goals of this Miami 212 Code
to preserve Neighborhoods and to provide transitions in intensity and Building Height.
Criteria 2 Support: The rezoning is successional. The application properties will be zoned T6-O,
and the properties to the north, currently zoned T5-O will continue the succession.
Criteria 3
Are the proposed changes related to adjacent and nearby districts, and within the scale and
needs of the neighborhood.
Criteria 3 Support: This corridor of Little Havana, specifically, the south side of SW 7 Street that
abut SW 8 Street is the ugly backyard of Calle Ocho. While all of S.W.8th Street along Little
Havana is zoned T6-O, the SW 7 corridor is stifled by the T5-O and T4 zoning. The existing T5-
0 zoning already permits all types of commercial development, many of which would generate
offstreet parking and traffic impacts with projects that could be approved "by right".
Unfortunately, the height and density limitations do not support the redevelopment of the area
into quality mixed use residential developments. This area is perfectly located for higher density
and intensity. It is well served by public transportation and other services. T6-O zoning that
could result is higher residential density and height will not affect nearby neighborhoods. The
areas immediately to the north are zoned T5-O and the areas immediately to the south are zoned
T6-O. In addition, there are no T3-O areas immediately affected by the higher density or
intensity.
Future Land Use Plan/Neighborhood Comprehensive Plan
The Property's FLUM designation is Restricted Commercial, a category that is consistent with
the requested T6-O zoning. The designation of this area as Restricted Commercial in the Future
Land Use Plan Map is an acknowledgment by the City's Planners that the long term
development of this area should be one of more intensity and density. Significantly, the FLUM
designation includes not only the application Property, but the entire SW 7 Street corridor
(north and south from SW 12 Avenue to SW 17 Avenue, in recognition of its significance to

Little Havana and to the fact that this corridor was part of the former SD-14 Latin
Special District of Ordinance 11000.

any requests to reschedule, continue or defer my hearing date to the attention of the decision -making body for
its consideration and vote at the public hearing on which my application is scheduled to be heard. I understand
that any requests by the applicant to reschedule, continue or defer the hearing date that are granted shall incur
a $1,000.00 fee, per instance, as per the Code.
4. Applicable Florida Building Code requirements, or other applicable requirements, may affect my ability to obtain
a building permit even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions proposed, or built,
without permits. In addition, a Certificate of Use ("C.U.") must be obtained for the use of the property after it has
been approved at a zoning public hearing. Failure to obtain the required permits and/or C.U., Certificates of
Completion (C.C.), or Certificate of Occupancy (C.O.) will result in an enforcement action against any occupant
and owner. Submittal of the zoning public hearing request may not forestall enforcement action against the
property.
5. Zoning public hearing applications inconsistent with the Miami Comprehensive Neighborhood Plan ("MCNP")
should not be approved by the decision -making body and the recommendation by the City staff will be for denial
or deferral; therefore, I acknowledge that if the request is inconsistent with the MCNP and I decide to go
forward, then my request will be denied, or deferred by City staff, but not approved. I understand that I will not
be reimbursed for any fees paid. I also understand that any requests by the applicant to reschedule, continue or
defer the hearing date that are granted shall incur a $1,000.00 fee, per instance, as per the Code.
6. Any covenant to be voluntarily proffered must be submitted in word format to the Planning Department and to
the Office of the City Attorney through ePlan for review and comments from the Planning Department, Office of
the City Attorney, and any other City departments as deemed necessary. The covenant will be reviewed in
ePlan and the applicant will be notified of any necessary changes, corrections or comments through ePlan.
Once the covenant receives a recommendation of approval from the Planning department and as to legal form,
Hearing Boards staff will extract the approved covenant directly from ePlan to include as part of the agenda.
The applicant is responsible to submit to the Hearing Boards the signed covenant with a current Opinion of Title
no later than two (2) weeks prior to the initial public hearing. I understand that any requests by the applicant to
reschedule, continue or defer the hearing date that are granted shall incur a $1,000.00 fee, per instance, as per
the Code.
