PZ-19-628 04/10/19 Re: LETTER OF INTENT Vacation and Closure related to NW 22 Terrace between NW 11 Avenue and NW 12 Avenue, Miami, Florida Dear Mr. Garcia: Our firm represents Track 23, LLC ("Applicant"), the owner of the property located at 1100 NW 23 Street ("Property") located in the City of Miami ("City"). The existing building is being adaptively reused for the new Rubell Museum, which will house the Rubell Family Collection currently located at 95 NW 29 Street. The purpose of this letter is to request a vacation and closure of the abutting right of way, NW 22 Terrace, south of the Property. Property. The Property is located on the south side of NW 23 Street, between NW 12 Avenue to the west and NW 11 Avenue on the east. See Figure 1. Property Aerial, below. Miami -Dade County's Office of the Property Appraiser identifies the Property by Folio Number 01-3126-052-0500. See Exhibit A, Property Appraiser Summary Report. The Property was platted in 1921 as part of the Lincoln Park plat recorded in the public records of Miami -Dade County at Plat Book 6, Page 163. See Exhibit B, Property Plat. The Applicant seeks to vacate NW 22 Terrace, between NW 11 Avenue and NW 12 Avenue, immediately to south of the Property (hereinafter "NW 22 Terrace"). In this area, NW 22 Terrace is a small roadway which has not been maintained for years and presents a burden to the City. The roadway directly abuts railroad tracks to the south which presents a unique maintenance condition. Vacation of NW 22 Terrace will shift the burden of this small, unmanageable right of way from the City to the Applicant. The Applicant wishes to assume this responsibility. As part of the adaptive reuse of the structure, the Applicant will not construct on the right of way, but rather will improve the area ancillary to the new museum use. The Florida Department of Transportation ("FDOT") owns the property on the south side of NW 22 Terrace. Pursuant to the terms of Section 177.085, Florida Statutes and the Property Plat, FDOT and the Applicant possess reversionary interests in NW 22 Terrace, up to the centerline of the right of way abutting their respective parcels. FDOT has indicated that it has no issue with the City's vacation of the right of way. See Exhibit C, FDOT Consent. However, FDOT does not wish to assume the burden of maintenance. Instead, FDOT has transferred its underlying interest in the southern portion of NW 22 Terrace to the Applicant. See Exhibit D, FDOT Quitclaim Deed. Analysis. Section 55-15(b) of the City Code of Ordinances (the "City Code") provides four (4) criteria for tentative plats involving vacation and closure. The proposed vacation of NW 22 Terrace satisfies the criteria as follows: (1) No tentative plat will be considered by the plat and street committee which includes only rights -of -way or easements to be vacated and closed. PZ-19-628 The properties on each side of the rights -of -way or easements to be vacated and closed shall be included in the plat, and all abutting property owners shall join in the plat and the disposition of the rights -of -way or easements shown. 04/10/19 As mentioned, FDOT owns the property to the south of NW 22 Terrace, and has no issue with vacation of the right of way. In fact, FDOT transferred its underlying interest to the Applicant. Therefore, the Applicant is the sole property owner included in the vacation and closure application. (2) Vacation and closure of half the width of the right-of-way or easement shall not be permitted. The vacation and closure of NW 22 Terrace is the entire width of the right of way. (3) Where the subdivider requests the vacation and closure of a portion of the right-of-way connecting two streets, he/she shall provide a cul-de- sac specified in section 55-11 "Design standards." This cul-de-sac shall be fully within the property being platted. All property owners abutting the right-of-way between the two streets shall join in the plat abandoning and disclaiming all right, title and interest in the portion of the right-of- way being closed except as provided in section 54-4. The portion of NW 22 Terrace to be vacated does not connect two streets. Currently neither vehicles nor pedestrians can access NW 22 Terrace. Additionally, FDOT, the owner of the property south of the right of way, has transferred its underlying interest in the right of way to the Applicant. This transfer, and FDOT's accompanying consent to the closure, effectively abandons and disclaims FDOT's right in the right of way. (4) Where the subdivider requests the vacation and closure of a portion of an alley, he/she shall provide on his/her property suitable access from the closed end of the alley to the nearest public street, or streets, as required by the plat and street committee. All property owners abutting the alley shall join in the plat as required in subsection (b)(3), except as otherwise specifically provided in section 54-4. The Applicant has suggested, and the Plat and Street Committee has agreed, that proposed vacation of NW 22 Terrace satisfies the criteria as follows: (1) Is it in the public interest, or would the general public benefit from the vacation of the rights -of -way or easements? The Applicant is adaptively reusing the existing warehouse structure for a private art museum that will be open to the public. Once vacated, the NW 22 Terrace right of way will be improved to provide parking for the museum. It should be noted that since the existing structures are being adaptively reused, there is no legal requirement to provide parking for the proposed museum. However, the Applicant is going above and beyond the legal requirements for the Property and proactively addressing parking before it becomes a concern in this area. The vacation will ensure that there is sufficient parking for the use and overflow parking will not spill over onto abutting properties. Further, the legal closure of this defunct right of way will shift the burden of maintenance and security from the City to the Applicant. This will benefit the general public by reducing the City's maintenance burden and resulting in cleaner and safer streets without cost to the City's taxpayers. Additionally, vacation and closure of NW 22 Terrance will return this land to the Miami -Dade County tax base and Result in a net benefit to local tax payers. (2) Is the general public no longer using the rights -of -way or easement, including public service vehicles such as trash and garbage trucks, police, fire or other emergency vehicles? The previous property owners fenced off access to NW 22 Terrace due to security concerns associated with the previous warehouse use. At this time, the Applicant seeks to legalize this condition that has existed for several decades. Although it is a street, NW 22 Terrace is operated more like a private alley for the properties which abut the right of way. Trash and garbage collection, police, fire or other emergency vehicles have not used NW 22 Terrace for decades and official vacation and closure will not alter the general public's use. Vacation and closure will also improve the safety of the pedestrian experience abutting an operational train track. Lastly, vehicular circulation will not be impacted as there is no roadway connection on the west side of the Property and it appears that NW 22 Terrace is closed as far east as NW 10 Avenue. Conclusion. The Applicant requests approval of the vacation and closure of NW 22 Terrace between NW 12 Avenue and NW 11 Avenue.
