The Applicant, GR OPCO, LLC, is requesting pursuant to Section 7.2.6 (a) an extension of an allegedly legal, nonconforming Use "for an additional twenty years through May 20, 2050". In reviewing the Analysis for Exception and other documents, I hereby formally request that the Application be re-evaluated and that the following issues that need to be corrected b4- addressed in the Commission Hearing next Thursday: 1. Ordinance #13566 (14-01304zt1) — Adopted September 24, 2015. This Amendment served to clarify (not revise) language regarding the initial twenty-year clock by right by confirming that. "...the Use may be continued for twenty (20) years from the date the Use first became legal nonconforming and consistent with the regulations of this section". In your analysis, you represented that the subject property's (29 NE 11'^ Street) adult entertainment Use became nonconforming with the -approval of Ordinance 11916. Exhibit A provides a copy of Ordinance #11916 showing that this ordinance was adopted on April 13, 2000 on final reading by the City Commission prohibiting "Adult Use" within the C-2 Liberal Commercial District. Ord. 11916 took effect per its expressed terms on May 13, 2000. Please confirm that if in fact the Applicant has a legal nonconforming Use for Adult Entertainment, said Use would expire no later than Mav 14, 2020? If that is the case, then the record should be corrected to reflect that the Applicant can seek an additional twenty years, pursuant to Section 7.2.6 (a), which would terminate on or before May 14, 2040. As you know, Section 937 of Miami 11000 allows for Adult Entertainment, by right, if (in part), the proposed establishment is not, "...located within six hundred (600) feet of any residentially zoned property" (Exhibit B). Pursuant to Section 937.3 (c) of Miami 11000, the establishment can only be approved "...for a certificate of use only when the application therefore is accompanied by a survey by a land surveyor registered in the State of Florida showing that the requirements...have been met". I have attached as Exhibit C a Certificate of Occupancy issued to a thirty -story, 463-unit residential property with an address of 915 NW 1st Avenue. This property, by the Applicant's own admissions in both a 2013 Warrant application and a 2018 Exception application, is approximately 387 feet from the subject property. The attached C of 0 for 915 NW 1st Avenue provides a date of October 1, 1990. Exhibit D provides a certified copy of the subject property's "Previous Business Usage", confirming that the residential property was built and open a decade prior to any alleged adult use being established at the subject property. Please confirm that the subject property. under Miami Code 11000, Section 937, would not have been entitled to Adult Use by right as it was within 600 feet of a residential property. Please confirm that there is no survey or any record of any survey being submitted pursuant to the obligations clearly articulated in Section 937. 3. Illegal Nightclub in a Warehouse. In the Analysis for this proposed Exception (PZ-19-649 EX), the following statements under "Permit History for the Site" are proffered: "...On May 18, 2001, the Planning and Zoning Department issued a Class II Special Permit #01-0123, to allow the operation of an Adult Nightclub, "Gold Rush", located within the "Entertainment Specialty District". "...In 2001, the Building Department issued Permit No. BD#01-5012635 to allow construction of a Structure". "...On August 19, 2003, a Certificate of Use (CU# 032546) was issued to allow Gold Rush Adult Nightclub to operate within the Structure". I have attached Exhibit E which confirms that a 4COP liquor License was approved to be transferred to the subject property ("Gold Rush" — 29 NE 11th Street) on November 8, 2000. In the Letter of Intent submitted for the Class II Special Permit approved on May 18, 2001, council of record, Ben Fernandez, Esq. and on behalf of the Applicant Page 2 of 5 Submitted into the public recor,�f��iy r�i(�S) QZ.'L on 11 CityClerk represented that, "...The owners of the property were previously granted a Class II Special Permit and have been in operation since" (Exhibit F). The Previous Business Usage (Exhibit D) confirms that the subject property was zoned as an "Industrial Storage/Distribution" facility until, as the Analysis for Exception indicates, August 19, 2003 wherein the C of U for a Nightclub and Commercial Food Services Establishment was granted. Please confirm that the subiect property did NOT comply with "zoning requirements for the sale of alcoholic beverages or wholesale tobacco products" pursuant to an application for a series 4COP alcoholic beverage license UNTIL August 19, 2003. Please confirm that it is illegal to sell or distribute alcoholic beverages. under Miami 21 or previous Miami code, in a warehouse. 