Miami 21 sought to CLARIFY that the initial 20-year clock by right that begins at the time the Use becomes nonconforming (see attached). • "No calls for service". The Planning and Zoning Staff and/or the Applicant alleged that "The Adult Entertainment Use has not received any calls for service from the Miami Police Department on complaints since April 17, 2018". o See attached Summary Chart of Calls — 453 calls in total o Ten Calls of which were fully redacted and violated Public Records Statutes — removal of redaction shows 8 aggravated assaults and 2 sex offense calls. I have attached a report regarding the Neighborhood Administrative Funding Services ("NAFS") which clearly evidences very serious concerns (including financial) related to off - duty policing in the Entertainment District. This includes surcharge payments for 11 months of 2018 that were not invoiced until February 2019. The invoice itself was generated on February 27, 2019, strongly indicating that NAFS was likely not registered as an off -duty purchaser after MEDA was terminated in January 2018. II. VIOLATION of the sound ordinance (36-5) AND a Warrant granted in 2013 to the subject property. During the 2018 Exception Hearing, the Applicant sold themselves to be "good neighbors" by offering to install a roof on their open-air terrace. This fee is very successful. But if you have a restaurant, you're going to have at least ten to 20 people coming in, which makes a difference in the amount of cars. Thank you. Renita Holmes: Good afternoon, Mr. Chair. Again, just for a point of clarity, in the language -- I'm reading it -- it made a statement in regards to how many years -- well, can -- does this allow -- through the Chair, Madam Attorney, does this language say that you can tear somebody's building down if it does not conform according to -- Victoria Mendez (City Attorney): No. Ms. Holmes: -- the 2010 date that was said upon, is that --? Ms. Mende_: No. It's just that they have to come to the City Commission for any continued use; that it's just not automatic. That's just the -- Ms. Holmes: It's not automatic, but if it's nonconformance within 20 years as of 2010, it can still cause your building to be torn down. Is this -- I mean, you're the attorney. Well, all of you are, actually. Mr. Garcia: I'll clar5, if I may. This pertains to uses; not to structures. So if the structure is still sound of structure -- in other words, it's sustainable and can be occupied safely -- the structure is in no danger of being torn down; however, a use that becomes nonconforming -- and I will give you an example that comes to mind. Adult entertainment facilities which become nonconforming, they have then a 20-year sunset period in which they can amortize their investments, presumably, but after those 20 years, then they would be out of compliance, and they would be expected to close shop. Ms. Holmes: I'm okay with that one. Can you find another one? I mean adult use -- I'm just kidding. I guess it's not quite -- because I see if you're adult use, we don't care too much for adult use, although I see them -- Ms. Mender: How about a gasoline station in a T3 area? Ms. Holmes: (UNINTELLIGIBLE) yeah, in a T3. Ms. Mendez: A gasoline station. Ms. Holmes: Most -- yeah. Ms. Mender: That's a good example that something was reset now to T3, and all of a sudden, there's a gasoline station in the middle, you know. WHEREAS, the Miami Planning, Zoning and Appeals Board, at its meeting on March 24, 2015, following an advertised public hearing, adopted Resolution No. PZAB R-15-014, by a vote of eight to zero (8 to 0), Item No. 9, recommending approval of an amendment to Ordinance No. 13114, as amended, to the City of Miami City Commission; and WHEREAS, on October 22, 2009, the City Commission adopted the Miami 21 Code ("Code"), Ordinance No. 13114, as the City of Miami's Zoning Ordinance; and WHEREAS, the intent of the Code is to allow legal nonconformities to continue but not allow expansions or enlargements of legal nonconformities; and WHEREAS, once legal nonconforming Uses cease, they may not be re-established, except under the terms of Section 7.2 of the Code only with the granting of an Exception by the City Commission; and WHEREAS, the intent of the Code is to allow legal nonconforming Uses to continue for only twenty (20) years from the date the use first became legal nonconforming; and WHEREAS, legal nonconforming Uses are lawful Uses that would not be permitted under the Code as new uses; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its citizens to amend its Code as hereinafter set forth. PROCEDURES AND NONCONFORMITIES 7.2.4 Moving a Nonconforming Structure on the Same Lot A nonconforming Structure may be moved on the same Lot only pursuant to an Exception. In addi- tion to satisfying the Exception criteria, the following criteria apply: a. The proposed movement must reduce the degree of nonconformity to the maximum extent rea- sonably feasible, or eliminate the nonconformity; b. The Structure shall in no case be moved in such a manner as to increase the degree of noncon- formity; and c. Where a nonconforming Structure is moved to a location not on the same Lot, the Structure and all new construction shall thereafter conform to the regulations for the Transect Zone to which it is moved. 7.2.5 Locally Designated Historic Resources—Nonconformities <4(7.2.6 a. Definition A locally designated historic resource is a Building or Structure listed in the Miami Register of Historic Places that has been deemed individually significant for its contribution to Miami's his- tory and sense of place; or is a part of a locally designated historic district where the individual Building or Structure is deemed to add to the historic architectural qualities or historical associa- tions, and the Building or Structure has been so designated through the formal public process provided in Chapter 23 of the City Code. b. Generally Nonconforming locally designated historic resources shall be subject to the regulations of this section, except as they may be granted certain waivers or an exception for preservation purposes by the Historic and Environmental Preservation Board pursuant to Chapter 23 of the City Code. Nonconforming Uses a. Time Limitation Where, at the effective date of adoption or amendment of this Code, a lawful Use exists which would not be permitted under this Code, the Use may be continued for twenty (20) years consistent with this section. Legally established alcoholic beverage establishments, having a valid Certificate of Use or certifi- cate of occupancy and all other required permits, may continue in existence despite subsequent establishment of a church or school within the distance limitations of Chapter 4 entitled "Alcoholic Beverages" of the City Code. c. Replacement and Expansion of Structures that Contain Nonconforming Use 1. No enlargement, extension, replacement, or reconstruction of an existing Structure which contains a nonconforming Use shall be permitted except to change the Use to a conforming Use, except as provided below: (a) Interior Arrangement A nonconforming Use may be extended throughout any parts of a Structure which was clearly designed or arranged for the nonconforming Use at the time that the Use became nonconforming. If a portion of a Structure was unoccupied or not manifestly designed for the nonconforming Use, the Use may not be expanded within the Structure. (b) Alterations to the extent of less than fifty percent (50%) of the square footage of a Struc- ture containing a nonconforming Use Where an alteration of a Structure containing a nonconforming Use is less than fifty percent (50%) of the square footage of the Structure at the time of alteration, the nonconforming Use may be permitted to continue pursuant to an Exception. (c) Exterior No nonconforming Use which exists outside a Structure shall be extended to occupy more area than was occupied at the time the Use became nonconforming, except as approved by Exception and to comply with the non Use regulations of the Transect in which it is located. In this case, the occupancy of the new location shall be construed as remaining a nonconforming Use. 2. Extending / Transferring the Nonconforming Use No nonconforming Use shall be extended to occupy any other Structure on the same Lot or parcel if the other Structure was not used for the nonconforming Use at the time the Use became nonconforming. 