The Applicant is under contract with the City to purchase and redevelop the Property with an affordable housing community to be known as "The MLK Residences". A copy of the Purchase and Sale Agreement is enclosed as Exhibit "B" (the "PSA"). The PSA is predicated on the Applicant's commitment to develop affordable housing on the unified Property (post vacation of the Alley). The Property is being replatted pursuant to the "MLK Residences" Tentative Plat (#1928), which received unanimous approval at the Plat and Street Committee meeting on September 6, 2018 and Miami -Dade County Plat Committee on November 9, 2018, copies or which are attached as Exhibit "C". The purpose of the replat is to close and vacate the Alley bisecting the Property to accommodate the affordable housing community contemplated for the Property. From an operational perspective, there will not be any negative impacts on the public use of the Alley as a three-dimensional public ingress -egress easement is being proffered in the portion of the Alley to be vacated. Specifically, the Applicant is proffering a fifteen -foot (15') wide easement where the fifteen -foot (15') wide Alley currently exists, thereby maintaining the width of the vehicular travel area. A copy of the Tentative Plat is enclosed as Exhibit "D". Section 55-15(c) of the City's Code of Ordinances lists four (4) technical requirements that are analyzed by the City in connection with vacation and closure requests. In this instance, the Plat and Street Committee voted in favor 6-0 of approving the request to close and vacate the Alley. Below is an analysis of the technical requirements contained in Section 55-15(c) of the Code: I. Is it in the public interest, or would the general public benefit from the vacation of the right of way? Vacation and closure of the Alley would remove this portion of the Alley from the City's maintenance schedule, thereby removing a burden on City services and the 2 Greenberg Traurig, P.A. Is the general public no longer using the right of way, including public service vehicles, fire, or other emergency vehicles? The portion of the Alley being vacated will be replaced by a public ingress -egress easement, which will maintain the current level of access through the Property. The easement will maintain sixteen feet (16') of vertical clearance as required by the Fire Department to provide a clear path for emergency rescue vehicles. There will be no restriction on access within the proposed easement area and no negative impact on the general public. III. Would there be no adverse effect on the ability to provide police, fire, or emergency services? As noted above, a three-dimensional platted easement will replace the Alley. As such, there is no adverse effect on the ability to provide police, fire, or emergency services. Further, the Alley is surrounded by the property which faces three (3) separate rights -of -way with ample access for police, fire and emergency services: NW 62 Terrace, NW 15th Avenue, and NW 62"d Street. IV. Would the vacation and closure of the right of way have a beneficial effect on pedestrian and vehicular circulation in the area? Through the platting process, subdivision improvements will be made which will improve the vehicular circulation and the pedestrian realm along the public rights - of -way adjacent to the Property.
