HomeMy WebLinkAboutR-19-0287City of Miami Resolution R-19-0287 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 6174 Final Action Date: 7/11/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION ESTABLISHING THE MIAMI COMPLETE COUNT COMMITTEE PURSUANT TO CHAPTER 2, ARTICLE XI, DIVISION 2, SECTION 2-883 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TO ADVOCATE AND ADVISE ON MATTERS RELATED TO THE UNITED STATES 2020 CENSUS; STATING THE COMMITTEE'S PURPOSE, POWERS, DUTIES, MEMBERSHIP, COMPOSITION, QUALIFICATIONS, PROVIDING FOR OFFICERS, MEETINGS, QUORUM, ASSIGNMENT OF LEGAL AND STAFF SUPPORT, PUBLIC NOTICE REQUIREMENTS, AND SUNSET PROVISION; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. SPONSOR(S): Mayor Francis X. Suarez WHEREAS, Article 1, Section 2 of the United States ("U.S.") Constitution mandates an enumeration of population every ten (10) years; and WHEREAS, the next decennial census of the U.S. population will be taken on April 1, 2020; and WHEREAS, census data helps determine how many seats each state will have in the U.S. House of Representatives and is necessary for an accurate and fair districting of state legislative seats, county and city councils, and voting districts; and WHEREAS, information compiled for the 2020 census will be tools utilized for economic development, increased employment, funding allocations, and other matters of national and local importance; and WHEREAS, the census count requires extensive work and the U.S. Census Bureau requires partners at state and local levels to ensure a complete and accurate count; and WHEREAS, typically, areas with lower -income families, immigrants, and non-traditional housing are difficult to accurately capture in the census count; and WHEREAS, it is vitally important that every person, including infants, children, and adults living in the City of Miami ("City") be counted in the 2020 census; and WHEREAS, the City wishes to establish the Miami Complete Count Committee ("Committee") to advocate and advise ways to implement awareness campaigns and encourage participation of the population to respond to the 2020 census; and WHEREAS, all recommendations of the Committee shall be presented to the City Commission for final approval and action; City of Miami Page 1 of 4 File ID: 6174 (Revision:) Printed On: 4/21/2025 File ID: 6174 Enactment Number: R-19-0287 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and finding contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Committee is hereby established. Section 3. Purpose, Powers, and Duties. The purpose, powers, and duties of the Committee are to: a. Compose a comprehensive assessment of individuals likely to be uncounted within the City; b. Identify and recommend resources which can be utilized to assist in outreach of the undercounted populations; c. Identify and recommend potential strategies to collaborate with Miami -Dade County and the State of Florida to ensure that the City is not undercounted; d. Compile information and develop a comprehensive 2020 census action plan ("Plan"), which shall include community -based and other strategies to ensure an accurate count of the City's population; e. Submit the Plan to the City Commission within ninety (90) days of the Committee's initial meeting. Should the Committee need additional time to finalize the Plan, the Committee may request an extension from the City Commission upon advising the City Commission of the current status of the Plan. Section 4. Membership: Composition, Appointment, Qualifications, Minimum Attendance Requirement, Removal, Appointment to Fill Vacancies, and Waiver. a. Composition, Appointment, and Qualifications. The Committee shall consist of seven (7) regular voting members. All members shall be permanent residents of the City and shall have good reputations for integrity and community service. All members will serve without compensation. In addition, the Committee shall reflect the diversity of the City. All members should have an interest in, or experience relating to, community organizations, faith -based organizations, education institutions, nonprofit organizations, or the business community with an emphasis on outreach to the City's undercounted census population. All members shall be subject to the provisions set forth in Section 2-884 of the City Code. Members shall be appointed as follows: 1. Mayor will nominate one (1) member; 2. Each of the five (5) District Commissioners shall nominate one (1) member for a total of five (5) members; and 3. City Manager will nominate one (1) member. 4. No alternate members shall be appointed. Minimum Attendance Requirements and Removal. It is expected that all appointed members of the Committee attend each meeting. Attendance requirements and removal therefrom shall be pursuant to Section 2-886 of the City Code. c. Vacancies. Vacancies of the Committee shall be filled pursuant to Section 2-885(a)(3) of the City Code. At the initial meeting, the members of the Committee shall select and designate a Chairperson and Vice -Chairperson from among the members present. Section 6. Meetings and Quorum. All meetings of the Committee shall be noticed and open to the public. The public shall be encouraged to submit oral or written comments to the Committee. A minimum of fifty percent (50%) plus one (1) of the Committee shall constitute quorum for the purpose of convening any meeting. An affirmative vote of not less than fifty percent (50%) plus one (1) of the members present and voting at any meeting is required for any action to be taken by the members. The initial meeting shall commence within thirty (30) days after a majority of the members of the Committee have been appointed. Section 7. Rules of Procedures. The Committee may adopt its own order of business and rules of procedure governing its meetings and take actions on matters within its jurisdiction not inconsistent with the provisions set forth herein, which rules of procedure shall be filed with the City Clerk. The Committee and any executive committee or subcommittee, if applicable, shall comply with all requirements of Chapters 119 (Public Records) and 286 (Sunshine Law) of the Florida Statues. The minutes of each meeting shall be promptly made available and such records shall be open to public inspection. Copies of minutes of all the Committee meetings shall be furnished to the Mayor, City Commission, City Attorney, and City Manager. Section 8. Legal Counsel. The City Attorney shall serve as legal counsel to the Committee and shall provide legal advice on all matters considered by the Committee. The City Attorney or designee shall provide legal support to the Committee and attend Committee meetings accordingly. Section 9. Assignment of Staff. The City Manager shall provide full cooperation and sufficient personnel for necessary administrative support to the Committee including assignment of an individual to act as liaison and secretary to the Committee as well as the assignment of individuals from any and all City Departments and Offices, as may be necessary, to advise the Committee about ongoing and pending projects. It shall be the duty of Committee's liaison to keep minutes or cause said minutes to be taken at all meetings, maintain Committee correspondence, post meeting notices with the City Clerk, file reports, and perform all other necessary support functions. The City Manager, or designee, may participate in deliberations of the Committee, as needed, and may give technical and policy advice to the Committee as requested. Notwithstanding the above, a NET Administrator shall attend all Committee meetings unless excused in writing from attendance from the Committee. Section 10. Sunset. The Committee shall automatically sunset and stand dissolved thirty (30) days after the 2020 Census is presented to the United States Congress, unless the City Commission approves an extension of this Committee as set forth herein. Section 11. This Resolution shall become effective immediately upon its adoption and signature of the Mayor. 1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