3. Subdivision or structural additions Structures used for nonconforming Uses shall not be subdivided, nor shall any Structures be added on the premises, except for conforming Uses and Structures. d. Provided, however, the time period shall not include any time during which the discontinuance is caused by governmental action which impedes access to the premises. 7.2.7 Nonconforming Lots a. Nonconforming Lot A nonconforming Lot may continue and may be used as provided by this section. A noncon- forming Lot is one shown on the latest recorded plat or described by deed, both as recorded in the public records of Miami -Dade County, which met the width, length and area requirements in effect when the Lot became of record, and which Lot would not conform to the requirements of this Code. b. Street or alley closure When a Lot has become nonconforming due to a street or alley vacation or closure, the Lot may be modified pursuant to an approval by the Director of the Public Works Department as long as the degree of nonconformity created by the vacation or closure is not increased. c. Rules concerning combinations of contiguous nonconforming Lots in the same ownership and with common Frontage for T3 Transects only. 1. Combinations required (a) If two or more Lots, or combinations of Lots and portions of Lots, with continuous Front- age in the same ownership exist at the time of passage or amendment of this Code, and if all or part of the Lots do not meet the requirements for Lot width and area, the lands involved shall be considered an "undivided parcel" for the purposes of this Code. Except as provided below in paragraph c.2., no portion of an undivided parcel shall be used or sold in a manner diminishing compliance with general Transect requirements for Lot width and area. (b) The undivided parcel shall be considered one Lot for which only one Single -Family Resi- dence or duplex may be constructed, regardless of how many nonconforming Lots make up the parcel. (c) A unity of title, or covenant in lieu of unity of title, which complies with all applicable requirements of the City Code shall be required on all undivided parcels prior to the is- suance of any building permits, including demolition permits. 2. Exceptions to the combination requirement Notwithstanding paragraph c.1, where nonconforming Lots with continuous Frontage in the same ownership exist at the time of passage or amendment of this Code, such Lots may be developed individually, in accordance with the applicable code requirements and pursuant to a Waiver, if such Lots individually comply with any of the following exceptions. Definition on q%6�9 City Clerk A nonconformity as used in this Code is an existing Use, Structure, Lot or site improvement that is in compliance with the zoning regulations that were applicable to it when it was established, and for which all required permits were issued, but which does not conform in whole or in part to the regulations of this Code. Such nonconformity is legal and may continue except as regulated by this section. 1. A nonconformity may also be created where the lawful use of eminent domain or an order of a court of competent jurisdiction has affected the lawfully existing Use, Structure, Lot or site improvement in a way so that the property does not comply with this Code. In this instance, the nonconformity is legal and may continue except as regulated by this section. 2. A change in tenancy, ownership, or management of a nonconforming Use, Structure, Lot or site improvement shall not be construed to create a nonconformity, provided the change is otherwise lawful and in compliance with this Code. b. Intent concerning nonconformities generally. It is the intent of this Code that nonconformities may continue but are not encouraged to expand or enlarge, and once they cease they may not be re-established, except under the terms of Sec- tion 7.2. c. The existence of nonconformity shall not be used as a reason to add new Uses, Structures, or site improvements that are not allowed by the regulations of the Transect Zone in which it is located. d. The temporary or illegal Use of property shall not be sufficient to establish the existence of a nonconformity or to create rights in the continuation of a nonconformity until it shall come into compliance with the regulations of this Code. e. If at any time a nonconforming Structure, or any Structure containing a nonconforming Use, becomes unsafe or unlawful by declaration of the City of Miami, Miami -Dade County Unsafe Structures Board, or other government agency having jurisdiction, the Structure shall not there- after be restored or repaired and the Use shall not be reestablished except in conformity with the regulations of the Transect Zone in which it is located. 7.2.2 Structures and Uses in the Event of Disaster a. City Clerk Investigation: Neighborhood Administrative Funding Services (NAFS, Inc.) Report by Michael Slyder Introduction: The Miami Entertainment District Association (MEDA) was formed in February of 2010; as a nonprofit 501(c)6, MEDA collected membership dues from nightlife businesses to, in part, fund the Enhanced Police Services (EPS) program. As a community policing model, the Miami Police Department provided "Zone Policing" wherein officers would cover specific zones and as such, did not work directly for any of these establishments. Critical to the success of the model was the involvement of Neighborhood Resource Officers (NROs) who: (1) served as intermediaries between the police and businesses; (2) handled complaints, surprise inspections and licensing review for the clubs; (3) organized and provided security training; and (4) did not get paid or work for MEDA. In 2011, MEDA presented the EPS program at a Problem -Oriented Policing (POP) Conference and placed second out of 72 projects world-wide. I was a founding member of MEDA, first serving as Vice President and then President (I was also Chair of the Research Committee), until my resignation on December 20, 2017. On March 7, 2018, Ken Ratner, MEDA's Treasurer, sent an email informing the membership that MEDA would be cancelled and a new, for profit business entity — "NAFS" —would take its place (Exhibit "A").1 I have also attached the corporate filing for NAFS (Exhibit "B"). I called Jorge Nunez (Vice President) and asked him why MEDA