Background of Item: The Department of Parks and Recreation has been selected to receive a donation valued at $44,500 from BIU, Inc. to resurface a basketball court for the purpose of facilitation youth and adult basketball activities at Belafonte Tacolcy Park in conjunction with Miami Art Week. The artwork placed on the newly resurfaced court will incorporate trademarked logos and/or designs. This resolution accepts the donation, and authorizes the City Manager to execute all necessary documents to accept the donation. All costs associated with this project will be paid directly by BIU,Inc. and the project will be at no cost to the City. WHEREAS, the City of Miami ("City") owns the property located at 6161 Northwest 9 Avenue, Miami, Florida, known as Belafonte Tacolcy Center; and WHEREAS, BIU, Inc., a for -profit corporation ("BIU"), wishes to donate equipment and improvements with an estimated value of $44,500.00 to the City for Belafonte Tacolcy Center and wishes to place a sign or advertising therein; and WHEREAS, the City desires to enter into an agreement for the acceptance of equipment, whereby BIU will grant and donate certain equipment to the City to be utilized at Belafonte Tacolcy Center and for the placement of a sign or advertisement therein; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's recommendation and written finding, attached and incorporated as Exhibit "A," pursuant to Section 18-86 of the Code of the City of Miami, Florida, as amended, are ratified, confirmed, and approved and the requirements for competitive sealed bidding methods are waived as not practicable or advantageous to the City to use for the placement of a sign or advertising from BIU within Belafonte Tacolcy Center. Section 3. The City Manager is authorized' to accept a donation from BIU at an estimated value of $44,500.00 in the form of equipment and improvements at Belafonte Tacolcy Center. Section 4. The City Manager is further authorized' to negotiate and execute a donation agreement, in a form acceptable to the City Attorney, with BIU for the placement of a sign or advertisement and the acceptance of the resurfaced basketball court at Belafonte Tacolcy Center. Section 5. The City Manager is further authorized' to negotiate and execute any other necessary documents, all in a form acceptable to the City Attorney, in order to implement the acceptance of said donation. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
