HomeMy WebLinkAboutResolutionCity of Miami City Hall 3500 Pan American Drive Resolution Miami, FL 33133 www.miamigov.com Legislation File Number:6478Final Action Date:9/12/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY POLICE OFFICERS FROM WORKING ESTABLISHMENTS THAT HOLD A 4COP OR A 4COP SRX/SFS LICENSE, OR THIRD-PARTY ENTITIES RETAINED BY THE ESTABLISHMENT, ANY SUBCONTRACTORS, OR ANY OTHER ENTITY WORKING DIRECTLY OR INDIRECTLY ON BEHALF OF OR AT THE DIRECTION OF THE ESTABLISHMENT, BECAUSE THE CONDUCT OF THE OFFICERS, EMPLOYEES, EMPLOYERS OR CLIENTELE OF THE AL STATURE; FURTHER DIRECTING THE CITY MANAGER TO ENSURE THAT MPD OBSERVE AND ENFORCE ALL OF ITS DEPARTMENTAL ORDERS, REFLECTING THE SAME, SO THAT MPD COMPLIES WITH ITS MISSION, VISION, AND CORE VALUES. SPONSOR(S): Commissioner Joe Carollo procedures to provide a clear understanding of the constraints and expectations in the performance of their duties; and coordinating police services for special events and to allow employees to engage in extra duty employment, provided the activity has prior departmental approval; and or extra duty jobs shall be considered a privilege, not a right, to the employees of the Employees are prohibited from working bars. Employees will only be permitted to work establishments which are primarily restaurants, as defined by the City of Miami Code, and which have a valid Certificate of Use for restaurant, issued by the City of Miami. The area NET Commander will be responsible for verifying the requirements of this section; and WHEREAS, pursuant to D.O. 12, Chapter 1, Section 1.10.2 the Special Events unit reserves the right to cancel any extra duty job at any establishment where it deems that the conduct of officers, employees, employers or clientele in any manner detracts City of MiamiPage 1of 2File ID: 6478 (Revision: ) Printed On:4/22/2025 File ID: 6478Enactment Number: WHEREAS, MPD Police Officers have been working establishments, or third- party entities retained by the establishment, any subcontractors, or any other entity working directly or indirectly on behalf of or at the direction of the establishment, that hold a 4COP or a 4COP SRX/SFS license; and WHEREAS, the conduct of the officers, employees, employers or clientele of the establishment, or third-party entities retained by the establishment, any subcontractors, or any other entity working directly or indirectly on behalf of or at the direction of the NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The City Commission, in accordance with D.O. 12, Chapter 1, Section 1.10, directs the City Manager to prohibit MPD Police Officers from working establishments that hold a 4COP or a 4COP SRX/SFS license, or third-party entities retained by the establishment, any subcontractors, or any other entity working directly or indirectly on behalf of or at the direction of the establishment, because the conduct of the professional stature. Section 3. The City Commission directs the City Manager to ensure that MPD observe and enforce all of its D.O.s, reflecting the same, so that MPD complies with Section 4. This Resolution shall become effective immediately upon its adoption and 1 signature of the Mayor. APPROVED AS TO FORM AND CORRECTNESS: 1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
