AUTHORIZING THE ACCEPTANCE OF FLORIDA STATE HOUSING
OPPORTUNITIES FOR PERSONS WITH AIDS ("HOPWA") PROGRAM FUNDING, IN
AN AMOUNT NOT TO EXCEED $947,477.60 FOR FISCAL YEAR 2019-2020, FOR
THE PURPOSE OF IMPLEMENTING PROGRAMS THAT HELP SUSTAIN OR
TRANSITION INDIVIDUALS AND FAMILIES TO STABLE HOUSING, FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL
DOCUMENTS INCLUDING AMENDMENTS, RENEWALS, EXTENSIONS, AND
MODIFICATIONS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AS
MAY BE NECESSARY FOR SAID PURPOSE, SUBJECT TO ALL FEDERAL, STATE,
AND LOCAL LAWS THAT REGULATE THE USE OF SUCH FUNDS.
Background of Item:
The Florida State HOPWA Program was created to prevent the condition of
homelessness from occurring to individuals and families living with HIV/AIDS, to
transition individuals and families back into stable housing as soon as possible, as well
as to create a strategy for long-term housing stability for persons living with HIV/AIDS.
On August 1, 2019, the Department of Housing and Community Development ("DHCD")
was informed by the Florida State Housing Opportunities for Persons with AIDS
("HOPWA") program of the allocation of the HOPWA funds in an amount not to exceed
$947,477.60.
The fund is provided for the purpose of implementing programs that help sustain or
transition individuals and families to stable housing in Miami -Dade County.
The City Administration recommends accepting the Florida State HOPWA Program
funds, in an amount not to exceed $947,477.60 for Fiscal Year 2019-2020.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE ACCEPTANCE OF STATE OF FLORIDA HOUSING
OPPORTUNITIES FOR PERSONS WITH AIDS ("HOPWA") PROGRAM FUNDS IN AN
AMOUNT NOT TO EXCEED $947,477.60 FOR FISCAL YEAR 2019-2020 FOR THE
PURPOSE OF IMPLEMENTING PROGRAMS THAT HELP SUSTAIN OR
TRANSITION INDIVIDUALS AND FAMILIES TO STABLE HOUSING; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL
NECESSARY DOCUMENTS, INCLUDING AMENDMENTS, EXTENSIONS, AND
MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY,
SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE THE
USE OF SUCH FUNDS FOR SAID PURPOSE.
WHEREAS, the State of Florida ("State") Housing Opportunities for Persons with AIDS
("HOPWA") program was created to prevent the condition of homelessness from occurring to
individuals and families living with HIV/AIDS, to transition individuals and families back into
stable housing as soon as possible, and to create a strategy for long-term housing stability for
persons living with HIV/AIDS; and
WHEREAS, on August 1, 2019, the Department of Housing and Community
Development was informed by the State HOPWA program of the allocation of the HOPWA
program funds in an amount not to exceed $947,477.60; and
WHEREAS, the HOPWA program funds are provided for the purpose of implementing
programs that help sustain or transition individuals and families to stable housing in Miami -Dade
County; and
WHEREAS, the City of Miami Administration recommends accepting the Florida State
HOPWA program funds in an amount not to exceed $947,477.60 for Fiscal Year 2019-2020;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The acceptance of State HOPWA program funds in an amount not to exceed
$947,477.60 for Fiscal Year 2019-2020 for the purpose of implementing programs that help
sustain or transition individuals and families to stable housing is authorized.'
1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
Section 3. The City Manager is authorized' to negotiate and execute any and all
necessary documents, including amendments, extensions, and modifications, all in forms
acceptable to the City Attorney, subject to all federal, state, and local laws that regulate the use
of such funds for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