needed to be terminated. His response was nonsensical as he claimed that MEDA should have paid sales tax on policing services since its inception in 2010. Exhibit "C" clearly provides that "law enforcement and public safety services" are exempt from sales tax. Exhibit "A" includes a program overview or summary of NAFS; the model significantly revises the MEDA policing system. In 2017, largely due to Miami World Center and other development, the membership in MEDA had dwindled to four or five members, all of which were located on 11`h Street. As a result, the coverage was limited to one zone. In the NAFS system, there are two zones, one managed by Space Nightclub and the other by Elleven, which in effect means that policing services are now directly managed and positioned by ONE club. For example, as "Lead Participant", Elleven manages and is financially responsible for the "North Zone", which includes the following "Additional Participants": (1) M&M Parking; (2) Corner Bar; and (3) All -Day Coffee Shop. The Corner Bar was never a member of MEDA and the All Day Coffee Shop is a daytime business. It is very likely then that Elleven is paying the lion's share of the dues and has only M&M parking as an additional member. This violates a principle rule of MEDA and the Miami Police Department's policy of no direct hiring of police for 4COP licensed establishments. Additionally, Space and Elleven now have their own cell phones to contact the sergeant on duty, rather than one phone for the entire system. For all intent and purposes then, there are two separate officer details — one positioned near or at Club Space and the other at Elleven. This is not "zone policing" and this direct relationship between the police officers and the two "Lead Participants" is, in my opinion, something that needs to be immediately investigated and addressed as a potential conflict of interest and as such, a significant liability for the City of Miami. 1 While MEDA's name had grown to be viewed as unfavorable to a number of residents, there was no reason to terminate the non-profit entity. A simple name change would have allowed the membership to keep a well established non-profit. Obviously, a 501(c)6 organization is subject to public inspection and "no part of the net earnings inures to the benefit of any private shareholder or individual". Page 1 of 4 Submitted into the pub"jc record fo ite s) . on Club Elleven's PZAB Hearing for Exception PZAB-R-19-028: On July 17, 2019, GR OPCO, LLC (operating company for Elleven Nightclub) appeared before the Planning, Zoning and Appeals Board ("PZAB") to ask for a recommendation to be approved for a time extension, pursuant to Article 7.2.6(a), for the nonconforming Use (Adult Entertainment) through May of 2050. In the Zoning Analysis submitted by the Planning and Zoning Department, it was asserted that, "...The Adult Entertainment Use has not received any calls for service from the Police Department on complaints since April 17, 2018. The complaints were related to noise".2 I requested a FOIA from the Miami Police Department for all "Calls for Service" since April 17, 2018 to August 6, 2019. Exhibit D provides a Chart which shows the total calls made since April 17, 2018 (N = 453 Total Calls for Service) as well as a distribution of the type and frequency of police signals, which included calls for larceny, assault, narcotics related incidents, etc. What was most troubling is that there was a total of TEN (10) calls that were completely redacted. In "A Guide for Law Enforcement Agencies" written by the State of Florida Office of Attorney General (2019 Edition), it is clear, pursuant to Florida Statute 365.171, that, "...with limited exception, that any record, recording, or information, or portions thereof, obtained by a public agency for the purpose of providing services in an emergency which reveals the name, address, or telephone number or personal information about, or information which may identify any person requesting emergency service or reporting an emergency by accessing an emergency communications E911 system is confidential and exempt from s. 119.07(1), F.S.". A second reason for exempting information involves situations where "information which is determined by a law enforcement agency to constitute active criminal investigative information may also be deleted". In other words, exemptions for the release of information typically involve protecting the identity of the caller or the victim or constitute information related to an ongoing investigation. I found it unusual that ten (10) calls were completed redacted and sent a request for a written explanation which in part read: "To complete my inquiry, I wish to inquire as to the reason(s) for the complete redaction of ten (10) calls for service. Pursuant to Florida Statue 119.01(1)(e): "If the person who has custody of a public record contends that all or part of the record is exempt from inspection and copying, he or she shall state the basis of the exemption that he or she contends is applicable to the record, including the statutory citation to an exemption created or afforded by statue." In addition, pursuant to Florida Statue 119.07(1)(f), I hereby request that the custodian of public records state in writing and with particularity the reason(s) for the conclusion that the record is exempt or confidential. To be clear, I am requesting the reason(s) for exempting the ten (10) calls for service that were completely redacted." The response that was sent did not directly answer my request for a written explanation for the ten (10) fully redacted calls for service. I received the documents, reorganized, which included eight of the ten calls for service — the remaining two were deleted. How do I know this? Whomever sent the original public records did not correctly redact the ten (10) calls and I was able to remove the redaction to see the actual calls for service that were completely blocked out. Exhibit E provides the ten calls (both redacted and unredacted) which consist of the following police signals: (1) eight (8) aggravated assaults; and (2) two sex offenses. Page2of4 City Clerk Submitted into the public record for it (s) Z . 15 on ,► i.h ► City CIerk provided (eight of which were actually provided at a later date within the "reorganized records response") and if anything, caller ID information could have been redacted while preserving the public's legal right to know.3 Given that this establishment (Elleven) was seeking a substantially beneficial extension of ADULT USE through May of 2050, it is likely that someone in the Miami Police Department assisted Elleven by improperly redacting these ten most serious calls. What is known is that the assertion that NO calls for service occurred at the subject property since April 17, 2018 is patently false and egregiously misleading, particularly given that this information was provided as part ofa Zoning Exception application to assist the City Commission in its evaluation of a property seeking a massive and valuable zoning entitlement. This illegal redaction should be investigated. City of Miami Surcharges for Off -Duty Policing Services: Miami Police officers who work off -duty are paid a specific hourly rate; additionally, the purchaser of these services is required to pay, at present, $4.50 per hour for every hour an officer works off-duty.4 This