Subject: Allocate Funds - Psychological & Counseling Associates, Inc.
Purpose of Item:
The nature of this item is to authorize a Resolution of the Miami City Commission with
attachments, accepting the proposal received December 12, 2018, pursuant to Request
for Proposals ("RFP") No. 610384, for the provision of Psychological Screening
Services, from Law Enforcement Psychological & Counseling Associates, Inc.
("LEPCA") for the Miami Police Department ("Police") for an initial period of five (5)
years, with an option to renew for one additional five (5) year period. Authorizing the
City Manager to execute the negotiated Professional Services Agreement ("PSA"), in
substantially the attached form; further authorizing the City Manager to negotiate and
execute all other documents, including any amendments, renewals, and extensions,
subject to allocations, appropriations and budgetary approval having been previously
made, and in compliance with applicable provisions of the Code of the City of Miami,
Florida, as amended ("City Code"), including, the City of Miami's Procurement
Ordinance, Anti -Deficiency Act, and Financial Integrity Principles, all as set forth in
Chapter 18 of the City Code, in a form acceptable to the City Attorney, and in
compliance with applicable regulations, as may be necessary for said purpose.
Background of Item:
On November 7, 2018, the Department of Procurement issued RFP 610384 under full
and open competition, to obtain proposals from experienced and qualified firms for the
provision of Psychological Screening Services, for Police. Proposers were required to
meet all of the minimum qualification requirements established within the RFP in order
to be deemed responsive and responsible to provide said services. On December 12,
2018, the Office of the City Clerk received one (1) proposal in response to the RFP. The
Evaluation Committee ("Committee"), appointed by the City Manager, evaluated the
sole Proposal following the guidelines set forth within the RFP. LEPCA received a score
of 498, out of a total combined (Technical and Price) score of 500.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ACCEPTING THE PROPOSAL RECEIVED DECEMBER 12, 2018, PURSUANT TO
REQUEST FOR PROPOSALS ("RFP") NO. 610384, FROM LAW ENFORCEMENT
PSYCHOLOGICAL & COUNSELING ASSOCIATES, INC. ("LEPCA"), FOR THE MIAMI
POLICE DEPARTMENT ("MPD"), FOR AN INITIAL PERIOD OF FIVE (5) YEARS,
WITH AN OPTION TO RENEW FOR ONE (1) ADDITIONAL FIVE (5) YEAR PERIOD,
ON AN AS -NEEDED CONTRACTUAL BASIS; ALLOCATING FUNDS FROM VARIOUS
SOURCES OF FUNDS FROM THE USER DEPARTMENT, SUBJECT TO THE
AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED;
AUTHORIZING THE CITY MANAGER TO EXECUTE THE NEGOTIATED
PROFESSIONAL SERVICES AGREEMENT ("PSA"), IN SUBSTANTIALLY THE
ATTACHED FORM; FURTHER AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ALL OTHER DOCUMENTS, INCLUDING ANY
AMENDMENTS, RENEWALS, AND EXTENSIONS, SUBJECT TO ALLOCATIONS,
APPROPRIATIONS, AND BUDGETARY APPROVAL HAVING BEEN PREVIOUSLY
MADE, AND IN COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), INCLUDING THE
CITY OF MIAMI'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND
FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE
CITY CODE, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, AND IN
COMPLIANCE WITH APPLICABLE REGULATIONS, AS MAY BE NECESSARY FOR
SAID PURPOSE.
WHEREAS, the Miami Police Department ("MPD") has a need for pre -employment
psychological evaluation, and psychological counseling service; and
WHEREAS, on November 7, 2018, the Department of Procurement ("Procurement")
issued Request for Proposals ("RFP") No. 610384 to obtain proposals from experienced and
qualified firms for the provision of Psychological Screening Services; and
WHEREAS, on December 12, 2018, the Office of the City Clerk received One (1)
proposal in response to the RFP, which was deemed responsive and responsible; and
WHEREAS, on February 25, 2019, the Evaluation Committee ("Committee") appointed
by the City Manager convened to discuss and evaluate the proposal, following the guidelines
established within the RFP, Law Enforcement Psychological & Counseling Associates, Inc.
("LEPCA") received a score of 498, out of a total combined Technical and Price score of 500; and
WHEREAS, on March 5, 2019, the City Manager concurred with the recommendation of
the Committee and authorized Procurement to enter into negotiations for a PSA for the provision
of psychological screening services; and
WHEREAS, Procurement and a designated negotiating team have successfully
completed negotiations with LEPCA, and have recommended to the City Manager the execution
of a PSA with LEPCA;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Proposal received December 12, 2019, pursuant to RFP 610384 from
LEPCA, for the provision of Psychological Screening Services for an initial period of five (5) years,
with an option to renew for one (1) additional five (5) year period, on an as -needed contractual
basis, is accepted.
Section 3. Funds to be allocated from various sources of funds from the user
department, subject to the availability of funds and budgetary approval at the time of need.
Section 4. The City Manager is authorized1 to execute the negotiated PSA in
substantially the attached form.
Section 5. The City Manager is further authorized to negotiate and execute all other
documents, including any amendments, renewals, and extensions, subject to allocations,
appropriations, and budgetary approval having been previously made, and in compliance with
applicable provisions of the Code of the City of Miami, Florida, as amended ("City Code"),
including the City of Miami's Procurement Ordinance, Anti -Deficiency Act, and Financial Integrity
Principles, all as set forth in Chapter 18 of the City Code, in a form acceptable to the City
Attorney, and in compliance with applicable regulations, as may be necessary for said purpose.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
2 This Resolution shall become effective as specified herein unless vetoed by the Mayor does within (10)
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
