HomeMy WebLinkAboutPZAB (5512) ResolutionCity of Miami PZAB Resolution Enactment Number: PZAB-R-19-011 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File ID: 5512 Final Action Date: 3/6/2019 A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD ("PZAB") RECOMMENDING APPROVAL TO THE MIAMI CITY COMMISSION OF AN ORDINANCE AMENDING ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, MORE SPECIFICALLY BY AMENDING ARTICLE 4, "TABLE 4: DENSITY, INTENSITY AND PARKING" TO REDUCE THE REQUIRED PARKING FOR RECREATIONAL FACILITIES; MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 22, 2009, the City Commission adopted Ordinance No. 13114, the Zoning Ordinance of the City of Miami, as amended ("Miami 21 Code"); and WHEREAS, Section 7.1.2.8 of the Miami 21 Code provides that all amendments, including rezoning, shall maintain the goals of the Miami 21 Code to preserve neighborhood and provide transitions in intensity, density, building height, and scale; and WHEREAS, it has been determined that modifications to the Miami 21 Code, Article 4 are required to further advance the intent of the Miami 21 regulations by reducing the parking requirement for certain Civic Uses; and WHEREAS, consideration has been given as to whether the proposed changes will further the goals, objectives and policies of the Miami Comprehensive Neighborhood Plan ("MCNP"), the Miami 21 Code, and other City regulations; and WHEREAS, the proposed amendments will allow the development of new open space opportunities throughout the City of Miami; and WHEREAS the proposed amendments allow the City to provide additional green spaces at a neighborhood scale, improving the quality of neighborhoods throughout the city; and WHEREAS, consideration has been given to the need and justification for the proposed change, including changed or changing conditions that make the passage of the proposed change necessary; and WHEREAS, Planning, Zoning, and Appeals Board ("PZAB") has considered whether the proposed amendment will further the goals, objectives, and policies of the Miami Comprehensive Plan, the Miami 21 Code, and other City regulations. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The PZAB recommends that the Miami 21 Code be further amended by amending Article 4, Table 4: Density, Intensity and Parking in the following particulars: ARTICLE 4. Civic Uses are permissible as listed in Table 3. • Minimum of 1 parking space for every 5 seats of assembly use. • Minimum of 1 parking space for every 4;000 5,000 square feet of exhibition or recreation area, and parking spaces for other Uses as required. • Parking requirement may be reduced according to the Shared parking standard, Article 4, Table 5. • Minimum of 1 Bicycle Rack Space for every 20 vehicular spaces required. 10,000 square feet of exhibition or recreation area. • Except for sites within 500 feet of an ungated T3 Transect Zone, the parking ratio may be reduced within a TOD area or within a Transit Corridor area by up to thirty percent (30%) by process of Waiver; by up to fifty percent (50%) by process of Waiver and payment into a transit enhancement Trust Fund, as established by Chapter 35 of the City Code; or by one hundred percent (100%) for any Structure with a Floor Area of ten thousand (10,000) square feet or less. • Parking for civic uses may be provided off -site within a distance of 1,000 feet. Civic Uses are permissible as listed in Table 3. • Minimum of 1 parking space for every 5 seats of assembly use. • Minimum of 1 parking space for every 47000 5,000 square feet of exhibition or recreation area, and parking spaces for other Uses as required. • Parking requirement may be reduced according to the Shared parking standard, Article 4, Table 5. • Minimum of 1 Bicycle Rack Space for every 20 vehicular cpacos required. 10,000 square feet of exhibition or recreation area. • Except for sites within 500 feet of an ungated T3 Transect Zone, the parking ratio may be reduced within a TOD area or within a Transit Corridor area by up to thirty percent (30%) by process of Waiver; by up to fifty percent (50%) by process of Waiver and payment into a transit enhancement Trust Fund, as established by Chapter 35 of the City Code; or by one hundred percent (100%) for any Structure with a Floor Area of ten thousand (10,000) square feet or less. • Parking for civic uses may be provided off -site within a distance of 1,000 feet.
