A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5S)
AFFIRMATIVE VOTE, RATIFYING, APPROVING AND
CONFIRMING THE CITY MANAGER'S ACTIONS IN
ACQUIRING CERTAIN PROPERTIES IN THE MODEL
CITY HOMEOWNERSHIP ZONE, AS LISTED ON
ATTACHMENT NO. 1 AND INCORPORATED BY
REFERENCE; AUTHORIZING THE CITY MANAGER TO
EXECUTE ALL NECESSARY DOCUMENTS AND PURCHASE
AGREEMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR SAID PURPOSE.
WHEREAS, pursuant to Resolution No 01-160, adopted
February 15, 2001, the City Commission authorized and directed
the City Manager to move forward with certain predevelopment and
project related activities, including land assembly and
relocation activities to facilitate revitalization in the Model
City Homeownership Zone; and
WHEREAS, land assembly activities are currently underway
and purchase offers based on two City secured appraisal reports
have been made to property owners in an effort to move the
project forward; and
WHEREAS, in some instances, purchase offers have been made
that exceed the highest of the two appraisals as a result of a

negotiated purchase settlement between he City and the property
owner; and
WHEREAS, it is necessary that the City Commission approve
the City Manager's action -in a acquiring certain parcels' that
may have exceeded the highest appraised value; and
WHEREAS, the City has also acquired parcels listed on a
Miami -Dade County tax deed parcels list whereby based on he
payment of all outstanding real estate taxes and liens,
appraisals were not secured;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2.
By a four -fifths (4/5th5) affirmative vote,
the City Manager's actions in acquiring certain properties in
the Model City Homeownership Zone, as listed on Attachment No. 1
and incorporated by reference, is ratified, approved and
confirmed.

Section 3.
The City Manager is authorized-1/ to execute
all necessary documents and purchase agreements, in a form
acceptable to the City Attorney, for said purpose.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.31

If the Mayor does not sign this Resolution, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City
Commission.

correspondence from the Department of Comnuni t_y Development
advising that the Costs incurred in Fiscal Year 2002 was
disallowed because of its finding that the Trust's expenses did
not conform with HDD's Regulations; and
WREitr:AS, the Trust' o acquisition effort has been delayed
eubstantielly, in part, because of the concid.erable period of
time required for processing the environmental clearance and a
variety of changes in administration; and
WHEREAS, construction may not occur until Spring 2004 with
the projected release of a Request for Proposals for the Phase I
Development anticipated in Summer 20fl3; and
WHEREAS, the Trust .proposes that the tunde designated for
the Model City Infrastructure Improvemento in Fiscal Year 2003
be reprogrammed to replace the HOME Program Funds utilized in
r'isca1 Year 2002 for acquisitions to resolve issues related to
the eligibility of DOME Program Funds and minimise additional
delays in the acquisition phase; and

WHERE, one of the eligible uses or EOME Program Fund~ is
infrastructure; and
WRAkEAS, ROME Program Funds would be released and available
for infrasLructure uses anticipated for the Homeland
Defense/Neighborhood Improvement Bond proceeds with the
replacement of Homeland Defense/Neighborhoud Improvement Bond

A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), APPROVING THE
ACQUISITION OF CERTAIN PROPERTIES LISTED ON
"LISTS 1, 2, AND 3," ATTACHED AND
INCORPORATED, AS APPROVED BY THE MODEL CITY
COMMUNITY REVITALIZATION DISTRICT TRUST AND
ITS BOARD OF DIRECTORS, SUBJECT TO CERTAIN
REQUIREMENTS AND COMPLIANCE WITH ALL
FEDERAL, STATE AND LOCAL REGULATIONS; AND
ALLOCATING FUNDS DESIGNATED FOR THE MODEL
CITY TRUST IN THE BUDGET FOR FISCAL YEAR
2003, SUBJECT TO THE AVAILABILITY OF FUNDS.
WHEREAS, the Model City Community Revitalization District
Trust ("Trust"), a limited agency and instrumentality of the
City of Miami, wishes to purchase certain properties as listed
on "Lists 1, 2, and 3," attached and incorporated; and
WHEREAS, the Trust has secured contracts with the property
owners that fall within the parameters of the policies for
negotiation approved by the City Commission and the Trust's
Board of Directors; and
WHEREAS, the purchase price of each individual property to

