The nature of this item is to establish a resolution of the Miami City Commission, by a
four -fifths (4/5ths) affirmative vote, pursuant to section 18-92 of the code of the City of
Miami, Florida, as amended, after an advertised public hearing, ratifying, approving and
confirming the City Manager's finding of a sole source; waiving the requirements for
competitive sealed bidding procedures and authorizing the purchase of the arrow EZ-IO
("EZ-IO") intraosseous infusion system and accessories and the Rusch Airtraq SP
("Airtraq") laryngoscope and accessories, from Teleflex LLC ("Teleflex"), for the
Department of Fire -Rescue ("Fire -Rescue"), on an as needed basis, for a period of one
(1) year, renewable annually, subject to an annual finding of sole source by the Chief
Procurement Officer and approved by the City Manager; allocating funds from the end
user department's various sources of funds; with future purchases to be allocated from
the various sources of funds from Fire -Rescue subject to the availability of funds and
budgetary approval at the time of need. Authorizing the City Manager to negotiate and
execute all other documents including any amendments, renewals and extensions
subject to allocations, appropriations and budgetary approvals having been previously
made, and in compliance with applicable provisions of the Code of the City of Miami,
Florida, as amended, ("City Code"), including, the City of Miami's Procurement
Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in
Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in
compliance with applicable regulations, as may be necessary for said purpose.
Background of Item:
Fire -Rescue uses Airtraq to perform endotracheal intubation as its primary form of
airway management. In the field, getting a clear view of the trachea can be extremely
difficult. Airtraq is used on patients in emergency laryngoscopy procedures to get a
clear view of the larynx (voice box), the vocal cords, and nearby structures like the back
of the throat. Airtraq is the only video laryngoscope that uses a non -displacing blade
that does not move anatomy. Accordingly, EMS personnel can use the Airtraq on
patients with cervical collars, in traction, and those entrapped.
Fire -Rescue uses EZ-IO to perform intraosseous infusion, which delivers medications
and fluids directly into the bone marrow when intravenous access is not available or
feasible. The EZ-IO is comprised of proprietary and patented double -beveled tip
needles with a battery powered driver. EZ-IO is the only powered Intraosseous Infusion
having an U.S. Food and Drug Administration indication for emergent, urgent, and
medically necessary uses. EZ-IO includes a reusable driver that occasionally must be
replaced and single -use consumable needles and stabilizers that must be resupplied on
an ongoing basis.
EZ-IO and Airtraq are manufactured, sold, and serviced exclusively by Teleflex
Incorporated through its wholly owned subsidiary, Teleflex. Fire -Rescue personnel
experience a very high success rate using the EZ-IO and Airtraq, in contrast to
alternative but very different products that have a higher failure rate, causing faster
consumption of consumable supplies and compromising patient care.

