Please accept this letter, along with the requisite appeal fee, as a timely appeal of the Planning, Zoning and Appeals Board's ("PZAB") denial of our appeal of Warrant No. 2018-0067 at its April 17, 2019 meeting, PZAB File ID No. 5619. A copy of the Warrant is attached hereto as Exhibit "A;" and a copy of the original appeal letter setting forth the grounds of denial for the Warrant in our preliminary appeal to PZAB is attached hereto as Exhibit "B." The Warrant should be denied and our appeal granted because the issuance of the Warrant by City Staff was based on clearly erroneous assumptions. Specifically, according to the City Staff report to PZAB, the Warrant was granted under the assumption that the Project would generate less than 20 peak trips per day. But when questioned about this assumption of 20 peak trips per day, Staff said it did not know where it received that number. In fact, the traffic experts for both the Appellant and the Appellee agreed that the Project would generate 78 peak trips per day — almost 4 times the estimated number of trips upon which Staff granted the Warrant. Because the Warrant was issued on the basis of clearly wrong information and the PZAB appeal was similarly denied due to reliance on the incorrect Staff report, our appeal must be granted and the Warrant must be denied. Further, Staff failed to request a traffic study from the applicant even though the City's own procedures require one. As stated by a Planning Department Official during the PZAB hearing, City protocol requires a traffic study be ordered from an applicant when the peak hour trips for a project are 20 or more. Again, even though the peak trips for this Project are proposed to be 78 as agreed to by both sides, the Planning Department failed to require a traffic study for this Project. Our appeal of the Warrant should be granted or at a minimum, the issuance of the Warrant should be suspended until the applicant has submitted a professional, comprehensive, traffic study, for review by all parties so that a proper determination can be made about whether or not the Project should move forward. The traffic and queuing issues relating to this Project are especially important for a few reasons: 1. The Project is located at the busy intersection of the 79th Street Causeway and 10th Avenue. Traffic is already bad at this location. 2. The entrance to the car wash facility is located very close to the traffic light for the intersection of 79th Street and 10th Avenue. In fact, the distance between the entrance and the traffic light violates FDOT requirements. And vehicles would almost certainly traverse double -yellow lines to enter and exit the property (which is illegal and a safety hazard). 3. Because of the small size of the lot, and other aspects of the proposed car wash facility, our traffic engineer has opined that the Project as proposed has insufficient space for queuing and will cause significant traffic back-ups on the street. Therefore, given the already well documented likely problems involving traffic circulation and queuing, it is especially important that the analysis of traffic and queueing by Staff be done correctly and thoroughly. Obviously that was not done here. 4. There is a fire department across the street, so it is particularly dangerous to compromise traffic at this location. As an aside, it should be noted that two additional matters were emphasized at the PZAB hearing that are completely irrelevant and should not have any bearing upon the City Commission's consideration of this appeal. First, the applicant attacked our appeal as being based upon allegedly anti -competitive desires given the appellant's operation of a restaurant and ancillary —use hand car wash adjacent to the Project. The appellant, however, is not motivated by anti -competition because the primary use upon his property is a restaurant. Rather, the appellant has brought this appeal over concerns regarding increased traffic. Regardless, irrespective of the appellant's motivations in raising this appeal, the Project fails to satisfy the City's basic standards for granting a Warrant, as otherwise detailed herein. Second, at PZAB, the applicant emphasized how the Project would function as a new, beautiful development of a property in need. Regardless of the benefits of gentrification, this is a separate issue from the merits of granting a use -based Warrant. Specifically, and to reiterate the conclusions of this letter, the applicant has failed to provide any documentation that would address traffic circulation within the Project and its impact on adjacent roadways; such that the Project fails to meet the City's standards for granting a Warrant. For these reasons, we respectfully file this appeal, and urge that the City Commission overturn PZAB's denial of our initial appeal and the Planning Department's approval of the Warrant. PROPERTY AND BACKGROUND INFORMATION: The subject parcel is vacant, consisting of approximately 13,685 sq. ft., located at the northeast corner of NE 79th Street and NE 10'h Avenue within the Shore Crest subdivision. Per records of the Office of Zoning, that last Use on the subject parcel File No. 2018-0067 was an auto