hourly fee, known as a surcharge, includes payment for the insurance Trust Fund, administrative processing fees and other related costs. As part of the MEDA policing program, the Downtown NETCommander assigned an officer who worked the off -duty assignment to also serve as the "Administrative Officer" for the program. The duties of the Administrative Officer were to coordinate with MEDA's Treasurer and President to review and provide weekly coverage rosters; Exhibit F shows a MEDA off -duty roster that was sent by the Administrative Officer at the time — Hector Herrera. In addition, the Administrative Officer was required to submit these duty rosters to the Special Events Unit (and/or Finance Department) so that monthly surcharge invoices could be generated and sent to MEDA's Treasurer for processing and payment. While MEDA usually made timely payment of the monthly surcharges, Exhibit G provides an example of what happens when the purchaser of policing services is delinquent with surcharge payments. In this case, the emails reveal that Officer Herrera was contacted by the Special Events Unit Supervisor and informed that off -duty would be cancelled if MEDA did not immediately pay past due monthly surcharges. Officer Herrera then emailed the Treasurer and the President (Michael Slyder) and the matter was handled.' We sent a FOIA request to the Miami Police Department on August 8, 2019 to ask for, among other things. off -duty surcharge payments, beginning in January of 2018, for both the Miami Entertainment District Association (MEDA) and the Neighborhood Administrative Funding Services ("NAFS"); the response was sent on September 17, 2019, and included the monthly surcharges invoiced to NAFS through July of 2019 — see Exhibit H. Regarding the 2019 invoices, each month was separate and the invoice itself was generated 1-3 weeks after the month in question — this was standard as well for MEDA monthly surcharge invoices, including invoices that were not paid on time. However, what was highly unusual was that NAFS invoices for 2018 were all on ONE page with an invoice generation date of February 27, 2019 — see Exhibit Hi. In other words, it appears that the 2018 invoices were not generated in real time for each month of service and that the invoice itself showed that NAFS was in the arrears from its inception for a total amount of $16,616.25. What is troubling is that this delinquency requires that BOTH the 3 I did in fact redact any personal information in these un-redacted records. ° When MEDA initially began its Enhanced Police Services (EPS) program, the surcharge was $3.00/hour. The surcharge was increased to $4.00/hour in 2016 and recently, to the current rate of $4.50/policing hour. ' For the record, MEDA was only behind a few months. We sent timely payment to Atlanta, Georgia and the checks were misplaced. It is therefore likely that MEDA paid its surcharges in full and then it was cancelled while NAFS may not have been registered as an off -duty services purchaser until 2019. Summary: As the former President of MEDA who has intimate and detailed knowledge of the Enhanced Police Services (EPS) program, I am concerned that the new NAFS policing model is wrought with "irregularities" that should and must be immediately investigated. The model violates MPD's policy on direct policing for 4COP liquor licensed establishments, provides for individual club cell phone communications, and may have violated financial requirements as a purchaser of off -duty policing services. The FOIA violations for illegal redaction of public information and surcharge invoices that were not generated until a year after the organization's inception reveal potentially serious problems that need to be both addressed and investigated. Its function is to collect funds from venues located in the area known as the Miami Entertainment District and disburse those funds as directed by its clients (the venues also called participants below). Any businesses facing those locations shall be eligible for coverage under the North Zone if they wish to participate. b. South Zone shall consist of NE 11 th Street. At the time of the creation of this document, the zones eligible participants shall include: i. North Zone — El IEVEN Miami, M&M Parking, Corner Bar and All Day Coffee Shop. ii. South Zone — Club Space, Heart, Hangar and Omni Parking. 2. Lead Participants a. Under this plan, each zone shall have a lead participant. b. Lead participants shall be financially responsible for the payment of funds for its zone, 100 percent including the maintenance of a deposit balance account to cover all expenses of the entity. c. Lead Participants may also suggest coverage location to the Miami Police Department Off Duty Personnel via requests made through NAFS since NAFS is the hiring entity of the Off Duty Personnel. d. At the time of the creation of this document, the following venues have agreed to become the lead participants of their zone: i. Whatever their procedures are during their regular duty, those procedures will be maintained. ii. This means that their time is not purchased or rented; it merely means their physical presence is limited to the general area defined in the zones. 5. NAFS is a. A management company hired to facilitate the receiving of and disbursement of funds by its clients. b. Responsible to its clients for accurate and full disclosure reporting to its lead participants. c. Responsible for any required reporting required by any governmental agency including local, county, state and federal requirements. The Miami Police have reviewed this operational plan and agree with the concept of focusing its staff using the zone system. Lead participants win by getting more focused coverage. However, it should be noted that these zones are not completely independent of each other. The Officer in charge controls both zones so if one zone requires immediate assistance from the other zone in case of significant issue, targeted zone coverage may be temporarily suspended until order is restored. About the Off Duty Coverage NAFS facilitates the Enhanced Off Duty Police Services program. The Miami Police Department mandates that no establishment with a liquor license shall hire any member of its staff for the purposes of security of any kind directly. This was put into place by the Chief of Police in Miami to combat the conflict of interest for Police Officers should issues arise between guests of liquor establishments and the law. By eliminating Police Officers from being hired by the individual establishments, the wall of conflict is dropped. The Enhanced Off Duty Police Services program is' not to be mistaken for any participant's security force. Miami Police Officers are engaged by NAFS are available to compliment and supplement the efforts that a participant puts into place on their own. Off Duty Officers are still obligated to assist in situations that may require a Police Officer regardless of whether or not a NAFS participant is involved at all. All past open balances owed to MEDA shall be paid directly to MEDA and not to NAFS. At current agreed upon levels, the cost to operate the off -duty program ranges between $3,500 and $4,200 (without consideration for late arrest additional time or the organizational costs required to operate NAFS). This means that the average zone lead participant weekly expense is going