A RESOLUTION OF THE MIAMI CITY COMMISSION, PURSUANT TO SECTION 18-
92 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"),
AFTER AN ADVERTISED PUBLIC HEARING, BY A FOUR -FIFTHS (4/5THS)
AFFIRMATIVE VOTE, RATIFYING, APPROVING, AND CONFIRMING THE CITY
MANAGER'S FINDING OF A SOLE SOURCE, ATTACHED AND INCORPORATED
AS EXHIBIT "A," WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED
BIDDING PROCEDURES, AND AUTHORIZING THE PURCHASE OF THE EZ-IO
INTRAOSSEOUS VASCULAR ACCESS SYSTEM AND ITS ACCESSORIES ("EZ-IO"),
AND THE RUSCH AIRTRAQ SYSTEM AND ITS ACCESSORIES ("AIRTRAQ"), FROM
TELEFLEX LLC, A FOREIGN LIMITED LIABILITY COMPANY AUTHORIZED TO
CONDUCT BUSINESS IN FLORIDA ("TELEFLEX"), FOR THE CITY OF MIAMI
("CITY") DEPARTMENT OF FIRE -RESCUE ("FIRE -RESCUE"), ON AN AS NEEDED
BASIS, FOR A PERIOD OF ONE (1) YEAR, RENEWABLE ANNUALLY, SUBJECT TO
AN ANNUAL SOLE SOURCE FINDING BY THE CITY'S CHIEF PROCUREMENT
OFFICER ("CPO") AND APPROVAL BY THE CITY MANAGER; ALLOCATING FUNDS
FROM FIRE -RESCUE'S VAROUS SOURCES OF FUNDS; WITH FUTURE
PURCHASES TO BE ALLOCATED FROM THE VARIOUS SOURCES OF FUNDS
FROM FIRE -RESCUE, SUBJECT TO THE AVAILABILITY OF FUNDS AND
BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS INCLUDING
ANY AMENDMENTS, RENEWALS, AND EXTENSIONS SUBJECT TO ALL
ALLOCATIONS, APPROPRIATIONS, AND PRIOR BUDGETARY APPROVALS, AND
IN COMPLIANCE WITH ALL APPLICABLE PROVISIONS OF THE CITY CODE,
INCLUDING THE CITY'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT,
AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF
THE CITY CODE, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN
COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS
MAY BE DEEMED NECESSARY FOR SAID PURPOSE.
WHEREAS, the City of Miami ("City") Department of Fire -Rescue ("Fire -Rescue") uses
the Rusch Airtraq System and its accessories ("Airtraq") on patients in emergency laryngoscopy
procedures to get a clear view of the larynx (voice box), the vocal cords, and nearby structures
in the back of the throat; and
WHEREAS, Fire -Rescue also uses the EZ-IO Intraosseous Vascular Access System
and its accessories ("EZ-IO") to perform intraosseous infusions, which deliver medications and
fluids directly into the bone marrow when intravenous access is not available or feasible; and
WHEREAS, Fire -Rescue personnel experience a very high success rate using the
Airtraq and EZ-IO, in contrast to alternative, and very different, products that have a higher
failure rate, causing faster consumption of consumable supplies and compromising patient care;
and
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as
amended ("City Code"), the finding from the City's Chief Procurement Officer ("CPO") that
Teleflex, LLC, a foreign limited liability company authorized to conduct business in Florida
("Teleflex"), is the sole source provider of the Airtraq and EZ-IO, and the City Manager approval
and adoption of the same, attached and incorporated, after an advertised public hearing, can be
ratified, approved, and confirmed by a four -fifths (4/5ths) affirmative vote of the City
Commission; and
WHEREAS, the CPO and the City Manager recommend that the requirements for
competitive sealed bidding procedures be waived and the sole source purchase of the Airtraq
and EZ-IO from Teleflex, be approved;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Pursuant to Section 18-92 of the City Code, after an advertised public
hearing, by a four -fifths (4/5ths) affirmative vote, the City Manager's finding of a sole source,
attached and incorporated as Exhibit "A," waiving the requirements for competitive sealed
bidding procedures, and authorizing the purchase of the Airtraq and EZ-IO from Teleflex for
Fire -Rescue, on an as needed basis, for a period of one (1) year, renewable annually, subject to
an annual sole source finding by the CPO and approval by the City Manager; allocating funds
from Fire -Rescue's various sources of funds; with future purchases to be allocated from the
various sources of funds from Fire -Rescue, subject to the availability of funds and budgetary
approval at the time of need, is hereby ratified, approved, and confirmed.
Section 3. The City Manager is authorized' to negotiate and execute all other
documents including any amendments, renewals, and extensions subject to all allocations,
appropriations and prior budgetary approvals, and in compliance with all applicable provisions of
the City Code, including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial
Integrity Principles, all as set forth in Chapter 18 of the City Code, all in a form acceptable to the
City Attorney, and in compliance with all applicable laws, rules, and regulations, as may be
deemed necessary for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
