SENATE BILL 1090, HOUSE BILL 829, OR SIMILAR LEGISLATION THAT PROHIBITS
AND REQUIRES REMOVAL OF ANY EXPRESS LANE OR TOLL ON STATE ROAD
826 (PALMETTO EXPRESSWAY) AND OPENS SAID EXPRESS LANE TO GENERAL
VEHICULAR TRAFFIC; DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED

A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR RON
DESANTIS AND THE MEMBERS OF THE FLORIDA LEGISLATURE TO ENACT
SENATE BILL 1090, HOUSE BILL 829, OR SIMILAR LEGISLATION THAT PROHIBITS
AND REQUIRES REMOVAL OF ANY EXPRESS LANE OR TOLL ON STATE ROAD
826 (PALMETTO EXPRESSWAY) AND OPENS SAID EXPRESS LANE TO GENERAL
VEHICULAR TRAFFIC; DIRECTING THE CITY CLERK TO TRANSMIT A CERTIFIED
COPY OF THIS RESOLUTION TO THE OFFICIALS NAMED HEREIN.
WHEREAS, the Florida Department of Transportation ("FDOT") has recently installed
separated express toll lanes on State Road 826 ("Palmetto Expressway") that require payment
for their use and do not allow for general access to all interchanges on the Palmetto
Expressway; and
WHEREAS, the Palmetto Expressway, though located at the City of Miami's ("City")
western boundary, forms an integral part of the regional transportation system that is used by
residents and visitors of the City; and
WHEREAS, the use of restricted express lanes inhibits regional mobility for the City's
residents and visitors by repurposing general traffic lanes for long -haul traffic at the expense of
those residents bound for nearby interchanges as well as inducing additional traffic to travel on
local roads, diminishing City residents' quality of life; and
WHEREAS, tolls for said express lanes burden the City's residents and visitors with
additional fees to use infrastructure already paid for through taxes collected by the State of
Florida; and
WHEREAS, House Bill 829 and Senate Bill 1090, currently pending in the State
Legislature, would prohibit tolls and express lanes on the Palmetto Expressway and require
removal of those currently in place; and
WHEREAS, the City Commission wishes to express its support for this legislation for the
reasons stated herein; and
WHEREAS, pursuant to Section 2-33(f) of the Code of the City of Miami, Florida, as
amended, the City Commission unanimously deems this Resolution to be of an emergency
nature in order to immediately protect the public health, welfare, and safety of the City's
residents;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the Preamble to this Resolution are
hereby adopted by reference and incorporated herein as if fully set forth in this Section.
Section 2. The City Commission hereby urges Governor Ron DeSantis and the
members of the Florida Legislature to enact Senate Bill 1090, House Bill 829, or similar
legislation that prohibits and requires removal of any express lane or toll on the Palmetto
Expressway and opens said express lanes to general vehicular traffic.
Section 3. The City Clerk is directed to transmit a certified copy of this Resolution to the
Governor, Senate President, House Speaker, and the Chair and Members of the Miami -Dade
County Legislative Delegation.
Section 4. The Resolution shall become effective immediately upon its adoption and
signature of the Mayor.'

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