to be $2,076.87. As stated earlier in this document, lead participants shall negotiate with additional participants for a fair and equitable contribution towards their weekly obligation. Operational costs for these purposes include any and all costs required by any governmental agency with jurisdictional control of such an operation plus the cost of required professional fees (accounting and legal) and bank fees (including the costs of checks). Gone from the past operational costs are the costs of website, post office box (will share an existing one already in use) and cell phone expense (leads may supply their own as previously described). In the event that either zone lead participant shall require additional or less coverage based upon their own determination, the respective weekly zone amount will change accordingly. The lead participants have already put into place what they believe to be applicable coverage for their zones for Music Week. Miami Police Officers are already signed on to cover the requested times. Those operational details will be disbursed to additional participants on behalf of lead participants to determine level of interest. In Summary NAFS was created to facilitate the wishes of members and in accordance with the way that I (Ken Ratner) would accept continued support of the group, without compensation but fully reimbursed for any organizational required costs. The MEDA model was simply not working. Too many financial issues that neither Jorge Nunez nor I were willing to continue with. Date: July 24, 2019 Re: Analysis of Adult Entertainment Use Entitlements Approved for 15 & 29 N.E. 11th Street, Miami, Florida (the "Property") QUESTION PRESENTED You have asked us to review a series of entitlement records provided for the purpose of determining whether the Adult Entertainment Use and Alcoholic Beverage Use(s) located on the Property were: (i) approved consistent with the City of Miami ("City") ordinances and zoning regulations (the "Code") in effect at the time they were first approved; and (ii) whether the subsequent modifications to said Uses were authorized consistent with the requirements of the Code. SHORT ANSWER Based on my review of the records provided by you and the pertinent copies of the City Code, including the applicable provisions of Ordinance 11000, as amended, and Miami 21, as amended, it appears that the: Class II Special Permit No. 00-0254 required to authorize an Adult Entertainment Use on the Property was issued after Ord. 11916 took effect prohibiting such use on parcels with a zoning designation of C-2 Liberal Commercial and further did not establish that the distance requirements in Sec. 937 of the Ordinance were satisfied; ii. Subsequent modification of the Property per Class II Special Permit No. 01-0123 was also erroneously approved notwithstanding the expansion of the then legal, non- conforming Adult Entertainment Use in the 2nd floor Mezzanine as the locker rooms, dressing rooms, and "private conversation rooms" are essential components of the Adult Entertainment Use which was expanded further within the structure notwithstanding the Use was no longer pennitted (which assumes the Use was legal at the time it was initially approved); iii. Such a determination is neither consistent with Sec. 7.2.6.c.1.(a) of Miami 21, nor with the requirement in Sec. 7.2.6.1.(b) that an Exception be approved where an alteration of less than 50% of the square footage of a Structure contains a non -conforming Use. iv. Alterations made to the structure on the Property following the approval of Warrant No. 13-0058 (the "2013 Warrant") and per Building Permit No. BD13-015159 (the "2013 Permit") were authorized in violation of Sec. 7.2.6.c.1.(b) of Miami 21 as continuation of the alleged non -conforming Adult Entertainment Use within an altered structure requires the approval of an Exception; and v. Exception approved by the Planning, Zoning & Appeals Board ("PZAB") in May of 2018 permitted the expansion of an allegedly legal non -conforming Adult Entertainment Use onto the existing rooftop structure via a proposed enclosure of an open-air terrace in contravention of Sec. 7.2.6 of Miami 21. SCOPE OF REVIEW The conclusions set forth in this memorandum are based on the review of the memorandums, timelines, and supporting documents provided by you in e-mail correspondence dated January 29, 2019, February 27, 2019, May 21, 2019, June 19, 2019, and June 20, 2019 (collectively, the "Slyder Documents"). Copies of the Slyder Documents are attached hereto as Exhibit "A". Our conclusions set forth herein are also based on our review of the following additional documents available to the public on the City's website (the "Public Documents"): 1. The Miami 21 Code, as amended, through May 2018; and 2. Documents forming part of the record for File No. 3591 in support of the Exception application submitted by GR OPCO, LLC approved in May of 2018 by the PZAB pursuant to PZAB Resolution 18-023. ANALYSIS The Property presently has a zoning transect designation of Urban Core Transect Zone Open (T6-60-0) pursuant to the City's present zoning code ("Miami 21"). Per Article 4, Table 3 of Miami 21, "Adult Entertainment Establishment" Uses are not permitted on properties with a transect designation of T6-60-0 and are only permitted by Right on properties with a zoning transect designation of Industrial (D2). Use History Under Ordinance 11000 Prior to the adoption of Miami 21, the Property's zoning designation was C-2 Liberal Commercial under Ordinance 11000. Prior to April 13, 2000, "Adult Entertainment" or "Adult Service Establishment" Use were permitted on parcel's designated C-2 pursuant to the issuance of a special permit, more specifically a Class 11 Special Permit issued by the Planning Director, pursuant to the standards set forth in Sec. 937 of Ord. 11000. Said section required such uses to, among other things: (i) be established at a distance of at least 1,000 feet from any other Adult Entertainment or Adult Service Establishment; (ii) be located a distance of not less than six hundred (600) feet from any residentially zoned property; and (iii) tender a survey certifying that the aforementioned distance requirements are satisfied prior to the issuance of a C.U. 9232696-1 BERGER SINGERMAN Submitted into the public record f ite (s) Q Z, i 5 on q 9�Lt_ . City Clerk In April of 2000, the City Commission adopted Ordinance No. 11916 (which became effective 30 days following its passage) which further limited the zoning districts where such Adult Entertainment and Adult Service Establishments could be located. Specifically, Ord. No. 11916, among other things, removed Adult Entertainment Uses from the schedule of Conditional Principle Uses permitted on properties designated C-2 Liberal Commercial. Therefore, Adult Entertainment Uses which were not legal, conforming uses prior to the effective date of Ord. No. 11916 could not thereafter be permitted on a property with a C-2 designation. Prior to 2003, the City's Previous Business Usage report (a certified copy which is attached hereto as Exhibit "B") for the Property evidences no record of the issuance of a Certificate of Use ("C.U."). for an Adult Entertainment Use. Said history seems only to evidence C.U.s for parking and self -storage on the Property prior to issuance of the first C.U.s for both a "Nightclub" and "Commercial — Food Service Establishment" on August 19, 2003. Therefore, the City records reviewed would seem to support the conclusion that no legal, conforming Adult Entertainment Use was established prior to the adoption of Ord. No. 11916, Class II Special Permit History Under Ord 11000 Prior to the adoption of Miami 21, the then owners/tenants of the Property solicited and were granted two (2) separate Class II Special Permits purportedly authorizing, among other things, an Adult Entertainment Use on the Property. Class If Special Permit No. 00-0254 The predecessor owner of the Property submitted an application for a Class II Special Permit to the City on October 27, 2000, seeking the authorization of, among other things, an Adult Entertainment Use on the Property. The findings made in the Class II Permit order were based on an analysis that failed to consider any of the requirements of Sec. 937 of Ord. 11000, as modified by the adoption of Ord. 11916, and erroneously issued findings predicated on the "Entertainment Specialty District" standards promulgated pursuant to Ord. 11917. Given that the Applicant filed a Class II Special Permit referencing Ord. 11917, it is reasonable to conclude that the Property's special permit application was submitted after the passage of Ord. 11916, as both ordinances were adopted on the same date. Had the Planning Director appropriately considered the application and applied the revised standards, the subject Class II Special Permit would have been denied as: (i) Adult Entertainment Uses were no longer authorized on properties with a C-2 zoning designation; and (ii) the proposed use did not satisfy the residential district requirements. Class II Special Permit No. 01-0123 Assuming arguendo that the initial Class II permit properly authorized the Adult Entertainment Use, the approval of Class II Special Permit No, 01-0123 (the "Class 11 Modification') represents, at -best, an expansion of a legal, non -conforming Use in contravention of the City Code. The Class II Modification consisted of a "reconfiguration of the interior space" of the original one-story building which was the subject of the original Class II permit. City Clerk the plans accompanying the Class II Modification application, it is clear that the creation of a mezzanine, which included the addition of locker and dressing rooms for performers and "private conversation rooms" accessible via a staircase from the main floor, represents an expansion of the alleged legal, non -conforming use. Notwithstanding the findings set forth in the Class II Modification order, specifically the second finding (which concluded that the proposed reconfiguration does not increase the nonconforming use), the addition of the mezzanine which includes elements that exist only to support the non -conforming use, represents an unauthorized expansion of the allegedly legal, non -conforming use. Modifications to Non -Conforming Uses Per Miami 21 Sec. 7.2.1. permits a nonconformity that was legally approved prior to the adoption of Miami 21 to continue so long as the non -conforming Use is neither expanded nor enlarged. Miami 21 further precludes the existence of a non -conformity to be used as a basis for the addition of new Uses, Structures or site improvements that are not permitted pursuant to the regulation of the subject Transect Zone. See Sec. 7.2.1.c. of Miami 21. Further Miami 21 expressly forbids a temporary or illegal use of the property to be used as a legal basis to claim the existence of a nonconformity or create rights in the continuation of a nonconformity. See Sec. 7.2.1.d. Finally, while the Code seeks to limit the duration of a nonconformity and encourage nonconforming structures to be brought into conformity with the standards of Miami 21, it does permit for the replacement or expansion of a Structure containing a nonconforming Use under specified conditions. Sec. 7.2.6.c.1.(b) of Miami 21 expressly authorizes alterations to a Structure containing a nonconforming Use (one that was legally established prior to the date Miami 21 became effective) where the alteration less than 50% of the square footage of the Structure at the time of the alteration. However, said provision provides that the nonconforming use may continue (not expanded or enlarged) following the approval of an Exception. Such a reading of Sec. 7.2.6.1.(b) is further supported by the express language of Sec. 7.2.6.c.1.(a) which only authorizes nonconforming Uses to occupy portions of Structures clearly designed or arranged for the nonconforming Use at the time such use became nonconforming. 2013 Warrant Application (File No. 13-0058) The 2013 Warrant submitted by the current Property owner proposed an enclosed addition to the rooftop which conforms with the standards of Miami 21 atop the existing, legal nonconforming Structure. In addition to the new rooftop Structure, the 2013 Warrant also proposed a series of modifications to the existing, nonconforming portions of the Structure which both: (i) substantially expanded capacity of the existing "Adult Entertainment Establishment" from 270 patrons to 620 patrons; and (ii) allowed for improvements of previously unoccupied spaces or areas not manifestly designed for the nonconforming Use at the time which such Use became nonconforming. Said modifications included the addition of the following improvements: (i) two mezzanine bars and related floor space easily in excess of 3,000 sq. ft.; (ii) approximately 20 "private conversation booths" designed for the entertainment of patrons by adult dancers; and (iii) bathrooms and related service spaces. Such modifications to the existing nonconforming Structure represent substantial expansions of the prohibited "Adult Entertainment" Use. Thus, the Warrant appears violative of Sec. 7.2.6. of Miami 21, specifically the limitation on the expansion of nonconforming Uses and the Exception requirement for the continuation of a 9232696-1 BERGER SINGERMAN Submitted into the public record for ite (s) on q % ji . City Clerk nonconforming Use within a Structure being altered by less than 50% set forth in subparagraphs c.1.(a) and (b), respectively. 2018 Exception for Alteration to Structure Containing a Nonconforming Use Consistent with the requirements of Sec. 7.2.6.c.1.(b) of Miami 21, the current operator of the Adult Entertainment Establishment located on the Property sought (with the consent of the Property owner) approval of an Exception to permit the enclosure of an open-air rooftop terrace for two (2) express purposes: (i) attenuate the impacts of noise generated by patrons on the rooftop for the benefit of neighboring residential owners; and (ii) extend the Adult Entertainment Use into the rooftop area. Such intention is repeatedly referenced in the letter, including in comments of counsel for the applicant at the hearing before the PZAB and in the applicant's letter of intent where the purpose of the application was described as follows: The aim of the extending the Adult Entertainment Use into the existing service area on the rooftop is to allow patrons to enjoy the entertainment throughout the entire venue. Applicant further affirmed their intent when referencing operational measures proposed to be employed to obscure exposure of the general public to the Use within the building in its letter of intent where it stated: Applicant will prevent partially dressed entertainers from being visible to the public, unless in street clothes. Instead the entertainers will enter the rooftop only from the elevator which stops on the mezzanine level, and not the street level. This statement clearly expressed the Applicant's intent to expand the allegedly legal, non- conforming Use into a portion of the building that was not manifestly designed for said Use (in contravention of 7.2.6.c.1.