related commercial establishment (Mechanic Shop) See exhibit B entitled "Zoning Records". i - Previous Auto Mechanic Shop located on the subject parcel, since demolished. On September 4, 2018, the Applicant submitted an application for a Warrant and associated Waiver(s) to allow for the redevelopment of the subject site, and to permit an auto related commercial establishment (automated carwash) which is the subject of this request. C. MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN (MCNP): The subject site is designated Restricted Commercial, this category allows general office use; clinics and laboratories, auditoriums, libraries, convention facilities, places of worship, and primary and secondary schools. Also allowed are commercial activities that generally serve the daily retailing and service needs of the public, typically requiring easy access by personal auto, and often located along arterial or collector roadways, which include: general retailing, personal and professional services, real estate, banking and other financial services, restaurants, saloons and cafes, general entertainment facilities, private clubs and recreation facilities, major sports and exhibition or entertainment facilities and other commercial activities whose scale and land use impacts are similar in nature to those uses described above. Analysis:The subject site previously housed an auto related commercial establishment known as Oscar Complete Auto Repair. The site is located on a major east west commercial arterial roadway (NE 79th ST) which also serves as the connector to North Bay Village. Staff notes that other similar uses exist in close proximity to the site such as but not limited "Car Wash 305" directly adjacent to the east and 79th Street Auto Center, one block west of the subject site. The use and size of the proposed establishment is consistent with other auto related commercial establishments in the immediate area and the use is permitted per the MCNP and the Miami 21 Code by Warrant. The proposed carwash will be the first Miami 21 code 2 File No. 2018-0067 compliant auto related commercial establishment to be constructed in the immediate area, along NE 79' Street. Findings: Consistent with the intent of Miami 21 D. CRITERIA: 1. Warrant, pursuant to Article 4, Table 3 and Article 7, Section 7.1.2.4(d.) As appropriate to the nature of the Warrant involved and the particular circumstances of the case, the following criteria shall apply to a Warrant application. The application shall be reviewed for compliance with this Code. The review shall consider the intent of the Transect, the guiding principles of the Miami 21 Code, and the manner in which the proposed Use will operate given its specific location and proximity to less intense Uses. The review shall also apply Article 4, Table 12, Design Review Criteria, as applicable. Analysis: The subject proposal has been reviewed for Warrant Permit pursuant to Article 4, Table 3 Building Function: Uses and Article 4, Table 12 of Miami 21 Code, as adopted, the Zoning Ordinance of the City of Miami, Florida, which states that auto -related commercial establishment (automated carwash) in "T5-O" Urban Center Transect Zone shall be by Warrant, Staff finds the plans attached hereto as exhibit A entitled "Plans" to be in compliance with all applicable criteria pursuant to the Miami 21 Code. Furthermore, staff notes the proposed use is less intense then the previous auto mechanic shop on site. The proposed building disposition is found to address all frontages and creates a transition in height with the abutting properties. The facades have been carefully design by incorporating architectural elements indicative of South Florida, address the pedestrian realm, by enhancing the width of the sidewalks and incorporating street trees. Waiver pursuant to Article 7, Section 7.1.2.5(28); The Waiver permits specified minor deviations from the Miami 21 Code, as provided in the various articles of the Miami 21 Code and as consistent with the guiding principles of said Code. Waivers are intended to relieve practical difficulties in complying with the strict requirements of the Code. Waivers are not intended to relieve specific cases of financial hardship, nor to allow circumventing of the intent of the Code. A Waiver may not be granted if it conflicts with the City Code or the Florida Building Code. (28) As appropriate to the nature of the Waiver involved and the particular circumstances of the case, Waivers up to ten percent (10%) of any particular standard of this Code except Density, Intensity and Height, may be granted when doing so promotes the intent of the particular Transect Zone where the proposal is located; is consistent with the guiding principles of this Code; and there is practical difficulty in otherwise meeting the standards of the Transect Zpne or when doing so promotes energy conservation and Building sustainability. The inability to achieve maximum Density, Height, or floor plate for the Transect shall not be considered grounds for the granting of a Waiver. This Waiver cannot be combined with any other specified Waiver of the same standard. Analysis: The Applicant is requesting to allow the building to Setback 9' where 10' is required along the Primary and Secondary frontage. Staff notes that the existing building abutting the subject property located at 1025 NE 79th Street has a zero foot setback from the Primary frontage as the building directly across NE 10th Avenue located at 981 NE 79th Street, which is also setback at zero feet from the Primary and Secondary frontage. Pursuant to Section 7.1.2.5(3) the Applicant may request a Waiver to match the dominate setback of the block and its context. 