A RESOLUTION OF THE MIAMI PLANNING, ZONING AND APPEALS BOARD,
WITH ATTACHMENTS, RECOMMENDING APPROVAL OF AN ORDINANCE OF THE
MIAMI CITY COMMISSION AMENDING THE ZONING ATLAS OF ORDINANCE NO.
13114, AS AMENDED, BY CHANGING THE ZONING CLASSIFICATION FROM "T4-
R" GENERAL URBAN TRANSECT - RESTRICTED TO "T5-O" URBAN CENTER
TRANSECT - OPEN OF THE PROPERTY LOCATED AT 1415 NORTHWEST 63
STREET, MIAMI, FLORIDA, MORE PARTICULARLY DESCRIBED IN EXHIBIT "A";
MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, the Miami -Dade County (the "Applicant") owns the property located at
approximately 1415 Northwest 63 Street, Miami, Florida (the "Property"); and
WHEREAS, the Property represents approximately 17.6 acres of 66.65 acres that
encompasses Liberty Square, an affordable housing development built in 1937; and
WHEREAS, the zoning designation of the Property is T4-R "General Urban Transect —
Restricted" which only allows residential uses by right; and
WHEREAS, the original Liberty Square, contained over 700 dwelling units and the
Applicant has proposed a redevelopment plan to demolish and construct a greater number of
units, and to provide new housing to existing residents currently living in Liberty Square and
new housing options to future tenants; and
WHEREAS, the Applicant proposes rezoning approximately 4.73 acres of the property
from T4-R to T-50 to allow the inclusion of some retail and commercial uses as part of the
redevelopment to fill the need in this area; and
WHEREAS, the "T5-O" Transect Zone would allow commercial and retail uses that are
currently prohibited within the "T4-R" Transect Zone; and
WHEREAS, the Applicant proposes to change the zoning designation of the properties
designated "T4-R" General Urban Transect Zone — Restricted to "T5-O" Urban Center Transect
Zone — Open, is in harmony with the established land use pattern and the adjacent districts; and
WHEREAS, the rezone from T4-R to T5-O allows the redevelopment of portions of
Liberty Square in such a way as to enliven the street environment and increase the availability
of affordable housing; and
WHEREAS, the proposed change of zoning from T4-R to T5-O is consistent with the
scale of the neighborhood, the needs of the neighborhood and the City of Miami ("City"); and

WHEREAS, the change of zoning from T4-R to T5-O responds to the requirement of the
proposed project to allocate more density and intensity to the south portion of the project
recognizing the Martin Luther King corridor represented by NW 62 Street, where additional T5-O
zoning designation is located; and
WHEREAS, the change of zoning from T4-R to T5-O will contribute to the improvement
of development of properties in the adjacent area in accordance with existing regulations; and
WHEREAS, the change of zoning from T4-R to T5-O will result in the allowance of uses
which are expected to improve the quality of life of the Liberty Square residents as well as the
surrounding neighborhoods; and
WHEREAS, the Planning, Zoning and Appeals Board, after careful consideration of this
matter, deems it advisable and in the best interest of the general welfare of the City and its
inhabitants to grant / deny this zoning change as hereinafter set forth; and
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING, ZONING AND APPEALS
BOARD OF THE CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The PZAB recommends that the City Commission approve the
amendment of the Zoning Atlas of Ordinance No. 13114, as amended, by changing the zoning
classification of the property located at approximately 1415 Northwest 63 Street designated "T4-
R" General Urban Transect — Restricted to "T5-O" Urban Center Transect — Open.
Section 3. This Resolution shall become effective upon adoption by the Planning, Zoning
and Appeals Board.