4. Illegal Warrant. In 2013, the Applicant for the current zoning Exception, applied for a warrant to "remodel" the property. Included in the more than 150 pages of architectural renderings were demolition plans that confirm that construction would include "Gut and Roof Demolition" (Exhibit G). It is obvious that this project was not a "remodel" and that significant alteration, as defined by Miami 21, was completed and included but was not limited to: (1) removal and addition of stairways; (2) addition of an elevator; (3) addition of bars on the "mezzanine" floor; (4) change of entrance, etc.). Pursuant to Sections 7.2.3.b.(1) and 7.2.6.c1.(b), any alteration of a nonconforming Structure containing an allegedly nonconforming Use shall be limited to fifty percent (50%) of the total square footage. Please confirm that the Applicant actually altered the property, which required two zoning Exceptions and more importantly, a 50% square footage limitation on the alteration of the subject property. 5. Violation of Chapter 36 and the 2013 Warrant. In the current 2019 Exception request packet, Snapshot-34389 recommends approval with numerous conditions including: "12. It shall be unlawful to play or operate music boxes, jukeboxes, radios, musical instruments or any other musical devices on or about the premises between the hours of 11:00 p.m. and 7:00 a.m. the following day, unless said music devises are played or operated within an enclosed building..." In 2013, Warrant 13-0058 included several Findings in the Decision Letter, including: Page 3of5 Submitted into the public .1 record for ite (s) City Clerk on "...Any noise generated on the site shall conform to Chapter 36 of the City Code noise regulations"; and "...Applicant is proposing to renovate the space for the existing adult entertainment nightclub and to add a new second floor to house a separate, independent non -adult entertainment nightclub with food service and outdoor seating area". The traffic study required for the Warrant described facility operations as follows: "...the proposed quality restaurant will operate as a full -service eating establishment until 11:00 PM and afterward will be utilized as a Night Club".1 Given that Warrant 13-0058 granted 24-hour alcohol service to this outdoor, open-air terrace, please confirm the following: By playing music outside after 11:00 p.m.. the Applicant repeatedly violated both the conditions set forth in the 2013 Warrant and Chapter 36 (section 36-5) of City of Miami Code. 6. Illegal Expansion of a Nonconforming Use. As you know, the 2018 zoning Exception granted by the PZAB on May 16, 2018 allowed for the expansion of the allegedly legal, nonconforming Use to the 2014 constructed, Miami 21 complaint, open-air "ultra -lounge" terrace and restaurant. 1 In case there is any question about the fact that music was played after 11:00 p.m. on Elleven's open- air, outdoor terrace, the following should be noted: (1) meeting minutes produced by a resident on 2/18/2016 following a meeting between noise complaining residents, police and the 11th Street clubs, Peter Maddock writes, "Touche (Elleven) may not be the sole source of noise the subject of the current complaints, but since the opening of Touche, the noise output from the Club Area has once again become excessive and wholly unacceptable. Residents are moving to the rear of their apartments to sleep or making plans to be away for the weekends. The Touche open roof top that was publicized as a restaurant appears to have become a full blown nightclub blasting music into neighboring areas; (2) on 8/16/16 and in response to sound complaints, Elleven's Director of Security (Adam Gould) emails the Downtown NET Police Commander and admits to "digitally monitoring the sound on an hourly basis when the roof deck is open" (Exhibit "H"); and (3) during a site inspection on Elleven's terrace by the Director of Code Compliance and the Chief of Staff for Commissioner Russell on 2/11/17 at approximately 2:30 a.m., it was noted in an email that the rooftop lounge was operating and that the Director would assist Ellven in working with the City to enclose the terrace. Rather than shut them down, Elleven continued to play music illegally after 11:00 p.m. until May of 2018. Please confirm. pursuant to Section 7.2.6. c.1. (a), that Miami 21 strictly prohibits the expansion of a nonconforming Use "...if a portion of the structure was unoccupied or not manifestly designed for the nonconforming Use..." Given that the Miami 21 compliant rooftop structure did not exist in 2000 when the alleged adult Use became nonconforming, please confirm that said Use cannot be expanded to the newly constr cted terrace. Where property in the City of Miami borders upon property of another city or Dade County, the term "residentially zoned property'" shall be those zoning districts designated as residentially zoned by the terms of the zoning ordinance of the external jurisdiction.
