Purpose of Item:
A city resolution is required in order to access $15.5 million dollars in County GOB
funds and $5.0 million dollars in Convention Development Tax funds.
Background of Item:
Per County Resolution No. 919-04 adopted July 20, 2004, the Board of County
Commissioners approved $15,500,000.00 for the Historic Virginia Key Beach Park
Museum Project. And also, pursuant to Resolution No. 304-01 adopted March 20, 2001,
the Board of County Commissioners approved an allocation of $5,000,000.00 from the
County Convention Development Tax funds for park improvements and construction of
the museum at the Historic Virginia Key Beach Park.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ACCEPT, ALLOCATE, AND APPROPRIATE
REIMBURSEMENT FUNDS FROM THE MIAMI-DADE COUNTY ("COUNTY")
CULTURE AND EDUCATION FUND PROJECT 291 OF THE BUILDING BETTER
COMMUNITIES BOND PROGRAM, IN AN AMOUNT NOT TO EXCEED FIFTEEN
MILLION, FIVE HUNDRED THOUSAND DOLLARS ($15,500,000.00) AND
ACCEPTING FUNDS, ON A REIMBURSEMENT BASIS, FROM THE COUNTY
CONVENTION DEVELOPMENT TAX FUNDS, IN AN AMOUNT NOT TO EXCEED
FIVE MILLION DOLLARS ($5,000,000.00) FOR THE CONSTRUCTION OF THE
MUSEUM/CULTURAL CENTER AND OTHER IMPROVEMENTS, TO THE HISTORIC
VIRGINIA KEY BEACH PARK, FOR A TOTAL AMOUNT NOT TO EXCEED OF
TWENTY MILLION, FIVE HUNDRED THOUSAND DOLLARS ($20,500,000.00)
("FUNDS"); FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND
EXECUTE AN AGREEMENT(S), IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, WITH THE COUNTY FOR SAID PURPOSE; FURTHER AUTHORIZING
THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL OTHER
NECESSARY DOCUMENTS, AMENDMENTS, EXTENSIONS, RENEWALS, AND
MODIFICATIONS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO
IMPLEMENT THE ACCEPTANCE OF AND COMPLIANCE WITH THE FUNDS FOR
SAID PURPOSE; FURTHER AUTHORIZING THE CITY MANAGER TO ESTABLISH A
HISTORIC VIRGINIA KEY BEACH PARK MUSEUM FUND AND, AT THE TIME OF
NEED, ALLOCATE AND APPROPRIATE FUNDS FOR THE PURPOSE OF
ADDRESSING ANY MUSEUM OPERATIONAL REVENUE SHORTFALLS THAT MAY
OCCUR WITHIN THE FIRST TEN (10) YEARS OF THE MUSEUM'S OPERATIONS.
WHEREAS, the City of Miami ("City") received an award from Miami -Dade County's
("County") Culture and Education Fund Project 291 ("Project 291") of the Building Better
Communities Bond Program ("Bond Program") and the County's Convention Development
Tax ("CDT"), on a reimbursement basis, for the Historic Virginia Key Beach Park ("Park")
Museum Project and other related park improvements ("Museum Project"), in a total
amount not to exceed Twenty Million, Five Hundred Thousand Dollars ($20,500,000.00)
("Funds"); and
WHEREAS, pursuant to the Bond Program Referendum held on November 2, 2004,
the County Board of County Commissioners ("County Commission") allocated an amount
not to exceed Fifteen Million, Five Hundred Thousand Dollars ($15,500,000.00) to the City
from Project 291 for certain park improvements and the construction of a museum/cultural
center at the Park, attached and incorporated herein as Exhibit "A;" and
WHEREAS, pursuant to County Resolution No. 304-01 adopted on March 20, 2001,
the County Commission approved the use of CDT Funds in an amount not to exceed Five
Million Dollars ($5,000,000.00) to fund the construction of a Civil Rights Museum at the
Park; and
WHEREAS, several City economic development projects and large-scale revenue
generating events are scheduled to be completed and operational on Virginia Key in the
near future, and those projects, namely the Commodore Ralph Munroe Miami Marine
Stadium, the Flex Park at Virginia Key, and the Maritime Center can help contribute to a
designated fund for the support of the Museum Project on an annual basis; and
WHEREAS, the planning of the Museum Project first emerged from a public
community charrette in the year 2000, which also resulted in the first comprehensive
development plan for the Park in its entirety; and
WHEREAS, the civic, social, and environmental characteristics of the Park hold
national, regional, and local significance in the history of civil rights, highlight the
achievements of local African American communities, and provide an opportunity for the
publicto explore various environmental phenomena unique to the Park; and
WHEREAS, the Park was added to the National Register of Historic Places in 2002,
added to the State of Florida Heritage Trail in 2006, included as a major stakeholder to the
Virginia Key Master Plan in 2010, and added to the City's Historic and Environmental
Preservation List in 2013; and
WHEREAS, on May 11, 2006, pursuant to City Resolution No. 06-0289, the City
Commission approved the Virginia Key Beach Park Master Plan, which included the
restoration of the Park and the Museum Project; and
WHEREAS, the release of said County GOB and CDT funding is contingent upon
the commitment from the City to support museum operations in the event of a revenue
short fall, upon the completion of the Museum Project construction, currently scheduled for
2021; and
WHEREAS, a thoroughly revised business plan completed by Lord Cultural
Resources and Management, the world's foremost authority on cultural asset development,
for the Museum Project has been created to optimize both the community benefit and
revenue potential of the Museum Project, attached and incorporated as Exhibit "B;" and
WHEREAS, the Virginia Key Advisory Board at its May 29, 2019 meeting, adopted a
Resolution in support of the Museum Project and the adoption of this Resolution by the City
Commission; and
WHEREAS, this Project will enhance the cultural offerings of the City, bring
international attention to the Park's noteworthy civil rights history, serve as a positive ex-
ample of civic engagement as represented by the history of the Park's origin and the
advocacy of a citizen based Board of Trustees, and create social engagement opportunities
through the incorporation of the public shoreline, green space, and the various amenities on
the island of Virginia Key;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as fully set forth in this Section.
Section 2. The City Manager is authorized' to accept, allocate, and appropriate the
Bond Program and CDT Funds, on a reimbursement basis, from the County for the
Museum Project in a total amount not to exceed Twenty Million, Five Hundred Thousand
Dollars ($20,500,000.00).
Section 3. The City Manager is further authorized' to negotiate and execute an
Interlocal Agreement, in a form acceptable to the City Attorney, with the County for said
purpose.
Section 4. The City Manager is further authorized' to negotiate and execute any and all
other necessary amendments, extensions, renewals, and modifications to the Interlocal
Agreement, all in a form acceptable to the City Attorney, to implement the acceptance of and
compliance with the Funds for said purpose.
Section 5. The City Manager is further authorized to establish a Historic Virginia
Key Beach Park Museum Fund and, at the time of need, allocate and appropriate funds for
the purpose of addressing any Museum operational revenue shortfalls that may occur
within the first ten (10) years of the Museum's operations; such ten (10) year time period
commencing upon the completion of the Museum Project construction, currently scheduled
for 2021.
Section 6. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2
APPROVED AS TO FORM AND CORRECTNESS:
1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
