("PROVIDER") IS A QUALIFIED FIRM WITH THE REPUTATION, EXPERTISE, AND INFRASTRUCTURE TO IMPLEMENT THE SUMMER YOUTH EMPLOYMENT & FINANCIAL EMPOWERMENT PROGRAM ("PROGRAM") AND THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA AS AMENDED; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AN AMENDMENT TO THE 2019 PROFESSIONAL SERVICES AGREEMENT ("2019 AGREEMENT") EXECUTED WITH THE PROVIDER, ATTACHED AND INCORPORATED HEREIN AS EXHIBIT "B," TO INCREASE THE FUNDING IN THE NOT TO EXCEED AMOUNT OF TEN THOUSAND, FIVE HUNDRED THIRTY DOLLARS ($10,530.00) AND TO ALLOW FOR AN ADDITIONAL OPTION TO RENEW THE PROGRAM, SUBJECT TO AVAILABILITY OF FUNDS, FOR THE PERIOD COMMENCING APRIL 1, 2020 THRU NOVEMBER 30, 2020 IN AN AMOUNT NOT TO EXCEED THREE HUNDRED FIFTY-THREE THOUSAND, THREE HUNDRED SIXTY-FOUR DOLLARS ($353,364.00), UNDER THE SAME TERMS AND CONDITIONS AS THE 2019 AGREEMENT. WHEREAS, the City of Miami ("City") was awarded a grant for Three Hundred Sixty - Seven Thousand, Five Hundred Dollars ($367,500.00) ("Grant") from the Cities for Financial Empowerment Fund, Inc. ("CFE") for the purpose of expanding and supporting up to one hundred (100) additional summer youth employment opportunities with local businesses and entities and to continue to adhere to established program components to connect participants to financial counseling and banking opportunities; and WHEREAS, this additional funding enabled the City to expand its Summer Youth Employment & Financial Empowerment program ("Program") by partnering with an experienced local provider of summer programs; and WHEREAS, pursuant to Resolution No. R-17-0195 adopted on April 27, 2017, among other things, created a Special Revenue Project for the Program in an amount not to exceed Three Hundred Forty -Two Thousand, Eight Hundred Thirty -Four Dollars ($342,834.00); and WHEREAS, the Overtown Youth Center, Inc. ("Provider") is a well -respected and recognized non-profit entity who is presently serving the local community and has been City of Miami Page 1 of 3 File ID: 6409 (Revision:) Printed On: 4/25/2025 File ID: 6409 Enactment Number: R-19-0408 providing the services required by the Program to aid in the hiring of additional local disadvantaged youth for summer job placement and oversight; and WHEREAS, the City and the Provider exercised their second and final option to renew the Agreement and executed a Professional Services Agreement ("2019 Agreement") on June 6, 2019 for Three Hundred Forty -Two Thousand, Eight Hundred Thirty -Four Dollars ($342,834.00) to implement the Program in 2019; and WHEREAS, the Provider's cost associated with salaries, background screening, transportation, and other administrative functions, all necessary expenses for the implementation of the Program, have increased since the inception of the Program in 2017; and WHEREAS, the Provider continues to be the most advantageous non-profit organization with the reputation, expertise, and infrastructure in summer youth programs to provide implementation, oversight, and staffing to ensure the Program implementation as required by the Grant; and WHEREAS, the City Manager is requesting for the City Commission to authorize the allocation of additional funding in the not to exceed amount of Ten Thousand, Five Hundred Thirty Dollars ($10,530.00) for the 2019 Program; and WHEREAS, the City Manager has made a written finding, attached and incorporated herein as Exhibit "A," pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), that competitive negotiation methods and procedures are not practicable or advantageous for the City and has recommended to the City Commission that the recommendations and findings be adopted and that competitive bidding methods and procedures be waived for the Program; and WHEREAS, the City Manager is requesting for the City Commission to authorize the negotiation and execution, in a form acceptable to the City Attorney, of an amendment to the 2019 Agreement, attached and incorporated herein as Exhibit "B," to increase the funding in the not to exceed amount of Ten Thousand, Five Hundred Thirty Dollars ($10,530.00) and to allow for an additional option to renew the Program, subject to availability of funds, for the period commencing April 1, 2020 through November 30, 2020 ("2020 Option") in an amount not to exceed Three Hundred Fifty -Three Thousand, Three Hundred Sixty -Four Dollars ($353,364.00) under the same terms and conditions as the 2019 Agreement; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written findings and recommendations that the Provider is a qualified firm with the reputation, expertise, and infrastructure to implement the Program, attached and incorporated herein as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous pursuant to Section18-85(a) of the City Code, and waiving the requirements for said procedures are hereby ratified, approved, and confirmed. The City Manager is authorized' negotiate and execute, in a form acceptable to the City Attorney, an amendment to the 2019 Agreement, attached and incorporated herein as Exhibit "B," to increase the funding in the not to exceed amount of Ten Thousand, Five Hundred Thirty Dollars ($10,530.00) and to allow for an additional option to renew the Program, subject to availability of funds, for the 2020 Option in an amount not to exceed Three Hundred Fifty -Three Thousand, Three Hundred Sixty -Four Dollars ($353,364.00) under the same terms and conditions as the 2019 Agreement. Section 4.
