HomeMy WebLinkAboutAgenda Item Summary FormAGENDA ITEM SUMMARY FORM File ID: #6060 Date: 06/25/2019 Commission Meeting Date: 07/25/2019 Requesting Department: Department of Procurement Sponsored By: District Impacted: All Type: Resolution Subject: Authorize - Buyboard National Purchasing Cooperative Interlocal Participation Agreement Purpose of Item: The nature of this item is to authorize a Resolution of the Miami City Commission, authorizing the accessing of various contracts via the existing BuyBoard National Purchasing Cooperative Organization ("BuyBoard"), effective through December 31, 2019 subject to any renewals, extensions, or replacement contracts by BuyBoard, to be utilized Citywide, on an as needed contractual basis, subject to the availability of funds and budgetary approval at the time of need; further acknowledging the cooperative procurement benefits of the BuyBoard that enables the City of Miami ("City") to aggregate its purchasing volume with that of other participating member public agencies, in order to realize a larger percentage discount pricing structure to the financial benefit of the residents of the City. Authorizing the City Manager to negotiate and execute all other documents, including any amendments, renewals, and extensions, subject to allocations, appropriations and budgetary approval having been previously made, and in compliance with applicable provisions of the Code of the City of Miami, Florida, as amended, ("City Code"), including, the City of Miami's procurement ordinance, anti -deficiency act, and financial integrity principles, all as set forth in chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Background of Item: BuyBoard offers member public agencies, free of charge, access to contracts which have been awarded via a competitive solicitation process conducted by a member public agency. BuyBoard assists member public agencies in reducing the costs of purchased goods and services by pooling the purchasing power of these public agencies nationwide. Membership in BuyBoard as well as the other Purchasing Cooperatives the City is a member, provide tools to streamline the Procurement process and enable the City access to larger discounts in order to reduce costs. WHEREAS, the BuyBoard National Purchasing Cooperative Organization ("BuyBoard"), offers member public agencies, free of charge, access to contracts which have been awarded via a competitive solicitation process conducted by a member public agency; and WHEREAS, BuyBoard assists member public agencies in reducing the costs of purchased goods by pooling the purchasing power of these public agencies nationwide; and WHEREAS, Section 18-113 of the Code of the City of Miami, Florida, as amended, entitled "Cooperative Purchasing," expressly allows the City's Procurement Department to participate in, sponsor, conduct, or administer cooperative purchasing agreements such as BuyBoard for the procurement of any goods and services, with other participating member public agencies; and WHEREAS, the adoption of this Resolution enables all City of Miami ("City") Departments to purchase goods and services, on an as needed contractual basis, utilizing all competitively solicited and awarded contracts available through BuyBoard, subject to the availability of funds and budgetary approval at the time of need; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained In the Preamble to this Resolution are adopted by reference and Incorporated as if fully set forth in this Section. Section 2. The cooperative procurement benefits of BuyBoard, that enable the City to aggregate its purchasing volume with that of other participating member public agencies in order to realize a larger percentage discount pricing structure to the financial benefit of the residents of the City are acknowledged. Section 3. The use of all competitively solicited and awarded contracts available through BuyBoard, subject to any renewals, extensions, or replacement contracts by the BuyBoard, to be utilized on an as -needed contractual basis, subject to the availability of funds and budgetary approval at the time of need, are authorized.' Section 4. The City Manager is authorized to negotiate and execute all other documents, including any amendments, renewals, and extensions, subject to allocations, appropriations and budgetary approval having been previously made, and in compliance with applicable provisions of the Code of the City of Miami, Florida, as amended ("City Code"), including the City's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in compliance with applicable regulations, as may be necessary for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, ity Attor ey 7/11/2019 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2 This Resolution shall become effective as specified herein unless vetoed by Mayor with ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