981 NE 79 Street 1025 NE 79 Street Furthermore, staff finds the request is warranted in order to comply with visibility triangle requirements as further identified in Sheets A1.O and A1.O@ of the plans attached hereto as Exhibit A entitled Moyka Car Wash No. 2. Findings: Complies 4 File No, 2018-0067 3. Waiver pursuant to Article 5, Section 5.5.4 (g) to permit a vehicular entrance of a parking lot or garage on a Frontage shall be no wider than twenty-five (25) feet and the minimum distance between vehicular entrances shall be sixty (60) feet, unless approved by Waiver. Analysis: The subject parcel in a corner lot, measuring approximately 115' by 119' at its widest length, with an overall lot area of approximately 13, 685 sq. ft. The lot has a Primary Frontage along NE 79th Street and a Secondary Frontage along NE 10th Avenue. Pursuant to Section 5.5.4(c), parking shall be access from a Secondary Frontage. See Plan Sheet A1.0 or image below entitled Site Plan. Vs ett a a 0 to 0 Site Plan Primary Frontage — NE 79th Street Due to the requirements under Section 5.5.4(c) that require vehicular access only from the Secondary Frontage in addition to visibility triangle requirements and the 60' distance separation between driveways under 5 File No. 2018-0067 Section 5.5.4 (g) provide for practical difficulties in complying with the strict requirements under the Miami 21 Code. As previously note, the site along the Secondary Frontage measures approximately 114', having to comply with visibility triangle requirements and the 60' distance separation between driveways limits the Applicants ability to develop the site in an efficient manner without obtaining a Waiver, See Analysis under Waiver 2. above. Findings: Consistent with the intent of Miami 21 4. Waiver pursuant to Article 6, Table 13 to reduce one (1) reservoir parking by Waiver Analysis: See Analysis under Waiver 1 and 2 above. Staff has conducted a thorough review of plans and found said request to be warranted, furthermore the Applicant provided staff with statistical traffic peak count information which has been reviewed by the City of Miami Office of Transportation. Under Miami 21 a Traffic study is not required however the Applicant provided additional information, the City of Miami Office of Transportation reviewed the site plan and the traffic peak count information and had no objections with recommendations to the development as proposed. See Exhibit C entitled "Office of Transportation". Findings: Complies E. NEIGHBORHOOD SERVICES: Pursuant to Article 7, Section 7.1.3.4 of the above -cited Zoning Ordinance, the Planning Department has made referrals to the following Departments and Boards. Their comments and recommendations have been duly considered for this final decision. The establishment will operate an automated carwash along with the following associated Warrant and Waiver(s): 1. Warrant to permit auto related commercial establishment (Automated Carwash) 6 File No. 2018-0067 2. Waiver to allow building to setback at 9' where 10' is required along the principal and secondary frontage. 3. Waiver to allow for a reduction in distance separation between vehicular entrances along the eastern secondary frontage, 42'-11" where 60' is required. 4. Waiver to allow for a reduction of one (1) reservoir parking space, where three (3) reservoir parking spaces are required. G. RECOMMENDATION: Based on the above findings and the considered advice of the officers and agencies consulted on this matter and pursuant to Article 4, Table 3, Article 7, Section 7.1.3.4, Article 5, Section 5.5.4(g), Article 6, Table 13 and Article 7, Section 7.1.2.5.a(28) of the Miami 21 Code of the Zoning Ordinance, the subject proposal is hereby approved with conditions subject to the plans submitted by the applicant and on file with the Planning Department as well as the following conditions: CONDITIONS: 1. The Applicant shall comply with applicable requirements of Chapter 24 of the Miami -Dade County Code as amended. 5. The Applicant shall obtain all necessary approval from the Florida Department of Transportation as part of the building permitting process. 