woman died. The
case was dropped

elderly abuse case in Monroe County. Charges are still
pending against the woman accused of operating the
two facilities in question.

against a Miami Beach
doctor police arrested in
2017 on counts of operating
two unlicensed elderly care
facilities in Monroe County
where detectives say pa-
tients were neglected and
one died malnourished and
suffering from severe bed-
soThis follows a lengthy
investigation that included
accusation, of neglect to all
sipatients living in the
two facilities, especially
regarding the patient who
ended up dying. Regla
Valdes, was an 85-yearold
woman who police say was
bleeding, covered in urine
and feces, as well as the
bedsores, when she was
brought to Mariners Hospi-
tal in Tavernier on Nov. 30,
2016.
Valdes died the next day
al Baptist Hospital in Ken-
dall. Mariner Hospital
staff caned the Florida
Department of Children
d Families after seeing
Valdes condition, end DCF
investigators contacted the
Monroe County Sheriff's
Office, launching the in-
vestigation.
Dr. Raul Tamayo, 68,
who detectives said in a
May 2017 probable cause
affidavit "ore lea and
maintained ' the facilities —
one in Key Largo and the
other in Plantation Key —
was rtested on elderly
neglect at his Miami Beach
home a month later and
held initially on a
$200,000 bond.
But Monroe County State
Attorney's Office prose -
tors said last week that
they never found that Ta-
mayo was anything but the
doctor whom the owner,
Amarilys Maristan, hired to
check up on her clients.
And prosecutors mid they
didn't have evidence to
prove he knew the facilities

They also said they did
not have enough evidence
to show he failed to provide
the care he told investiga-
tors he did and for which
he billed Medicare.
Charges against Tamayo
were dropped on Aug. 19.
"1t was a very difficult
decision to make. We put a
lot of time and effort into
this case," said Monroe
County State Attorney
Dennis Ward.
The U.S. Department of
Health and Human Serv-
es Office of Inspector
General also investigated
the facilities, as well as
accusations by the sheriff•
office that Tamayo was
billing Medicare for serv-
es he didn't provide. But
the federal investigators
findings didn't match those
found by the sheriffs of-
fice, Ward said.
"We didn't have
enough," he mid.
Regarding Valdes, prose-
cutor said the condition of
her skin was bad, but it
likely had been for a long
time, and there was no
indication it was that way
because of Tamayo a treat-
ment or lack thereof.
"We couldn't tie the
doctor to abuse," said As-

The Monroe County
medial examiner also

Jason Gatlin forced a
17-yearold girl into the tux
trade in Miami -Dade and
the Keys, took videos and
pictures of her having tux
to attract clients and then
bribed the victim to lie, a
federal jury decided Mon-
day.
After a two -week trial in
Fort Lauderdale federal
court, the jury convicted
Gatlin, 42, of Miami, on
eharges of tux trafficking
of a minor, production of
child pornography and
witness tampering.
He will be sentenced in
December.
Acriminal complaint
alleges Gatlin first met the
girl, whom the feds say he
knew was being sex traf-
ficked by others, in Octo-
bee 2018. They met at a
McDonald's in the Florida
Ken and Gatlin offered
her money to work for him,
court records show. He
convinced the gal he want-
ed to marry her.
But Investigator say that
over a two -month span, he
taught her how to post ads
of hermit to attract cus-
tomers. If she didn't give
him enough money
through prostitution, he
beat her, according to the
criminal complaint.
Gatlin also rented rooms
in the Keys for the teen to
meet her customers.
On Nov. 26, Gatlin took
her to a Motel 6 in Culler
Bay, where he rented a
room fora few nights so
Me could have sex with
customers who had re-
sponded to her online ad.
When Gatlin arrived on
the 28th, the minor said
she didn't have any money
for him. Gatlin hit her
across the face and drove
her to Monroe County,
where she had sex with
more customer, the com-
plaint says.
While in Monroe, Gatlin
beat her to the point of
unconsciousneas after she
Ihr atened to call the po-
lice on him if he didn't take
her back to Miami -Dade
County, records show.
Gatlin eventually relent-
ed and two days later, they
were tin the road back to
Miami -Dade, the com-
plaint says.
The teen asked hire to
let her use a bathroom at a
gas station. Once inside
the bathroom, she locked
herself in and called 911 on
Nov. 30. Monroe County
Sheriffs deputies found
her with "a swollen face,
and bloody, ripped
clothes," according to the
U.S. Attorney a Office.
Gatlin was arrested a few
days later in Miami -Dade.
While in jail, Gatlin
bribed the girl to tell in-
vestigators that she was
never trafficked. It was
Gatlin's mother who
housed the girl and drove
her to the defense attor-
ney's office for her to re-
cant her story, court re-
cords show.
"The government pre-
sented recorded evidence
al trial to prove the witness
tampering," Me U.S.At-
lomey's office wrote.
Gatlin is being held at a
federal detention center in
Miami. He could spend the
rest of his life in prison.

Monroe County Sheriff
Rick Ramsay said he stands
by his lead detective in the
case, but understands the
decision by the State At-
toeney's Office.
"The investigator in this
case encountered a sit-
uation he obviously be-
lieved was putting elderly
residents at risk and took
action to stop it. The bur-
den of proof the State At-
torney must meet is higher
than required for an ar-
rest," Ramsay mid in an
mail Tuesday. "I under-
stand
they feel they could
not meet that burden. I
respect their decision and
appreciate their continued
dMors in the co -defen-
ant's aggravated neglect
of an elderly person case,
which is still pending."
