HomeMy WebLinkAboutExhibitEXHIBIT - File No. 6601 CERTIFICATION AND DECLARATION OF RESULTS FOR THE CITY OF MIAMI GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 5, 2019 STATE OF FLORIDA ) COUNTY OF MIAMI-DADE ) CITY OF MIAMI ) I, Todd B. Hannon, City Clerk of the City of Miami, Florida, do hereby certify that all necessary legal steps were taken in connection with the conduct of the City of Miami General Municipal Election held on November 5, 2019, including, though not limited to, the following: I. Wednesday, October 23, 2019 A. Commencing at approximately 10:00 a.m. the Miami -Dade County Supervisor of Elections (hereinafter "Supervisor of Elections") conducted a Logic and Accuracy Test of the touch screen and optical scan voting systems to be used for the City of Miami's November 5, 2019 General Municipal Election (hereinafter "General Municipal Election") at the Miami -Dade Elections Department located at 2700 NW 87t1' Avenue, Doral, Florida (hereinafter "Elections Department"). B. A member from the City of Miami's Canvassing Board (hereinafter "Canvassing Board") compared the test results with the predetermined totals for each candidate used for the Logic and Accuracy Test and pursuant to the requirements established in Section 101.5612, Florida Statutes, observed the performance and results of all required tests and verified the correctness of the programs and equipment. C. I further certify that on Wednesday, October 23, 2019, two sets of documents containing the results of the Logic and Accuracy Tests validated that the tabulating equipment was functioning correctly and that said documents were signed off by the Supervisor of Elections and City Clerk. These documents were then placed in a sealed canvass bag using seal number 0051659. II. Thursday, October 31, 2019 through Tuesday, November 5, 2019 A. On Thursday, October 31, 2019, the Supervisor of Elections conducted the Pre - count Logic and Accuracy Test of the optical scan system used for vote -by -mail and provisional ballots at the Elections Department. Additionally, the process of opening vote -by -mail ballots and the duplication of damaged vote -by -mail ballots (as needed) began at 10:00 a.m. The task of opening vote -by -mail ballots was continued on an as -needed basis until Tuesday, November 5, 2019. Page 1 of 4 III. Tuesday, November 5, 2019 A. At approximately 5:00 p.m., the Canvassing Board met at the Elections Department to canvass presumed invalid vote -by -mail ballots. After the completion of this task, the tabulation of election results, including only the vote - by -mail ballots that were deemed valid by the Canvassing Board, was finalized and the Supervisor of Elections presented me with the UNOFFICIAL election results for the General Municipal Election. Pursuant to Section 101.68(4), Florida Statutes, voters whose vote -by -mail ballots were presumed to be invalid by the Canvassing Board have the right to present written evidence supporting their eligibility to vote to the Supervisor of Elections no later than 5:00 p.m. on the second day following the election. The deadline to provide said evidence was Thursday, November 7, 2019, by 5:00 p.m. B. Additionally, the sealed canvass bag (seal number 0051659) containing the results of the Logic and Accuracy Test conducted on Wednesday, October 23, 2019, was opened and one set of documents was retained by the Supervisor of Elections and the other set was retained by the City Clerk. IV. Thursday, November 7, 2019 A. The Canvassing Board met at the Elections Department at approximately 5:00 p.m. to canvass presumed invalid vote -by -mail ballots and provisional ballots cast on Election Day. Pursuant to Sections 101.68(4) and 101.048(1), Florida Statutes, persons casting vote -by -mail ballots and provisional ballots have the right to present written evidence supporting their eligibility to vote to the Supervisor of Elections no later than 5:00 p.m. on the second day following the election. The deadline to provide said evidence was Thursday, November 7, 2019, at 5:00 p.m. After the Canvassing Board reviewed presumed invalid vote - by -mail ballots in addition to provisional ballots cast on Election Day, I received the certified OFFICIAL election results for the General Municipal Election. B. Additionally, the Canvassing Board randomly selected a voting precinct associated with the General Municipal Election for the post -election manual audit which resulted in Precinct 995.0 being selected. V. I further certify and declare that: • for District 1 Commissioner, no candidate received a majority of votes cast and therefore a Run -Off Election will be required to determine who will be elected to the District 1 seat. Per City of Miami Charter Section 4(b), Alex Diaz de la Portilla and Miguel Angel Gabela, having received the greatest number of votes cast in the General Municipal Election, shall be placed on the ballot for the Run - Off Election scheduled for November 19, 2019; • for District 2 Commissioner, Ken Russell received more than fifty percent plus one of all votes cast and is hereby declared to have been elected as Miami City Commissioner. for District 2; • for District 4 Commissioner, Manolo Reyes ran unopposed. Pursuant to Section 101.151(7), Florida Statutes, "...the names of unopposed candidates shall not appear on the general election ballot. Each unopposed candidate shall be deemed to have voted for himself or herself" Additionally, pursuant to Miami City Code Page 3 of 4 Section 16-8, "[I]f, at the close of the qualifying period there is only one candidate's name listed on the general municipal election ballot for mayor or for a city commissioner for a specific district seat(s), no election for mayor or for a city commissioner for a specific district seat(s) shall be required, and said candidate or candidates shall be declared elected for that particular term(s) of office as of five days after the date of the scheduled general municipal election." In accordance with Florida State Statutes and the Miami City Code, Manolo Reyes is hereby declared to have been elected as Miami City Commissioner for District 4. VII. Friday, November 8, 2019 A. On Friday, November 8, 2019, the Canvassing Board met at the Elections Department at approximately 2:00 p.m. to conduct a post -election manual audit in accordance with Florida Division of Elections Rule 1S-5.026. The audit entailed audit teams from the Elections Department manually counting the ballots cast during vote -by -mail voting, early voting and Election Day voting for precinct 995.0. Upon the completion of the audit I received the Voting System Post -Election Audit Report. WITNESS my hand and the official Seal of the City of Miami, Florida, this 12t1, day of November 2019.
