City of Miami File ID: 6470 (Revision:) Printed On: 4/22/2025 City of Miami Legislation Ordinance File Number: 6470 Final Action Date: 9/12/2019 AN ORDINANCE OF THE MIAMI COMMISSION AMENDING CHAPTER 36 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "NOISE," MORE PARTICULARLY BY AMENDING ESTABLISHING A NEW SECTION 36-10, TITLED "MULTIPLE VIOLATIONS WITHIN A NINETY (90) DAY PERIOD," TO REQUIRE VIOLATORS WHO RECEIVE THREE (3) OR MORE VIOLATIONS OF THIS CHAPTER WITHIN A NINETY (90) DAY PERIOD TO AUTOMATICALLY BE REFERRED TO THE OFFICE OF THE CITY ATTORNEY FOR ANY AND ALL LEGAL ACTION AVAILABLE UNDER THE LAW WITHOUT THE NEED FOR FURTHER CITY COMMISSION ACTION; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, unnecessary, excessive, or unusually loud noise directly affects the quality of life of residents of the City of Miami, Florida, ("CITY"); and WHEREAS, many properties located in the City continuously violate the Code of the City of Miami, Florida, as amended ("City Code"), especially as it relates to noise; and WHEREAS, eliminating the requirement of City Commission approval for properties which have received three (3) or more violations of Chapter 36 of the City Code within a ninety (90) day period will allow the Office of the City Attorney to take quicker legal action which will deter future violations; and WHEREAS, the City Commission finds that it is in the best interest of the City and its residents to amend the City Code for the purposes stated herein; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and incorporated as if fully set forth in this Section. Section 2. Chapter 36 of the City Code is further amended in the following particulars: "CHAPTER 36 NOISE Sec. 36-10. Multiple Violations within 90-Day Period. 1 Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. City of Miami File ID: 6470 (Revision:) Printed On: 4/22/2025 Violators which have received three (3) or more violations of this Chapter of the City Code shall automatically be referred to the Office of the City Attorney. The Office of the City Attorney will review all matters and is hereby automatically authorized to seek any and all remedies allowed under the law against said violators without the need for further City Commission action. The provisions of this Section are not exclusive, and the remedies provided for in this Section shall be in addition to any other remedies provided for in any other law, available under common law, or otherwise. *„ Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective thirty (30) days after final reading and adoption thereof.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City Attor ey 8/3072019 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
