PURPOSE: This will change the zoning designation of the above properties from "T4-R"
General Urban Transect-Restricted Zone to "T5-O" Urban Center Transect -Open Zone.

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING THE
ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY
CHANGING THE ZONING CLASSIFICATION FROM "T4-R," GENERAL
URBAN TRANSECT-RESTRICTED, TO "T5-O," URBAN CENTER
TRANSECT-OPEN, FOR THE PROPERTIES LOCATED AT
APPROXIMATELY 1415 NORTHWEST 63 STREET AND 1200
NORTHWEST 62 LANE, MIAMI, FLORIDA, AS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED;
MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") at its meeting on
December 19, 2018, following an advertised public hearing, adopted Resolution No. PZAB-R-
18-065 by a vote of nine to zero (9-0), Item No. PZAB.5, recommending approval of the change
of zoning classification as stated herein; and
WHEREAS, Miami -Dade County ("Applicant") owns the properties located at
approximately 1415 Northwest 63 Street and 1200 Northwest 62 Lane, Miami, Florida
("Properties"); and
WHEREAS, the Properties comprise all the land upon which the Liberty Square
Affordable Housing Development ("Liberty Square") was built in 1937; and
WHEREAS, the Properties are currently designated "T4-R," General Urban Transect—
Restricted, which allows residential uses but not commercial uses; and
WHEREAS, the original Liberty Square contained over seven hundred (700) dwelling
units and the Applicant has proposed a redevelopment plan to demolish and construct a greater
number of units, to provide new housing to existing residents currently living in Liberty Square,
and to provide new housing options to future tenants; and
WHEREAS, the Applicant proposes rezoning approximately 6.27± acres of the property
located at 1415 Northwest 63 Street, Miami, Florida and 17.6 ± acres of the property located at
1200 Northwest 62 Lane, Miami, Florida, from "T4-R," General Urban Transect-Restricted, to
"T5-O," Urban Center Transect-Open, to allow the inclusion of some retail and commercial uses
as part of the redevelopment to fill the need in the area; and
WHEREAS, the "T5-O," Urban Center Transect-Open, would allow commercial and retail
uses that are currently prohibited within the "T4-R," General Urban Transect-Restricted; and
WHEREAS, the Applicant's proposal to change the zoning classification of the
Properties from "T4-R," General Urban Transect Zone —Restricted, to "T5-O," Urban Center
Transect—Oren, is in harmony with the established land use pattern and the adiacent districts;

and
WHEREAS, the portions of the Properties not subject to the change of zoning
classification request will maintain the "T4-R," General Urban Transect-Restricted, designation,
buffering and creating transition to the abutting "T3-L," Sub -Urban Transect-Limited, located to
the north; and
WHEREAS, the properties located on the south of Northwest 62 Street ("Martin Luther
King Boulevard") are designated "T5-O," Urban Center Transect-Open; and
WHEREAS, the change of zoning classification from "T4-R," General Urban Transect-
Restricted, to "T5-O," Urban Center Transect-Open, of the properties located on the north of
Martin Luther King Boulevard will confirm the medium and high residential density and mixed -
use character and scale of the corridor; and
WHEREAS, the change of zoning classification creates transition, decreasing in Density
and Intensity to the north, east, south, and west; and
WHEREAS, the change in zoning classification from "T4-R," General Urban Transect-
Restricted, to "T5-O," Urban Center Transect-Open, allows the redevelopment of portions of
Liberty Square in such a way as to enliven the street environment and increase the availability
of affordable housing; and
WHEREAS, the change of zoning classification is consistent with the needs of the
neighborhood and the City of Miami ("City"); and
WHEREAS, the change of zoning classification from "T4-R," General Urban Transect-
Restricted, to "T5-O," Urban Center Transect-Open, will contribute to the improvement of
development of other properties in the adjacent area in accordance with existing regulations;
and
WHEREAS, the change of zoning classification from "T4-R," General Urban Transect-
Restricted, to "T5-O," Urban Center Transect-Open, will result in the allowance of uses which
are expected to improve the quality of life of the Liberty Square residents as well as the
surrounding neighborhoods; and
WHEREAS, the City Commission, after careful consideration of this matter, deems it in
the best interest of the general welfare of the City and its inhabitants to grant this change of
zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission approves the amendment of the Zoning Atlas of
Ordinance No. 13114, as amended, by changing the zoning classification of the Properties from
"T4-R," General Urban Transect—Restricted, to "T5-O," Urban Center Transect—Open.
Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty-one (31) days after second
reading and adoption thereof pursuant and subject to Section 163.3184(12), Florida Statutes,

1 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein. whichever is later.
