HomeMy WebLinkAboutR-19-0278City of Miami Resolution R-19-0278 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 6040 Final Action Date: 7/11/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE CITY OF MIAMI'S ("CITY") FIVE-YEAR CONSOLIDATED PLAN, THE CITIZEN PARTICIPATION PLAN FOR FISCAL YEARS 2019-2023, AND THE ANNUAL ACTION PLAN FOR FISCAL YEAR 2019-2020, ATTACHED AND INCORPORATED (COLLECTIVELY, "PLANS"); AUTHORIZING THE CITY MANAGER TO SUBMIT THE PLANS TO THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT, FOR REVIEW AND APPROVAL; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS, INCLUDING AMENDMENTS, EXTENSIONS, AND MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AS MAY BE NECESSARY FOR SAID PURPOSE, SUBJECT TO ALL FEDERAL, STATE, AND LOCAL LAWS THAT REGULATE SUCH DOCUMENTS. WHEREAS, pursuant to the Code of Federal Regulations, 24 CFR 91.220, all entitlement jurisdictions are required to submit a Five -Year Consolidated Plan ("Consolidated Plan") and an Annual Action Plan ("AAP") to the United States Department of Housing and Urban Development ("HUD") for the purpose of carrying out its long-term strategic plan; and WHEREAS, the Consolidated Plan sets forth the overall goals and objectives of the City of Miami ("City") as it relates to the following entitlement grants: Community Development Block Grant ("CDBG"), Home Investment Partnerships Program ("HOME"), Emergency Solutions Grants ("ESG"), and Housing Opportunities for Persons with AIDS ("HOPWA"); and WHEREAS, the AAP sets forth the overall goals and objectives of the City's Consolidated Plan to be undertaken in Fiscal Year ("FY") 2019-2020; and WHEREAS, the AAP must be submitted to the local HUD field office at least forty-five (45) days before the beginning of the FY, which is August 15, 2019; and WHEREAS, the Citizen Participation Plan ("CPP") provides a guide for City residents to participate in planning, implementing, and assessing City programs funded by HUD under the CDBG, HOME, ESG, and HOPWA federal entitlement grants and it meets the requirements of HUD as outlined in 24 CFR Part 91.100 and CFR Part 91.105; and WHEREAS, the City's Administration recommends the approval of the City's Consolidated Plan, the CPP for FY 2019-2023, and the AAP for FY 2019-2020, attached and incorporated, and requests authorization to submit them to HUD for review and approval; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File ID: 6040 (Revision:) Printed On: 4/18/2025 File ID: 6040 Enactment Number: R-19-0278 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City's Consolidated Plan, the CPP for FY 2019-2023, and the AAP for FY 2019-2020, attached and incorporated, are approved. Section 3. The City Manager is authorized' to submit the City's Consolidated Plan, the CPP for FY 2019-2023, and the AAP for FY 2019-2020 to HUD for review and approval. Section 4. The City Manager is authorized' to negotiate and execute any and all necessary documents, including amendments, extensions, and modifications, all in forms acceptable to the City Attorney, as may be necessary for said purpose, subject to all federal, state, and local laws that regulate such documents. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: ndez, City Attor ey 6/27/2019 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
