HomeMy WebLinkAboutR-19-0461City of Miami Resolution R-19-0461 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 6733 Final Action Date: 11/21/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), BY A FOUR FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDINGS, ATTACHED AND INCORPORATED AS COMPOSITE EXHIBIT "A," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY"); WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION AND APPROPRIATION OF GRANT FUNDS FROM REMAINING FUNDS OF THE MIAMI SPORTS AND EXHIBITION AUTHORITY IN A TOTAL AMOUNT NOT TO EXCEED TWO HUNDRED THIRTY TWO THOUSAND DOLLARS ($232,000.00) FROM THE SPECIAL REVENUE FUND TITLED DEPARTMENT IMPROVEMENT INITIATIVES ACCOUNT NO. 15500.980000.548000.0.0 TO MARTIN LUTHER KING ECONOMIC DEVELOPMENT CORPORATION, A FLORIDA NOT -FOR -PROFIT CORPORATION ("MLKEDC"), IN SUPPORT OF MLKEDC ORGANIZING THE DR. MARTIN LUTHER KING, JR. CANDLELIGHT VIGIL EVENT TO BE HELD IN 2020 IN THE CITY OF MIAMI; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL GRANT DOCUMENTS NECESSARY, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Commissioner Keon Hardemon WHEREAS, Martin Luther King Economic Development Corporation, a Florida not for profit corporation ("MLKEDC"), is seeking funding to support its organizing of the Dr. Martin Luther King, Jr. Candlelight Vigil Event ("Event") to be held in 2020 in the City of Miami ("City"); and WHEREAS, the Event, as described in further detail in Composite Exhibit "A" which is attached and incorporated herein, provides, among other things, that MLKEDC will organize the Event; and WHEREAS, pursuant to Ordinance No. 13801, adopted on October 25, 2018, the City Commission abolished the Miami Sports and Exhibition Authority ("MSEA"), provided that all fund balances remaining in MSEA accounts be transferred to the City, and authorized the City Manager to accept and appropriate said funds in accordance with all applicable local, State and Federal laws; and WHEREAS, the City wishes to provide grant funds to MLKEDC from the Special Revenue Fund titled Department Improvement Initiatives, which includes the remaining funds from MSEA Account No. 15500.980000.548000.0.0 in a total amount not to exceed Two City of Miami Page 1 of 2 File ID: 6733 (Revision:) Printed On: 4/28/2025 File ID: 6733 Enactment Number: R-19-0461 Hundred Thirty -Two Thousand Dollars ($232,000.00) ("Funds") for the Event; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has made a written finding, attached and incorporated as Composite Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds for the Event; and WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute any and all grant documents necessary, all in a form acceptable to the City Attorney, for said allocation, appropriation, and use of Funds by MLKEDC for the Event; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the City Code, by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written findings, attached and incorporated as Composite Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds to MLKEDC for the Event and waiving the requirements for said procedures are hereby ratified, approved, and confirmed. Section 3. The City Manager is authorized' to allocate and appropriate from remaining MSEA the Funds from the Special Revenue Fund titled Department Improvement Initiatives, Account No. 15500.980000.548000.0.0 to MLKEDC in support of MLKEDC organizing the Event to be held in 2020 in the City. Section 4. The City Manager is further authorized' to execute any and all grant documents necessary, all in a form acceptable to the City Attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity Attor ey 11/12/2019 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