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The acquisition of certain properties listed
on "Lists 1, 2, and 3," attached and incorporated, as approved
by the Trust and its Board of Directors is approved, subject to
certain requirements and compliance with all federal, state and
local regulations, is approved, as follows:
1.
The acquisition of the twelve (12) properties
listed on List 1, entitled "List 1, Model City
Trust, Vacant Land," is approved at the purchase
prices set forth.
2. The acquisition of the twenty-one (21) properties
listed on List 2, entitled "List 2, Model City
Trust, Vacant Properties with Buildings," is
approved at the purchase prices set forth subject
to confirmation that the properties were not
occupied at the time of the City/Trust's
commencement of negotiations with the property
owner.
3. The acquisition of the one (1) property listed on
List 3, entitled "List 3, Model City Trust,
Occupied Properties Log," is approved at the
purchase price set forth, subject to the proper
application of a Relocation Plan approved by the
Trust's Board of Directors.
Section 3. Funds for said acquisitions are allocated as
designated for the Model City Trust in the budget for Fiscal
Year 2003, subject to the availability of funds.

RECOMMENDATION:
1. It is respectfully recommended that the City Commission approve
the acquisition of the eighteen (18) properties that are vacant lots or
owner -occupied at the purchase prices listed and highlighted for
your review (see attached list 1).
2. It is respectfully recommended that the City Commission approve
the acquisition of the twenty-two (22) properties that contain
vacant buildings at the purchase prices listed and highlighted for
your review (see attached list 2) subject to staff confirming that the
properties were not occupied at the time of the City/Trust's
commencement of negotiations with the property owner.
3. It is respectfully recommended that the City Commission approve
the acquisition of the five (5) occupied properties at the prices listed
and highlighted (see attached list 3) subject to the proper
application of a relocation plan consistent with the relevant
regulations and laws regarding such issues.
BACKGROUND:
The City Commission executed a policy that requires that each property for
acquisition in the Model City Homeownership Zone project area that requires
two (2) appraisals on a property to establish the fair market value of the
property. Consistent with the Board's adoption of the City Commission's policy
for land acquisition in Community Revitalization Districts (Resolution No. 02-
678) that was subsequently adopted at the Board's meeting of July 16, 2002, staff
negotiated up to 15% above the average of the two appraisals. ..
The appraisers were selected from the City's qualified appraisers list established
as a result of a formal solicitation process. To ensure expedited processing of
.appraisal requests and more favorable pricing for the project given the
anticipated economies of scale, interested firms from that list were invited to

respond to a closed bid process for a rate schedule to perform appraisals
exclusively for the Model City Homeownership Pilot Project acquisitions.
You should also note that Evans Environmental & Geosciences (EE&G)
completed several environmental site assessments over the affected area. All
properties slated for approval here have received an environmental clearance
from EE&G through either the Areawide Phase I or the subsequent Phase II
where appropriate.
To facilitate your review and understanding of the material, please note that all
of the items discussed below are highlighted in the attached lists.
1. Vacant land (List 1)
Five (5) of the properties on List 1 were under contract with the City for more
than a year. Although these property owners had closing dates, the closings
could not occur because the U.S. Department of Housing and Urban
Development (HUD) had not yet given environmental clearance for the project.
Upon receipt of the clearance from HUD (which is attached), staff prepared new
offer letters for the negotiated purchase price.
With the delays in closing, the log which had been maintained to track offers and
purchase prices was updated to reflect the closing costs on these five properties
(Note 1).

