WHEREAS, pursuant to Section 51 of the Charter of the City of Miami, Florida, as amended ("Charter"), and Chapter 11.5, Article II of the Code of the City of Miami, Florida, as amended ("City Code"), the Civilian Investigative Panel ("CIP") was created as an independent citizens' oversight panel with authority to conduct investigations and propose recommendations regarding allegations of misconduct by any sworn officer of the City of Miami's ("City") police department ("MPD"), make written recommendations related to MPD's policies and procedures, and subpoena witnesses and documents when conducting independent investigations of allegations of police misconduct; and WHEREAS, Section 11.5-35 of the City Code provides that the CIP shall be operated on an annual budget that shall be no less than one percent (1%) of the approved regular salaries and wages line item for the MPD's general fund budget except as otherwise required by the City Manager's declaration of a fiscal emergency, financial urgency, or financial emergency; and WHEREAS, the CIP reviewed and approved on July 16, 2019 its budget for Fiscal Year 2019-2020 in the total amount of $1,174,000.00, attached and incorporated as Composite Exhibit "A"; and WHEREAS, the CIP requests the approval by the Miami City Commission of its budget for the Fiscal Year commencing October 1, 2019 and ending September 30, 2020 in the total amount of $1,174,000.00, attached and incorporated as Composite Exhibit "A"; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The CIP's Fiscal Year 2019-2020 budget, attached and incorporated as Composite Exhibit "A," in the total amount of $1,174,000.00, for the Fiscal Year commencing October 1, 2019 and ending September 30, 2020, is approved and adopted. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.' APPROVED AS TO FORM AND CORRECTNESS: 1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