(a)) and, pursuant to the 2013 Warrant, expressly segregated from the Adult Entertainment Use by means of separate access. While the staff analysis analyzes the conformity of the proposed alteration to a non -conforming Structure with the square footage limitations set forth in Sec. 7.2.6.c.1.(b) of Miami 21, no discussion of the propriety of the Adult Entertainment use is contained in the analysis. While said section clearly authorizes a modification to the non -conforming Structure of less than 50% of its square footage and the non -conforming Use contained therein when the Structure which is the subject of the modification contains a non -conforming Use, the rule does not expressly authorize an expansion of non -conforming Uses. This section must be read in pari materia with the balance of Code regulations governing non -conforming Uses in Article 7 of Miami 21. Such a reading requires a finding that a legal, nonconforming Use cannot be expanded. An alternate conclusion would be counter to the express regulations in Secs. 7.2.6.c.2. (precluding expansion of non -conforming Use to other Structures on the same Lot if other Structure was not used for the nonconforming Use when the use became nonconforming) and 7.2.6.c.3. We have taken your recommendation asserted in your letter dated January 3, 2019, and sought formal review by Javier Fernandez, Esq. ("Javier"), a land use and zoning attorney, to support my Clients' claims. We have attached for your review Javier's detailed Land Use and Zoning analysis and other findings of the properties located at 15 & 29 N.E. 11 th Street, Miami, Florida (the "Property"), which conclusively supports my Clients' claims in the complaint (the "Opinion Letter"). Background of General Land Use and Zoning Findings My Clients assert, through a painstaking, thorough and comprehensive investigation, as supported by the Opinion Letter, that: A. The 2000 and 2001 Class II Special Permits were issued after the adoption of Ord. 11916, prohibiting Adult Use in a C-2 District; B. Your recent submittal (as an addendum to the Exception application) of the CUO4 Warehouse Certificate of Use, dated April 12, 2000 to the Planning, Zoning and Appeals Board following the denial of a recommendation to approve an Exception, does not evidence the approval of "Adult Use" or "Adult Services." Even if it is assumed in arguendo, that Adult Use was acquired prior to the passage of 11916 in April of 2000, the 2001 Class II Special Permit clearly evidences an illegal expansion of the Adult Use to the "newly configured" space as our Land Use Consultant notes: "Subsequent modification of the Property per Class II Special Permit No. 01-0123 was also erroneously approved notwithstanding the expansion of the then legal, nonconforming Adult Entertainment Use in the 2"d Floor Mezzanine as the locker rooms, dressing rooms, and `private conversation rooms' are essential components of Adult Entertainment Use which was expanded further within the structure notwithstanding the Use was no longer permitted (which assumes the Use was legal at the time it was initially approved);" D. The 2013 Warrant is replete with errors and inaccurate statements of fact, beginning with the assertion that the demonstratively massive Alteration of the Property was a simple "renovation." The Miami 21 definition of Alteration is clear, and your clients claimed "renovation" to avoid the requirements that an Exception, which would need to be approved to continue the Adult Use and that such Alterations could be no more than 50% of the square footage of the Property to be approved or the Property brought into Miami 21 compliance. In the end, your clients expanded the nonconforming Adult Use, as evidenced in the removal of the kitchen and related areas, which contributed to the change in occupancy from 270 to 620 persons; E. The 2018 Exception provided yet another egregious example of an improperly gained approval of an entitlement. As our expert notes: "...While the staff analysis analyzes the conformity of the proposed alteration to a non -conforming Structure with the square footage limitations set forth in Sec. 7.2.6.c.1(b) of Miami 21, no discussion of the propriety of the Adult Entertainment use is contained in the analysis. While said section clearly authorizes a modification to the non -conforming Structure of less than 50% of its square footage and the non- conforming Use contained therein when the Structure which is the subject of the modification contains a non -conforming Use, the rule does not expressly authorize an expansion of non -conforming Uses. This section must be read in pari materia with the balance of Code regulations governing nonconforming Uses in Article 7 of Miami 21. Such a reading requires a finding that a legal, nonconforming Use cannot be expanded." City Clerk "...The New Use will be separate and independent from the existing establishment, with a completely separate entrance and will not have any adult entertainment component." (Tony Recio, Esq., Dated August 23, 2013); September 26, 2019 Meeting. My Clients intend to appear and testify in front of the City Commission whenever this Exception comes before the Commission on September 26, 2019. My Client fully intends to disclose in full detail our expert's findings and other research and evidence to the Commission to explain why this Exception to extend the allegedly legal nonconforming Use, pursuant to 7.2.6(a), should not be granted. Mr. Slyder has asked that I share with you his findings including quotes from your client's lawyers gained through his research and freedom of information requests: 1. Section 7.2.6(a) As you are aware, Miami 21 was amended on September 24, 2015, clarifying the initial, twenty-year clock for nonconforming Uses. The Amendment clearly articulates that the "Use may be continued for twenty (20) years from the date the Use first became legal nonconforming and consistent with the regulations of this section." Even if the property had acquired Adult Use (which it did not), said Use would expire on or before April 13, 2020.1 During your appearance in front of the PZAB on July 17, 2019, you repeatedly stated that the property has the nonconforming Use, by right, through 2030: PZAB Chair: "...Aren't you coming in early for the twenty year"; Terminello: "No, we are entitled to apply for it" Chair: "No what I am saying is don't you have years left" Terminello: "We have a couple of years left but..." Chair: "How many is a couple?" Terminello: "We could go to 2030 as we stand here today" Chair: "2030 with doing nothing." Furthermore, two letters of intent (dated January 8, 2019 and April 17, 2019) that you sent on behalf of your client — GR OPCO, LLC, stated that the granting of the requested Exception would allow your clients nonconforming Use to continue through May 20, 2050. 