As you know, that delay in closing occurred during a significant organizational
change that transitioned responsibilities for the Homeownership Zone from the
Department of Community Development to the Model City Community
Revitalization District Trust. Thus, the Trust's staff, charged with securing new
contracts for acquisition, inadvertently induded closing costs that were rolled
into the tracking log's price fields to produce the new offer letters and the
subsequent contracts.
Given the significant increase in property values in the area, staff believes that
the inflated cost (with the FY 2002 dosing costs) would be significantly less than
the cost would be if an additional appraisal were secured. State law authorizes
the City Commissiofi as the governing body to acquire property in excess of the
property's appraised value.

Prior to the adoption of Resolution No. 02-678 that established the policy of 15%
of the average of the two appraisals, the City Commission approved Resolution
No. 01-1044 that enabled the Administration to negotiated up to 15% above the
highest of two appraisals. The City Commission approved the purchase of
thirty-five properties where the property exceeded the highest appraisal in
Resolution 01-1043 (September 25, 2001). The following property meets that
condition although it also exceeds the parameters of the existing policy (Note 2):

At the Board meeting of January 13, 2003, the Board approved a policy that
would allow an offer of the current tax assessment to be made where the
property's assessed value exceeds the appraised values. The following property
meets that condition (Note 3):
■ MHZ 617 Randolph Thomson 1645 NW 55th Street
At its meeting of April 14, 2b03, the Board of Directors of the Model City Trust
approved the acquisition of vacant land on list one. Please find attached the
resolutions approved by the Board of Directors.
2. Vacant Properties with Structures (List 2)
Given the City's sensitivity to potential issues related to relocation assistance to
eligible residents of acquired properties, staff has agreed to make a Herculean
effort to confirm that no residents occupied the properties at the time the
City/Model City Trust initiated negotiations with the property owner. If staff
determines that residents may have occupied a property, those individuals will
be identified and granted relocation assistance consistent with the Trust's
approved relocation plan.
Staff is looking to the first sets of appraisals as its first source of information in
this regard. Where all appraisals confirm that the property is not occupied, staff
will consider this information is sufficient to proceed to dosing. If the appraisals
bear conflicting information or in some way fail to support that the property was
vacant, staff will work with the property owners to identify past residents and
secure all information regarding last known addresses to better track down the
individuals and ensure that these individuals receive the assistance to which
they are entitled. Where necessary and appropriate, additional resources will be
identified to ensure that this identification effort is successful.
Although most of the properties that were scheduled for closing in FY 2002 were
vacant lots, one had a structure. Thus, this property's purchase price is inflated

by closing costs as discussed with the aforementioned five properties on list 1
(please see list 2).
MHZ 458 Alex and Sonia Flowers 1420 NW 57th Street
At its meeting of April 14, 2003, the Board of Directors of the Model City Trust
approved the acquisition of vacant properties with structured on list two. Please
find attached the resolutions approved by the Board of Directors.
3. Occupied Properties (List 3)
At its meeting on July 16, 2003, the Board of Directors of the Model City Trust
approved several properties for acquisition at an amount that exceeded 15%
above the average of the two appraisals. As discussed with Note 1, the City
Commission as the governing body would have to approve a purchase above the •
appraised value consistent with State law.
Additionally, one additional` occupied property was approved by the Board of
Directors of the Model City Trust at its meeting of May 12, 2003 because
contained exclusively tenants who were receiving public housing assistance
either through HOPWA or the Section 8 program. This scenario limits the
Trust's relocation obligations to a needs assessment interview and moving
expenses at a minimum of $500 (or more if expenses are properly documented).
Each tenant has a case manager from the appropriate program (i.e. HOPWA or
Section 8) who is responsible for ensuring that the replacement housing meets
the necessary federal requirements. That property is as follows:
• MHZ 98 Faith Williams 1461 NW 60th Street
The Model City Trust has noticed all residents in properties targeted for
acquisition and has commenced the needs assessments on the residents in those
properties. These properties are not anticipated to close until all of the building
occupants are relocated consistent with federal and state law.
Because the Trust is looking to the City Attorney to conduct/schedule the
closings on these contracts and no Interlocal Agreement between the City of
Miami and the Model City Trust exists as yet, the City Attorney has asked that
the Trust . secure City Commission approval on the acquisitions prior to
proceeding with dosing.
