Please refer to Articles 3.9 of the Miami Code for Special Area Plans information.
1. Project name: Magic City Innovation District SAP
2. Applicant(s): MCD Miami, LLC and its affiliate Co -Applicants listed on Exhibit 1 hereto.
3. Subject property address(es) and folio number(s): See attached Exhibit 1 hereto.
4. One (1) original survey dated within six (6) months from the date of application prepared by a State
of Florida registered land surveyor.
5. One (1) original 24x36" plan, signed and sealed by a State of Florida registered architect or
engineer showing property boundaries and proposed structure(s), parking, landscaping, etc.;
building elevations and dimensions and computations of lot area and building spacing.
6. After Hearing Boards, Public Works, Zoning and Planning initial and date the plans, 11x17" copies
of the original plan, including the survey, to be incorporated in the Special Area Plan binders.
7. After final City Commission approval, submittal of all documents in "InDesign" software.
8. Current Zoning Referral and Write -Up signed by the Office of Zoning designee.
9. A clear and legible copy of the recorded warranty deed and tax forms of the most current year
showing the present owner(s) and legal description of the property to match the legal description on
the survey.
10. A clear and legible copy of the subject property address(es) and legal description(s) on a separate
sheet, labeled as "Exhibit A", to match with the current survey's legal description.
11. At least two photographs showing the entire property showing land and improvements.
12. Copy of the lobbyist registration processed by the Office of the City Clerk, if applicable.
13. Affidavit of Authority to Act and the Disclosure of Ownership of all owner —and contract purchasers,
if applicable —of the subject property.
14. For all corporations and partnerships indicated:
a) Articles of Incorporation;
b) Certificate from Tallahassee showing good standing, less than one (1) year old;
c) Corporate Resolution or a Power of Attorney signed by the secretary of the Corporation
authorizing the person who signed the application to do so;
d) Non-profit organizations: A list of Board of Directors less than one (1) year old.
15. Certified list of owners of real estate within 500 feet of the subject property.
16. Original Disclosure of Consideration Provided or Committed for Agreement to Support or Withhold
Objection Affidavit.
17. Original Public School Concurrency Management System Entered Requirements form.
18. The subject property(ies) cannot have any open code enforcement/lien violations.

ACKNOWL.EDGEMENT BY APPLICANT
The Public Works Department, Transportation, CRC and other City and County agencies review
and critique zoning hearing applications which may affect the scheduling and outcome of my
hearing. These reviews may require additional hearings before PZAB, HEPB, UDRB, or other
City and County boards, which may result in the modification of plans, studies and/or the
proffering of agreements to be recorded. Submission and acceptance of application does not
necessarily meant that application is ready to be scheduled for public hearing. I am also aware
that I must comply promptly with any City or County conditions and advise this office in writing if
my application will be withdrawn.
2. Filing fees may not be the total cost of a hearing. Some requests require notices to be mailed to
property owners up to a mile from the subject property and I am responsible for paying the
additional radius mailing costs. In addition to mailing costs, I am responsible for additional fees
related to application changes, plan revisions, deferrals, re -advertising, etc., that may be
incurred. I understand that fees must be paid promptly. Applications withdrawn within 60 days
of the filing are eligible for a refund of 50% of the hearing fee. Hearing applications withdrawn or
returned after 60 days of filing will be ineligible for a refund. Refunds must be requested in
writing.
3. Applicable Florida Building Code requirements may affect my ability to obtain a building permit
even if my zoning application is approved; and a building permit will probably be required. I am
responsible for obtaining any required permits and inspections for all structures and additions
proposed, or built without permits. And a Certificate of Use (C.U.) must be obtained for the use
of the property after it has been approved at a Zoning Hearing. Failure to obtain the required
permits and/or C.U., Certificates of Completion (C.C.) or Certificate of Occupancy (C.O.) will
result in enforcement action against any occupant and owner. Submittal of the Zoning Hearing
application may not forestall enforcement action against the property.
4. The 3rd District Court of Appeal has ruled that zoning applications inconsistent with the Miami
Comprehensive Neighborhood Plan (MCNP) should not be approved by the Planning Zoning
and Appeals board or City Commission and the recommendation will be for denial or deferral.
Therefore, I acknowledge that if the hearing request is inconsistent with the MCNP and I decide
to go forward then my hearing request can only be denied or deferred, but not approved. I also
understand that I will not be reimbursed any fees paid unless I withdraw within 60 days of filing
and then I will receive a 50% refund.
5. Any covenant to be proffered must be submitted in word document format to the Office of the
City Attorney at least two (2) months prior to the hearing date. The covenant will be reviewed
and the applicant will be notified if changes or corrections are necessary. Once the covenant
receives a recommendation of approval as to legal format, the applicant is responsible to submit
the signed covenant with a current `Opinion of Title' within 2 weeks of the hearing. The Office of
the City Attorney can advise as to additional requirements applicable to foreign corporations.
Documents submitted to must carry a cover letter indicating subject matter, application number
and heariate. The Office of the City Attorney may be reached at (305) 416-1400.
