The Centners launched an Opportunity Zone fund that will support the Teachers Village project at 3350 Biscayne Blvd. Opportunity Zones are a new federal program where people can defer their capital gains by investing in economically distressed neighborhoods. David Centner said he'll personally invest $40 million into this Opportunity Zone fund, and has more investors lined up to commit additional funds. A Miami native, Centner moved to the Northeast to start tech companies in the 1990s. In 2018, Centner and his wife sold Highway Toll Administration LLC, which specializes in electronic toll collection technology, to Platinum Equity. Centner and his wife have returned to Miami, and he's found the city looks very different from when he left about 25 years ago. "My heart has always been in Miami," Centner said. "My wife and I wanted to show appreciation to Miami doing right by me and try to give back ... We are parlaying the [Highway Toll Administration] transaction proceeds into underserved and under developed areas." In September 2018, Centner's 3350 Biscayne LLC acquired a 37,000-square-foot site at Biscayne Boulevard and Northeast 34th Street for $11.5 million. He has partnered with New Jersey -based RBH Group to build Teachers Village there. RBH Group previously built a Teachers Village in Newark, New Jersey with affordable housing for teachers and educational programs for them provided through Rutgers University. Ron Beit, CEO of RBH Group, said he'd like to construct a similar project in Miami. The curriculum developed by Centner Academy complements language acquisition with involvement in world issues, local associations and contact with a broad diversity of school guests. Mandarin will be used daily to provide content without repetition or translation in English or Spanish, and all three languages together present the full curriculum content. The first is located on the ground floor on the south side of the existing building, recessed off of N. Miami Avenue. That recreational area will be enclosed by concrete walls and is located between two commercial uses. The second recreational area will be located on the rooftop of the existing building. The rooftop recreational area will be shaded by canopies, which serve the dual function of providing shade and absorbing noise. The rooftop deck is located behind a solid parapet wall and a 58" high guardrail with plexiglass panels. • Use of the recreational areas will be staggered. No more than 2 classrooms will utilize a recreational area at any given time, which means at maximum enrollment there will be no more than 20 children utilizing the recreational areas at any given time. Since there are two recreational areas, the minimum number of swifts will be 3 per recreational space. The Planning, Zoning and Appeals Board shall give full consideration to the Planning Director's recommendations, and shall determine whether to grant an application for Exception, to grant with conditions and safeguards or to deny the application. PALMER TRINITY PRIVATE SCHOOL INC Decided: July 05, 2012 by the Third District • An applicant seeking a special exception must demonstrate to the decision -making body that its proposal is consistent with the county's land use plan; that the uses are specifically authorized in the applicable zoning district; and that the requests meet with the applicable zoning code standards of review. See Jesus Fellowship v. Miami —Dade County, Florida, 752 So.2d 708, 710. [sic] (Fla. 3d DCA 2000). If an applicant meets this burden, then the request MUST be granted unless the opponent carries its burden to demonstrate that the applicant's request does not meet the standards and are in fact adverse to the public interest. Id Based on this record, the circuit court clearly was correct in striking the 900 student "cap." Under our ruling in Jesus Fellowship, Inc., it also had no choice but to strike the restriction, leaving intact Palmer Trinity's entitlement to a special exception allowing 1150 students. There, as here, an applicant (a church) sought a special exception for a private school and a day care center for a specific number of students (524) but was restricted by the county commission to fewer students (150). There, as here, professional staff recommended approval of the request. There, as here, neighbors and a professional engineer appeared to oppose the request. There, as here, the opposition witness testimony, proved not to be competent substantial evidence on the issue of the church's student request. There, as here, removal of the unsupported condition mandated approval of the school. ANALYSIS Miami Comprehensive Neighborhood Plan (MCNP) The Future Land Use Map (FLUM) designates the Eastern Lot as Low Densffy Restricted Commercial, and the FLUM-designation of the Western Lot is Duplex Residential. In accordance with the Interpretation of the 2020-Future Land Use Element of the Miami Comprehensive Neighborhood Plan (MCNP), both Low Density Restricted Commercial and Duplex Residential. FL LIM designations allow primary and secondary schools. Exception Criteria 1: Per Section 7,1.2,6, the review of an application for an Exception "shall conslderthe manner in which the proposed Use will operata given its specific location and proximity to less intense Uses r....r Analysis 1: Educational facilities tend to support the residential communities in which they are located by providing a safe and easy way for families to access the Pre -School. As indicated in Article4, Table 3, educational 'uses are one of the few non-residential uses allowed in the lower density and intensity neighborhoods. Furthermore, the Pre -School is proposed at the intersection of an established resldenttal community and an innovative commercial district. This convergence of uses is consistent with the Miami 21 Zoning Atlas which shows that the Eastem Property is bounded by a different transect In three directions. Given the intensity of several of the current uses in the area, the intensity of the Pre - School use would not further encroach into the abutting T3-L communities. /Finding 1: The PraSchool Use is compatible with the less intense T3-L uses in its vicinity. Table 12 which includes the following design criteria: "Minimize the impact of automobile parking and driveways on the pedestrian environment and adjacent properties, especially 72 areas.(..] For pedestrian and vehicular safety minim¢e conflict points such as the number end width of driveways and curb cuts." Furthermore, because of the physical constraints of the existing site, the Applicant has agreed to install a boom barrier at the entrance of the parking lot. The lot will be closed during the pickup end drop off periods. By preventing the drop-off and pickup of students on the surface lot during the busiest time of day, the number of conflicts between the vehicles and pedestrians will be minimized. Fitst , 2: Given the operational measures and site improvements proposed by the Applicant for the site, the request for a Preschool Use is consistent with Article xi, Table 12, as required by the Exception criteria established in Section 7.1 2.6. The application is consistent with the criteria for en Exception.
