HomeMy WebLinkAboutR-19-0279City of Miami Resolution R-19-0279 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 6156 Final Action Date: 7/11/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), BY A FOUR FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDINGS, ATTACHED AND INCORPORATED AS EXHIBIT "A," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY"); WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF GRANT FUNDS FROM THE DISTRICT 1 COMMISSIONER'S SHARE OF THE CITY OF MIAMI'S ("CITY") ANTI- POVERTY INITIATIVE ("API"), IN A TOTAL AMOUNT NOT TO EXCEED NINETY-TWO THOUSAND, SEVEN HUNDRED TWO DOLLARS ($92,702.00) TO LITTLE HAVANA ACTIVITIES & NUTRITION CENTERS OF DADE COUNTY, INC., A FLORIDA NOT FOR PROFIT CORPORATION ("LITTLE HAVANA ACTIVITIES CENTER"), IN SUPPORT OF ITS MEALS PROGRAM FOR SENIORS AT ANTONIO MACEO PARK; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS NECESSARY, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Commissioner Wifredo (Willy) Gort WHEREAS, the City of Miami ("City") created the Anti -Poverty Initiative ("API") to address poverty based on a strategy of focusing the provision of support towards the City's residents achieving self-sufficiency; and WHEREAS, Little Havana Activities & Nutrition Centers of Dade County, Inc., a Florida not for profit corporation ("Little Havana Activities Center"), is seeking funding in support of the meals program for Seniors at Antonio Maceo Park ("Program"); and WHEREAS, the City's District One Commissioner ("Commissioner") wishes to provide grant funds from the Commissioner's share of the City's API in an amount not to exceed Ninety - Two Thousand, Seven Hundred Two Dollars ($92,702.00) ("Funds") for the Program; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has made a written finding, attached and incorporated as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds for the Program; and WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute any and all documents necessary, all in a form acceptable to the City Attorney, for said allocation of Funds for the Program; City of Miami Page 1 of 2 File ID: 6156 (Revision:) Printed On: 4/21/2025 File ID: 6156 Enactment Number: R-19-0279 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the City Code, by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written findings, attached and incorporated as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds for the Program, and waiving the requirements for said procedures are hereby ratified, approved, and confirmed. Section 3. The City Manager is authorized' to allocate Funds from the Commissioner's share of the City's API to Little Havana Activities Center, in an amount not to exceed Ninety - Two Thousand, Seven Hundred Two Dollars ($92,702.00) for the Program. Section 4. The City Manager is further authorized' to negotiate and execute any and all documents necessary, all in a form acceptable to the City Attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City Attor ey ) 7/1/2019 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
