A RESOLUTION OF THE MIAMI HISTORIC AND ENVIRONMENTAL
PRESERVATION BOARD, PURSUANT TO SEC. 23-14 OF THE CITY CODE OF
ORDINANCES, RECOMMENDING DENIAL OF AN APPLICATION FOR AN AD
VALOREM TAX EXEMPTION (PART II) FOR A PROPERTY LOCATED
APPROXIMATELY AT 528 SOUTHWEST 9 AVENUE, MIAMI, FLORIDA, 33130,
WITHIN THE RIVERVIEW HISTORIC DISTRICT; FURTHER INCORPORATING THE
ANALYSIS IN THE ATTACHED STAFF REPORT ENTITLED "EXHIBIT A" WITH THE
FOLLOWING FINDINGS.
1. The Ad Valorem Tax Exemption shall not include the windows on the front facade facing
SW 9th Avenue.
Vice Chair Lynn Lewis motioned to recommend denial of the application because the
improvements which have been made to the property do not conform to the specific
requirements of this Board when it dealt with two companion items on the same
property, specifically HEPB-R-15-053 and HEPB-R-15-054. To be even more specific,
what was approved in 2015 for this building and its Special Certificate of
Appropriateness in conformity with the Standards of the Secretary of the Interior
included retention of the windows, window openings and stucco of the arched window
and arched door along the Southwest 9 Avenue facade.

A. GENERAL INFORMATION:
REQUEST: Pursuant to Section 23-10 of the City Code of Ordinances as amended the Applicant is
requesting a recommendation for approval of the Ad Valorem Property Tax Exemption for Historic
Resources, Part II Application for an existing low -density, multifamily residential structure located on
a parcel zoned T4-R "General Urban Transect Zone".
The subject property is a Contributing structure located within the Riverview Historic District,
Riverview Subdivision and the Little Havana Net Area. The site is approximately the second parcel
located on the North quadrant of SW 6th Street and SW 9th Avenue. (Complete legal description is

B. BACKGROUND:
The applicant came before the Historic and Environmental Preservation Board on July 07, 2015 for
the renovation of the exterior and interior, and an addition. The application was approved under
HEPB-R-15-053 (Attachment "A").
The approved plans depicted a four-story addition on the north side of the existing building that
accommodates an elevator and a second emergency staircase. A new rooftop terrace with a covered
bar and bathroom with a flat roof and finished with stucco. Finally, the renovation of the interior and
exteriors were approved.
The applicant came before the Historic and Environmental Preservation Board on July 07, 2015 for
approval of the Ad Valorem Application, Part I for the renovation of the exterior and interior, and a
new addition. The application was approved, with conditions, under HEPB-R-15-054 (Attachment
"B"). The condition with which Part I was approved, states that 'the description of the windows for
which there will be the ad valorem tax exemption will not include the windows on the front facade
facing SW 9th Avenue.
C. COMPREHENSIVE PLAN:
The subject property is a Contributing structure within the Riverview Historic District and constructed
in 1925. Pursuant to Goal LU-2, 2.3 and 2.4 of the Miami Neighborhood Comprehensive Plan the
City will preserve and protect the heritage of the City of Miami through the identification, evaluation
rehabilitation, adaptive reuse, restoration and public awareness of Miami's historic and archeological
resources.
The Applicant is requesting a recommendation of approval for the Ad Valorem Property Tax
Exemption for Historic Resources, Part II Application in accordance with the Comprehensive Plan
and the Secretary of Interior Standards.

The following is a review of the request pursuant to Section 23-10 of the City Code of Ordinances and
the Secretary of Interior Standards. The General Information section of this report is hereby incorporated
into the analysis and its corresponding criteria by reference:
Analysis: The subject property is a two-story contributing hotel constructed in 1925.
The applicant is requesting approval of the AD Valorem Property Tax Exemption for
Historic Resources, Part II Application. The applicant received approval from the Historic
and Environmental Preservation Board for the following completed improvements:
-Windows: Replace all windows with hurricane impact single -hung, horizontal
rollers, and fixed with applied colonial muntins (does not include the windows on the
front facade facing SW 9th Avenue).
- Drywall Partitions: Replace all damaged drywall partitions.
- Ceilings: Patch and repair holes in ceilings.
- Bathroom Fixtures: Replace all tubs, sinks and toilets.
- Floor Tiles: Replace floor tiles.
- Structural Systems: Replace structural and load bearing walls.
- Floor Joists: Replace wood floor joists as necessary.
- Addition: Build an addition to house an elevator and second emergency
staircase.
Unlike the City of Miami's Historic and Environmental Preservation Board's authority to
review only the exterior improvements in a Certificate of Appropriateness application, an
ad valorem tax exemption requires that the interior improvements be reviewed as well if
the tax exemption is to be applied. The guidelines for the review of interior improvements
include: Whether or not significant materials, examples of superior craftsmanship, and
volume -defining spaces (e.g. cathedral ceilings, mezzanine spaces) are retained.
Preservation staff inspected the property and in accordance with Division II - Sec, 23-19
of the City Code and found that the work complies with resolution HEPB-R-15-054.

H. CONCLUSION:
The application has demonstrated compliance with Chapter 23 entitled "Historic Preservation" of the
City of Miami Code of Ordinances and the Secretary of the Interior's Standards. Staff finds the
request complies with all applicable criteria subject to the following conditions as stipulated in
subjection "I" entitled ''Recommendation" as listed below.
I. RECOMMENDATION:
Pursuant to Section 23-10 of the City of Miami Code of Ordinances as amended and the Secretary
of Interior Standards, the Planning Department recommends the recommendation of approval with
conditions for the application for Ad Valorem Tax Exemption for Historic Properties, Part II.
1. Thea Ad Valorem Tax Exemption shall not include the windows on the front fa9ade facing
SW 9th Avenue.

1. All historic masonry openings in the front elevation be kept in the same size and that the
windows will match in accordance to historic preservation guidelines as administered by
staff.
2. Entire front facade and all its architectural details will follow historic preservation
guidelines.
3. Rooflines will also match what evidence we have by the photograph of what was
existing.
4. Windows in side elevations will meet what was submitted for building permit.