6. The Applicant shall comply with the conditions from the Office of Capital Improvements Transportation Division pursuant to Exhibit C. 7. After repairing the property and completing his tenant improvements, the tenant requested a certificate of use in order to begin operating his business. Much to his surprise, the request was denied and he was told that the property had lost its grandfather status and does not comply with zoning. The zoning official suggested I prepare this letter for your consideration of allowing this use on a property that has historically been operated as an auto service building. Needless to say, we believe this is a needed service in this community given the hard economic times that the majority of Miami Dade County and City of Miami residents are facing. The days of purchasing a new car every two years is over and we are learning to hold on to these cars longer and that requires maintenance and repairs. We have been involved with this property since late 2008 when the foreclosure process was finalized. After foreclosure, the Bank had to initiate an eviction process which took several months. In early 2009, we were able to assess the condition of the property and begin the clean up stage. The prior owner not only left the property in disrepair but full of trash and debris, something that we addressed immediately but took some weeks to complete. We began our marketing efforts and there was a great deal of interest, to re-establish an auto service business. The major drawbacks to finalizing a deal was mostly -1) the difficult financing environment and 2) the fact that the property was being monitored for environmental issues. Despite the Interest none of the offers or letter of intents resulted in the acquisition of the property JUI GV I uo.00p HUViino$u KE _:Stale! HUV JUL /-oJUJ There was no lack of interest in the property but these difficult econom ic times, due to the financial markets illiquidity has made it difficult for small businesses to acquire capital either to purchase properties and businesses and/or to expand. Therefore, the pool ofowner/users or qualified purchasers is greatly reduced and the properties have to be exposed to the markets much longer than anyone has a nticipated. To add insult to injury, the property was vandalized in early to mid-2010 resulting in stolen personal property and the copper lines being removed from the entire building. We were able to secure a tenant that was willing to take the property in as -is condition. Mr. Morales has worked diligently to transform this property from a vacant eye sore to a property ready for occupancy that any owner would be envious to own. This has come at a great cost to Mr, Morales as he has put not only cash but sweat equity_ i would like to emphasi2e the point that many operators felt that their business would flourish in the subject location, and needless to say we believe this is a service the local community can benefit from specially when one considers the difficulty for families to buy new cars today. The days of purchasing or leasing vehicles for 2 years as so many of us have done in the past, I believe are gone, as we all are looking to hold on to our belongings a little longer. Mr. Morales has purported to the Owners and myself that he has been in the business and operating in that community for many years. Mrs. Slazyk, we are asking for your assistance to review this file and reinstate the property use and please note that this use is not a typical for the area. NE 79th Street, Miami, FL, which is immediately adjacent to the Project. Please accept this letter, along with the requisite appeal fee, as a timely appeal of the Wan -ant, which was approved by the City and posted on its website on February 19, 2019. A copy of the Warrant is attached hereto as Exhibit "A." Pursuant to Section 7.1.2.4 of Miami 21, a Warrant shall be reviewed to determine compliance with Miami 21, including the intent of the Transect, the guiding principles of Miami 21, and the manner in which the proposed use will operate given its specific location and proximity to less intense uses. With respect to Waivers, Section 7.1.2.5 of Miami 21 provides that Waivers shall be reviewed for compliance with the standards applicable to the specific Waiver and the guiding principles of Miami 21. Waivers are intended to relieve practical difficulties in complying with the strict requirements of Miami 21, and are not automatically granted upon request. The applicant has to demonstrate that there is practical difficulty in complying with the requirement, and the City is obligated to review the Waiver(s) for compliance with the standards applicable to the specific Waiver. That did not occur here. In this case, two of the Waivers sought by the applicant relate to traffic circulation within the Project, which in turn, impact adjacent roadways. Despite these requests, the applicant did not submit, and the City's Planning Department did not request, any documentation to support the granting of these Waivers, nor was there any analysis by the City of the standards applicable to these specific Waivers. In its review of the Warrant (including the underlying Waivers), the City's Transportation Analysist, Collin Worth, recognized and acknowledged the importance of analyzing traffic circulation within the Project, and the potential impact on adjacent roadways. Specifically, Mr. Worth noted that "it would be good to see the site plan and understand how vehicles are accessing the site, maneuverability, vehicle loading or storage, and [how] driveways are laid out." He then noted that "[w]hile no queuing or operations report has been provided, the site meets code requirements for parking reservoir spaces." See