HomeMy WebLinkAboutR-19-0496City of Miami Resolution R-19-0496 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 6736 Final Action Date: 12/12/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), ESTABLISHING A NEW SPECIAL REVENUE PROJECT TITLED "FY 2020 MOTORCYCLE SAFETY INITIATIVE OVERTIME PATROL PROJECT"; APPROPRIATING FUNDS CONSISTING OF A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") FOR THE MIAMI POLICE DEPARTMENT IN THE AMOUNT OF $50,000.00, WITH NO MATCHING FUNDS REQUIRED, TO PROVIDE FUNDING FOR HIGHWAY SAFETY; AUTHORIZING THE CITY MANAGER TO EXECUTE THE GRANT AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH FDOT; AUTHORIZING THE CITY MANAGER TO DESIGNATE THE CHIEF OF POLICE OR ANY OTHER DESIGNEE TO EXECUTE THE NECESSARY DOCUMENTS FOR THE ACCEPTANCE OF REIMBURSEMENT FUNDS; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL NECESSARY DOCUMENTS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") submitted a grant application to the Florida Department of Transportation ("FDOT") to fund highway safety; and WHEREAS, the City received notification that said application was approved for funding in an amount not to exceed $50,000.00 for personnel services; and WHEREAS, the implementation of this project's cost will be allocated towards personnel services which will cover overtime salaries and benefits to include those provided pursuant to the Federal Insurance Contributions Act and Federal Labor Standards Act; and WHEREAS, funds from this grant will be used to continue the City's effort to decrease hazardous driving incidents involving motorcyclists, establish a campaign to bring awareness to pedestrian safety and lawful operation of motorcycles, and to enhance the Miami Police Department's ("MPD") enforcement efforts and deterrence capabilities to reduce motorcycle - related crashes and fatalities in the City; and and WHEREAS, the covering period for this grant is October 1, 2019 to September 30, 2020; WHEREAS, there are no matching funds for this grant; and WHEREAS, the City Manager is requesting authorization to accept the Grant and to establish a new Special Revenue Project for the appropriation of said award; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 6736 (Revision:) Printed On: 4/28/2025 File ID: 6736 Enactment Number: R-19-0496 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The following new Special Revenue Project is established and resources are appropriated as described below: FUND TITLE: FY 2020 Motorcycle Safety Initiative Overtime Patrol Project RESOURCES: FDOT $50,000.00 APPROPRIATIONS: Motorcycle Safety $50,000.00 Section 3. The City Manager is authorized' to execute the grant agreement, in substantially the attached form, with FDOT. Section 4. The City Manager is further authorized' to execute any and all necessary documents, all in a form acceptable to the City Attorney, for the purposes stated herein. Section 5. The City Manager is authorized' to designate the Chief of Police or any other designee to execute the necessary documents to implement the acceptance of reimbursable funds in an amount not to exceed fifty thousand dollars ($50,000.00), with no City matching funds required, for the overtime reimbursement of MPD's members conducting motorcycle safety checkpoints. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City Attor ey 12/3/2019 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City of Miami Commission.
