PURPOSE: This will change the zoning designation of the property from "T4-R" General
Urban Transect-Restricted Zone to "T5-O" Urban Center Transect -Open Zone.

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING THE
ZONING ATLAS OF ORDINANCE NO. 13114, AS AMENDED, BY
CHANGING THE ZONING CLASSIFICATION FROM "T4-R," GENERAL
URBAN TRANSECT-RESTRICTED, TO "T5-O," URBAN CENTER
TRANSECT-OPEN, OF THE PROPERTY LOCATED AT 1415
NORTHWEST 63 STREET, MIAMI, FLORIDA, AS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A," ATTACHED AND INCORPORATED;
MAKING FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB") at its meeting on
December 19, 2018, following an advertised public hearing, adopted Resolution No. PZAB-R-
18-063 by a vote of nine to zero (9-0), Item No. PZAB.1, recommending approval of the change
of zoning classification as stated herein; and
WHEREAS, Miami -Dade County ("Applicant") owns the property located at
approximately 1415 Northwest 63 Street, Miami, Florida ("Property"); and
WHEREAS, the Property represents approximately 17.6 acres of 66.65 acres that
encompasses Liberty Square, an affordable housing development built in 1937; and
WHEREAS, the current zoning designation of the Property is "T4-R," General Urban
Transect— Restricted, which only allows residential uses by right; and
WHEREAS, the Property originally contained over seven hundred (700) dwelling units
and the Applicant has proposed a redevelopment plan to demolish and construct a greater
number of units, to provide new housing to existing residents currently living on the Property,
and to provide new housing options to future tenants; and
WHEREAS, the Applicant proposes a change of zoning classification of approximately
4.73 acres of the Property from "T4-R," General Urban Transect-Restricted, to "T5-O," Urban
Center Transect-Open, to allow the inclusion of some retail and commercial uses as part of the
redevelopment to fill the need in the area; and
WHEREAS, the "T5-O," Urban Center Transect-Open, designation would allow
commercial and retail uses that are currently prohibited within the "T4-R," General Urban
Transect-Restricted, designation; and
WHEREAS, the Applicant's proposal to change the zoning classification of the
Properties from "T4-R," General Urban Transect—Restricted, to "T5-O," Urban Center Transect—
Open, is in harmony with the established land use pattern and the adjacent districts; and
WHEREAS, the change in zoning classification from "T4-R," General Urban Transect-

Restricted, to "T5-O," Urban Center Transect-Open, allows the redevelopment of portions of the
Property in such a way as to enliven the street environment and increase the availability of
affordable housing; and
WHEREAS, the change in zoning classification from "T4-R," General Urban Transect-
Restricted, to "T5-O," Urban Center Transect-Open, is consistent with the scale of the
neighborhood, the needs of the neighborhood, and the goals City of Miami ("City"); and
WHEREAS, the change in zoning classification from "T4-R, General Urban Transect-
Restricted, to "T5-O," Urban Center Transect-Open, responds to the requirement of the
proposed project to allocate more density and intensity to the south of the project recognizing
the Martin Luther King corridor at Northwest 62 Street where additional "T5-O," Urban Center
Transect-Open, designations are located; and
WHEREAS, the change in zoning classification from "T4-R," General Urban Transect-
Restricted, to "T5-O," Urban Center Transect-Open, will contribute to the improvement of
development of properties in the adjacent area in accordance with existing regulations; and
WHEREAS, the change in zoning classification from "T4-R," General Urban Transect-
Restricted, to "T5-O," Urban Center Transect-Open, will result in the allowance of uses which
are expected to improve the quality of life of the Property's residents as well as the surrounding
neighborhoods; and
WHEREAS, the City Commission, after careful consideration of this matter, deems it in
the best interest of the general welfare of the City and its inhabitants to grant this change in
zoning classification as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission approves the amendment of the Zoning Atlas of
Ordinance No. 13114, as amended, by changing the zoning classification of the Property from
"T4-R," General Urban Transect—Restricted, to "T5-O," Urban Center Transect—Open.
Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty-one (31) days after second
reading and adoption thereof, pursuant and subject to Section 163.3184(12), Florida Statutes
and Section 163.3187(5)(c), Florida Statutes.'
1 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein. whichever is later.