Exhibit "B." As evidenced by the applicant's Waiver request, the Project does not meet the requirements for reservoir spaces. Again, the approval of a Waiver is not automatic upon request. The applicant has to demonstrate that there is practical difficulty in complying with the requirement, and the City is obligated to review the Waiver for compliance with the standards applicable to the specific Waiver. While the applicant failed to provide any documentation that would address traffic circulation within the Project and its impact on adjacent roadways, expert analysis was provided to the Planning Department by the appellant that raised significant concerns with respect to the requested Warrant (and underlying Waivers), including potential issues with vehicle queuing and maneuverability within the Project and the resulting impact on adjacent roadways. In support of this appeal, we hereby submit expert evidence demonstrating significant issues with respect to vehicle queueing and maneuverability within the Project. Specifically, we have enclosed a trip generation, queueing, access and internal site circulation analysis prepared by Joaquin Vargas of Traf Tech Engineering, Inc. (the "Traffic Report"), which is attached hereto as Exhibit "C." The Traffic Report concludes that the Project does not provide sufficient queueing to accommodate the peak vehicular demands anticipated at this automated car wash facility. Moreover, the driveway dimension provided adjacent to the vacuum stations is insufficient to allow maneuvers to and from the vacuum stations in a safe manner, without conflicting with the queueing line for the car wash. As a result of these issues, the Traffic Report concludes that there will likely be spillage onto NE 10th Avenue, which is further compounded by the non -compliant proximity of the driveway to the intersection of NE 79th Street/NE 10th Avenue and the existing traffic signal. Notwithstanding these significant issues, which were presented to the Planning Department during its review of the Warrant, the City approved the Warrant. The applicant provided no expert evidence to address queueing, access and internal site circulation for its Project in order to support the granting of the Warrant (and the underlying Waivers). PROPERTY AND BACKGROUND INFORMATION: The subject parcel is vacant, consisting of approximately 13,685 sq. ft., located at the northeast corner of NE 79' Street and NE 10' Avenue within the Shore Crest subdivision. Per records of the Office of Zoning, that last Use on the subject parcel File No, 2018-0067 was an auto related commercial establishment (Mechanic Shop) See exhibit B entitled "Zoning Records". Previous Auto Mechanic Shop located on the subject parcel, since demolished. On September 4, 2018, the Applicant submitted an application for a Warrant and associated Waiver(s) to allow for the redevelopment of the subject site, and to permit an auto related commercial establishment (automated carwash) which is the subject of this request. C. MIAMI COMPREHENSIVE NEIGHBORHOO PLAN (MCNP): The subject site is designated Restricted Commercial, this category allows general office use; clinics and laboratories, auditoriums, libraries, convention facilities, places of worship, and primary and secondary schools. Also allowed are commercial activities that generally serve the daily retailing and service needs of the public, typically requiring easy access by personal auto, and often located along arterial or collector roadways, which include: general retailing, personal and professional services, real estate, banking and other financial services, restaurants, saloons and cafes, general entertainment facilities, private clubs and recreation facilities, major sports and exhibition or entertainment facilities and other commercial activities whose scale and land use impacts are similar in nature to those uses described above. Analysis:The subject site previously housed an auto related commercial establishment known as Oscar Complete Auto Repair. The site is located on a major east west commercial arterial roadway (NE 79th ST) which also serves as the connector to North Bay Village. Staff notes that other similar uses exist in close proximity to the site such as but not limited "Car Wash 305" directly adjacent to the east and 79th Street Auto Center, one block west of the subject site. The use and size of the proposed establishment is consistent with other auto related commercial establishments in the immediate area and the use is permitted per the MCNP and the Miami 21 Code by Warrant. The proposed carwash will be the first Miami 21 code 2 File No. 2018-0067 compliant auto related commercial establishment to be constructed in the immediate area, along NE 79th Street. Findings: Consistent with the intent of Miami 21 . CRITERIA: 1. @Warrant, pursuant to Article 4, Table 3 and Article 7, Section 7.1.2.4(d.) As appropriate to the nature of the Warrant involved and the particular circumstances of the case, the following criteria shall apply to a Warrant application. The application shall be reviewed for compliance with this Code. The review shall consider the intent of the Transect, the guiding principles