2. Operation of an Alcohol Services Establishment 1 In both the 2018 and 2019 Exception Analyses, Chief of Land Development Jackie Ellis confirmed that ordinance 11916 created the nonconformity regarding your clients' specific property (although she erroneously provides the date of "October of 2004" when in actuality the adoption date for Ord. 11916 was April 13, 2000). As importantly, the Analysis for the 2019 Exception request includes 7.2.6.(a) as it is currently written based in part on the revisions approved via the September 24, 2015 Amendment. 3 SCHLESINGER LAW GROUP 800 BRICKELL AVENUE • SUITE 1400 MIAMI, FLORIDA 33131 • TELEPHONE 305.373.8993 FAX 305.373.8098 September 18, 2019 Page 4 of 6 Submitted into the public record � � tid%(q) QZ.S on CityClerk Beginning with the Transfer of a 4COP Liquor License on November 8, 2000, there was error wherein the "Acting Zoning Administrator" affirmed that the "location complies with zoning requirements for the sale of alcoholic beverages or wholesale tobacco products pursuant to this application for a Series 4COP alcoholic beverage or wholesale tobacco license." In addition to extensive records from the Department of Alcoholic Beverage and Tobacco obtained through a FOIA request, counsel for Applicant (Ben Fernandez) for the Class II Special Permit, submitted on April 26, 2001, confirmed in the application's Letter of Intent that, "...The owners of the property were previously granted a Class II Special Permit and have been in operation since." That initial Class II Special Permit was approved on November 13, 2000. The property's certified Previous Business Usage record confirms that Gold Rush did not receive its Certificate of Use for a nightclub and Commercial Food Establishment until August 19, 2003, effectively operating an illegal alcohol service establishment in a warehouse (CU04) for approximately 34 months. 3. Repeated Violations of the Sound Ordinance and 2013 Warrant As alleged in a letter addressed to you dated December 28, 2018, Club El Leven was the recipient of countless noise complaints from nearby residents. However, as alleged, Club El l even and others participated in a directed effort to blame my Clients for the noise violations which precipitated in the closure of Club Heart. Previously, at a separate Hearing for Exceptions, your clients conditioned the approval of the Exception to Use on the fact that Club El leven would build a soundproof enclosure over the rooftop, eluding to the fact that it was necessary to build the enclosure to be "good neighbors." Your clients, through their legal representative, specifically stated the following in two separate hearings: Terminello: (May 16, 2018 PZAB Hearing for Exception PZAB-R-18-0023) "...We are building this enclosure...keep in mind...we are offering this sound- proof, opaque roof enclosure as a condition to approval. We want to condition the expansion of the nonconforming Use of the rooftop...us building this enclosure. We want to eliminate the noise...we want to build this rooftop. It's a very expensive project...I don't have to tell you...look you have the plans in front of you...between the soundproofing and construction this is an expensive project but we're willing to undertake it because we want to be good neighbors (emphasis added). We want to eliminate the noise...we want the condos to be rested. We don't want our noise to intrude." Terminello: (July 17, 2019 PZAB Hearing for Exception PZAB-R-19-028) "... We have been good neighbors...we've been operating for four years... we have zero convictions of any code violations of any nature whatsoever...and we are going to continue to be good neighbors." City Clerk If you recall, you represented Elevated Eateries in its 2013 acquisition of a 4COP liquor license and served as Co -Counsel with Tony Recio, who spearheaded, among other things, the Warrant process pursuant to Ord. 11917. While numerous documents clearly evidence your client's plan to build an "Ultra -lounge" with an open-air terrace,2 the fact that the Warrant's principle purpose was to acquire a 24-hour alcohol use within the Park West Entertainment Specialty District was proof positive of your client's intentions. As you know, 36-5 violations do not require a complainant when the violator is playing music outdoors after 11:00pm — the offense is enforceable just by the very playing of music. In addition, as we allege your client directly violated the conditions set forth in the 2013 Warrant wherein it is stated that, "Any noise generated on the site shall conform to Chapter 36 of the City Code noise regulations." Additionally, your client attended a meeting with Commander Alfonso, Downtown NET Commander, on February 18, 2016, wherein it was made clear that the sound disturbance was critical and could result in arrests of club owners and managers. Residents attended and during that meeting, representatives for Elevated Eateries and GR OPCO, LLC revealed plans to enclose the open-air terrace,3 disclosing that there was a setback issue that needed to be resolved. FOIA records clearly evidence that your client wrongly stated its efforts to enclose the rooftop and did not approach the City of Miami until August 28, 2017 for a Pre -Application Meeting to discuss the illegal expansion of GR OPCO, LLC's nonconforming Use. 4. Calls for Service to Miami Police Department The Staff Analysis for the 2019 Exception of the twenty-year extension for the nonconforming Use has a glaring error. Specifically, the Planning Staff asserted that, "...The Adult Entertainment Use has not received any calls for service from the Police Department on complaints since April 17, 2018. The complaints were related to noise." My Clients' investigation shows that FOIA records obtained from the Miami Police Department reveal a total of more than 450 Calls for Service for the time period between April 17, 2018, through July 17, 2019, at the subject property address of 29 NE l lth Street. These calls were frequent and at times serious in nature; for example, police "signals" included calls for assaults, larcenies, stolen vehicles, and alcohol related incidences. 2 Your client's intentions were best articulated by the description provided in the Traffic Impact and Circulation Study: "...the proposed Quality Restaurant will operate as a full -service eating establishment until 11:00pm and afterward will be utilized as a Night Club" (Application for Warrant 2013 -005 8, p. 301). 3 Peter Maddock, a resident who was a member of the resident Noise Abatement Committee, provided detailed minutes from this meeting, in which it was made clear that the principle disturbance in the District was the direct result of your client's egregious and deliberate violation of 36-5: "...Touche may not be the sole source of noise the subject of the current complaints, but since the opening of Touche, the noise output from the Club Area has once again become excessive and wholly unacceptable. Residents are moving to the rear of their apartments to sleep or making plans to be away for the weekends. As you have made threats against me personally as well as my Clients, this letter gives you notice of the facts and back-up my client will present to the City Commission prior to the Hearing to provide them with the information and evidence necessary to refute your clients' claim that the nonconforming Use is valid through 2030 and in turn to oppose their request for an additional twenty years via Exception PZAB-R-19-028.
