A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -
FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING,
RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S RECOMMENDATION
AND WRITTEN FINDING, ATTACHED AND INCORPORATED AS EXHIBIT "A," PURSUANT
TO SECTION 18-86 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED;
WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING METHODS AS NOT
BEING PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI ("CITY") FOR THE
PLACEMENT OF A SIGN OR ADVERTISING, AS DESCRIBED IN EXHIBIT "A" OF THE
DONATION AGREEMENT, FROM BIU, INC., A FOR -PROFIT CORPORATION ("BIU"),
WITHIN BELAFONTE TACOLCY CENTER, A CITY -OWNED PROPERTY LOCATED AT 6161
NORTHWEST 9 AVENUE, MIAMI, FLORIDA ("BELAFONTE TACOLCY CENTER");
AUTHORIZING THE CITY MANAGER TO ACCEPT A DONATION FROM BIU AT AN
ESTIMATED VALUE OF $44,500.00 IN THE FORM OF RESURFACING BASKETBALL
COURTS AT BELAFONTE TACOLCY CENTER; FURTHER AUTHORIZING THE CITY
MANAGER TO NEGOTIATE AND EXECUTE A DONATION AGREEMENT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR THE PLACEMENT OF THE SIGN OR
ADVERTISING AND THE ACCEPTANCE OF THE EQUIPMENT AND IMPROVEMENTS; AND
FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND
ALL OTHER NECESSARY DOCUMENTS, ALL IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, IN ORDER TO IMPLEMENT THE ACCEPTANCE OF SAID DONATION.
WHEREAS, the City of Miami ("City") owns the property located at 6161 Northwest 9
Avenue, Miami, Florida, known as Belafonte Tacolcy Center; and
WHEREAS, BIU, Inc., a for -profit corporation ("BIU"), wishes to donate equipment and
improvements with an estimated value of $44,500.00 to the City for Belafonte Tacolcy Center
and wishes to place a sign or advertising therein; and
WHEREAS, the City desires to enter into an agreement for the acceptance of
equipment, whereby BIU will grant and donate certain equipment to the City to be utilized at
Belafonte Tacolcy Center and for the placement of a sign or advertisement therein;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing,
the City Manager's recommendation and written finding, attached and incorporated as Exhibit
"A," pursuant to Section 18-86 of the Code of the City of Miami, Florida, as amended, are
ratified, confirmed, and approved and the requirements for competitive sealed bidding methods

are waived as not practicable or advantageous to the City to use for the placement of a sign or
advertising from BIU within Belafonte Tacolcy Center.
Section 3. The City Manager is authorized to accept a donation from BIU at an
estimated value of $44,500.00 in the form of equipment and improvements at Belafonte Tacolcy
Center.
Section 4. The City Manager is further authorized' to negotiate and execute a donation
agreement, in a form acceptable to the City Attorney, with BIU for the placement of a sign or
advertisement and the acceptance of the resurfaced basketball court at Belafonte Tacolcy
Center.
Section 5. The City Manager is further authorized' to negotiate and execute any other
necessary documents, all in a form acceptable to the City Attorney, in order to implement the
acceptance of said donation.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
