AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMENDING CHAPTER
2, ARTICLE II, SECTION 2-33(C)(7) AND SECTION 2-33(K) OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED
"ADMINISTRATION/MAYOR AND CITY COMMISSION/ORDER OF BUSINESS
AND RULES OF PROCEDURE," TO CHANGE THE TIME AND MANNER
WHEREBY THE CITY COMMISSION MEETINGS ARE ADJOURNED;
CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.

WHEREAS, the operation of the adjournment rule set forth in Section 2-33(c)(7) is at
odds with the number of items routinely on the agenda for deliberation by the City Commission;
and
WHEREAS, City of Miami ("City") business should be conducted within reasonable
hours rather than in the dark of night; and
WHEREAS, the City Commission finds it to be in the best interests of the citizens,
residents and stakeholders of the City to amend its rules of procedure to provide for a more
transparent and efficient means of conducting City Commission meetings;
NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as fully set forth in this Section.
Section 2. Chapter 2, Article II of the Code of the City of Miami, Florida, as amended,
are further amended in the following particulars:1
"CHAPTER 2
ADMINISTRATION
ARTICLE II. MAYOR AND CITY COMMISSION

added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted

Section 2-33(c). Order of business and rules of procedure.
(7). The city commission meetings, shall adjourn:
(a) At the conclusion of deliberation of the agenda item being considered at
10:00 p.m., unless the time is extended by unanimous agreement of the
hers of the city commission then present, or
(b) At the conclusion of the regularly scheduled agenda, whichever occurs
first. This rule does not apply to city commission meetings required for
annual budget hearings.
(k) Any scheduled agenda item not considered prior to the adjournment of
the first regular monthly city commission meeting shall be perfunctorily
regarded as a continued item and scheduled on either: the next immediatc
rnonth's first regular city commission agenda. Any scheduled agenda item not
considered prior to the adjournment of the second regular monthly city
commission meeting shall be perfunctorily regarded as a continued item and
cchcdulcd on the ncxt immcdiatc month's second regular city commission
agenda.
(1) the City Commission agenda for the next like meeting; or
(2) an alternate meeting date and time designated by the City Commission.

Section 3. If any section, part of section, paragraph, clause, phrase or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty (30) days after final reading and
adoption thereof.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days
from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the effective date stated herein,
whichever is later.