of the Miami 21 Code, and the manner in which the proposed Use will operate given its specific location and proximity to less intense Uses. The review shall also apply Article 4, Table 12, Design Review Criteria, as applicable. Analysis: The subject proposal has been reviewed for Warrant Permit pursuant to Article 4, Table 3 Building Function: Uses and Article 4, Table 12 of Miami 21 Code, as adopted, the Zoning Ordinance of the City of Miami, Florida, which states that auto -related commercial establishment (automated carwash) in "T5-O" Urban Center Transect Zone shall be by Warrant. Staff finds the plans attached hereto as exhibit A entitled "Plans" to be in compliance with all applicable criteria pursuant to the Miami 21 Code. Furthermore, staff notes the proposed use is less intense then the previous auto mechanic shop on site. The proposed building disposition is found to address all frontages and creates a transition in height with the abutting properties. The facades have been carefully design by incorporating architectural elements indicative of South Florida, address the pedestrian realm, by enhancing the width of the sidewalks and incorporating street trees. Findings: Complies Rendering of the proposed canvash looking east from NE loth Avenue. 3 File No. 2018-0067 2. Waiver pursuant to Article 7, Section 7.1.2.5(28); The Waiver permits specified minor deviations from the Miami 21 Code, as provided in the various articles of the Miami 21 Code and as consistent with the guiding principles of said Code. Waivers are intended to relieve practical difficulties in complying with the strict requirements of the Code. Waivers are not intended to relieve specific cases of financial hardship, nor to allow circumventing of the intent of the Code. A Waiver may not be granted if it conflicts with the City Code or the Florida Building Code. (28) As appropriate to the nature of the Waiver involved and the particular circumstances of the case, Waivers up to ten percent (10%) of any particular standard of this Code except Density, Intensity and Height, may be granted when doing so promotes the intent of the particular Transect Zone where the proposal is located; is consistent with the guiding principles of this Code; and there is practical difficulty in otherwise meeting the standards of the Transect Zone or when doing so promotes energy conservation and Building sustainability. Analysis: The Applicant is requesting to allow the building to Setback 9' where 10' is required along the Primary and Secondary frontage. Staff notes that the existing building abutting the subject property located at 1025 NE 79th Street has a zero foot setback from the Primary frontage as the building directly across NE 10th Avenue located at 981 NE 79th Street, which is also setback at zero feet from the Primary and Secondary frontage. Pursuant to Section 7.1.2.5(3) the Applicant may request a Waiver to match the dominate setback of the block and its context. 981 NE 79 Street 1025 NE 79 Street Furthermore, staff finds the request is warranted in order to comply with visibility triangle requirements as further identified in Sheets A1.0 and A1.0@ of the plans attached hereto as Exhibit A entitled Moyka Car Wash No. 2. Findings: Complies 4 File No. 2018-0067 3. Waiver pursuant to Article 5, Section 5.5.4 (g) to permit a vehicular entrance of a parking lot or garage on a Frontage shall be no wider than twenty-five (25) feet and the minimum distance between vehicular entrances shall be sixty (60) feet, unless approved by Waiver. Analysis: The subject parcel in a corner lot, measuring approximately 115' by 119' at its widest length, with an overall lot area of approximately 13, 685 sq. ft. The lot has a Primary Frontage along NE 79th Street and a Secondary Frontage along NE 10th Avenue. Pursuant to Section 5.5.4(c), parking shall be access from a Secondary Frontage. See Plan Sheet A1.0 or image below entitled Site Plan. Secondary Frontage - NE 10 Ave Site Plan Primary Frontage — NE 79th Street Due to the requirements under Section 5.5.4(c) that require vehicular access only from the Secondary Frontage in addition to visibility triangle requirements and the 60' distance separation between driveways under 5 File No. 2018-0067 Section 5.5.4 (g) provide for practical difficulties in complying with the strict requirements under the Miami 21 Code. As previously note, the site along the Secondary Frontage measures approximately 114', having to comply with visibility triangle requirements and the 60' distance separation between driveways limits the Applicants ability to develop the site in an efficient manner without obtaining a Waiver. See Analysis under Waiver 2. above. Findings: Consistent with the intent of Miami 21 4. Waiver pursuant to Article 6, Table 13 to reduce one (1) reservoir parking by Waiver Analysis: See Analysis under Waiver 1 and 2 above. Staff has conducted a thorough review of plans and found said request to be warranted, furthermore the Applicant provided staff with statistical traffic peak count information which has been reviewed by the City of Miami Office of Transportation. Under Miami 21 a Traffic study is not required however the Applicant