A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AMENDING THE CITY OF MIAMI'S DEPARTMENT OF HOUSING AND
COMMUNITY DEVELOPMENT'S AFFORDABLE RENTAL HOUSING
PRESERVATION PROGRAM POLICY TO ALLOW PROGRAM FUNDS TO BE
USED FOR PROPERTY ACQUISITION, AS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY
AND ALL NECESSARY DOCUMENTS, ALL IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, FOR SAID PURPOSE.
WHEREAS, the supply of affordable housing has failed to keep pace with demand which
has driven housing prices up and has made many City of Miami ("City") neighborhoods less
affordable; and
WHEREAS, according to a study performed by the Florida International University Jorge
M. Perez Metropolitan Center ("FIU Study"), the City loses approximately 1,200 affordable
housing units each year due to increasing cost; and
WHEREAS, in accordance with recommendations set forth in the FIU Study, the City
should first stem the loss of affordable housing units before creating new units; and
WHEREAS, the City's Department of Housing and Community Development's
Affordable Rental Preservation Program Policy ("Policy") is designed to help stem the loss of
affordable housing units in the City; and
WHEREAS, the City's Administration recommends that the Policy be amended, as more
particularly described in Exhibit "A," attached and incorporated, in order to allow for property
acquisition to preserve affordable housing units;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The amendment of the Policy to allow program funds to be used for property
acquisition, as more particularly described in Exhibit "A," attached and incorporated, is
authorized.'

Section 3. The City Manager is authorized' to negotiate and execute any and all
necessary documents, all in a form acceptable to the City Attorney, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