provided additional information, the City of Miami Office of Transportation reviewed the site plan and the traffic peak count information and had no objections with recommendations to the development as proposed. See Exhibit C entitled "Office of Transportation". Findings: Complies E. NEIGHBORHOOD SERVICES: Pursuant to Article 7, Section 7.1.3.4 of the above -cited Zoning Ordinance, the Planning Department has made referrals to the following Departments and Boards. After repairirig the property and completing his tenant improvements, the tenant requested a certificate of use in order to begin operating his business. Much to his surprise, the request was denied and he was told that the property had lost its grandfather status and does not comply with zoning. The zoning official suggested I prepare this letter for your consideration of allowing this use on a property that has historically been operated as an auto service building, Needless to say, we believe this is a needed service in this community given the hard economic times that the majority of Miami Dade County and City of Miami residents are facing. .The days of purchasing a new car every two years is over and we are learning to hold on to these cars longer and that requires maintenance and repairs. We have been involved with this property since late 2008 when the foreclosure process was finalized. After foreclosure, the Bank had to initiate an eviction process which took several months. In early 2009, we were able to assess the condition of the property and begin the clean up stage. The prior owner not only left the property in disrepair but full of trash and debris, something that we addressed immediately but took some weeks to complete. We began our marketing efforts and there was a great deal of interest, to re-establish an auto service business. The major drawbacks to finalizing a deal was mostly -1) the difficult financing environment and 2) the fact that the property was being monitored for environmental issues. To add insult to injury, the property was vandalized in early to mid-2010 resulting in stolen personal property and the copper lines being removed from the entire building. Our review focused on trip generation, queueing, access and internal site circulation. The following is a summary of our findings: Trip Generation The trip generation for the proposed one -tunnel car wash was based on information contained in the Institute of Transportation Engineers (ITE) Trip Generation Manual (10th Edition). According to the subject ITE document, the trip generation for a typical weekday peak hour of automated car wash (ITE's Land Use Code 948) is determined with the following equation: Peak Hour Trips = 77.5 (X), where X is the number of automated tunnels For the proposed 1001 NE 79th Street Car Wash, the typical weekday peak hour is estimated to be 78 trips (39 inbound and 39 outbound). The directional distribution between inbound and outbound trips is also based on ITE. Queuing The maximum queue anticipated at the subject car -wash facility was determined using information contained in ITE's Transportation and Land Development, Chapter 81. Hence, the subject car wash can theoretically process one (1) vehicle through the tunnel per minute, or up to 60 vehicles per hour. o Demand Rate: Based on trip generation section of this report, the maximum number of inbound vehicular traffic flow anticipated at the subject car wash is approximately 39 vehicles. Using equation 8-9b and Table 8-11 of ITE's Transportation and Land Development, the maximum number of vehicles accumulated on site, at the 95% confidence level, is five (5) vehicles. Since the proposed car wash facility is designed to accommodate two vehicles without interfering with the vacuum stations and south drive aisle (refer to site plan contained in Attachment A), queuing is projected to be a concern at this facility. In other words, the projected on -site queues are projected to interfere with the vacuum stations and could potentially spill onto NE 10th Avenue. It is important to note that the 5- vehicle stacking projection is based on an aggressive one -vehicle per minute processing time assuming a seamless process. Hence, queuing at this facility will likely exceed five vehicles during typical weekdays' peak periods. The results of the ITE queuing/stacking procedure is contained in Attachment B. Access and Internal Site Circulation The proposed site plan includes a full -access driveway (south driveway) on NE 10th Avenue located approximately 50 feet from NE 79th Street and an egress -only driveway (north driveway) also on NE 10th Avenue. Based on FDOT's Access Management Standards2 (Rule 14-97), the south driveway is too close to NE 79th Street and this is further compounded by a traffic signal at NE 79th Street and NE 10th Avenue. According to FDOT, the minimum driveway spacing for isolated corner properties is 125 feet. The south driveway as proposed has a 60% variance from FDOT's safe driveway spacing standards. With more than two vehicles in queue, the 24-foot drive aisle located adjacent to the vacuum stations is not wide enough to allow parking and un-parking maneuvers to and from the vacuum stations.
