Subject: Ad Valorem Tax Exemption - The Fischer Residence - 3518 S Moorings Way
Purpose of Item:
This resolution will grant an Ad Valorem Tax Exemption for Historic Properties, as per
Chapter 23, Article II, to property owners Joel and Courtney Denaro, for a property
located at 3518 South Moorings Way.
Background of Item:
The Historic and Environmental Preservation Board at its meeting on April 01, 2014
adopted Resolution No. HEPB-R-14-017 recommending approval of the ad valorem tax
exemption for historic properties Part I. Subsequently, the Historic and Environmental
Preservation Board at its meeting on May 01, 2018, adopted Resolution No. HEPB-R-
18-036 recommending approval of the ad valorem tax exemption for historic properties
Part II.
The applicant and HEPB are now requesting approval from the City Commission as
required under Chapter 23, Article II of the City Code under Section 23-22(a) which
states: The city commission shall grant or deny the tax exemption based on the
recommendations of the board (HEPB). A vote of the commission shall be required to
adopt a motion.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
GRANTING THE APPLICATION FOR A HISTORIC AD VALOREM TAX EXEMPTION,
BASED ON THE RECOMMENDATION OF THE HISTORIC AND ENVIRONMENTAL
PRESERVATION BOARD, TO THE OWNERS, JOEL AND COURTNEY DENARO,
FOR THE PROPERTY LOCATED AT 3518 SOUTH MOORINGS WAY, MIAMI,
FLORIDA AND KNOWN AS THE INDIVIDUALLY -HISTORICALLY DESIGNATED
PROPERTY, "THE FISHER RESIDENCE."
WHEREAS, Chapter 23, Article II of the Code of the City of Miami, Florida, referred to as
the Historic Tax Exemption Ordinance, authorizes the City Commission to grant tax exemptions
to owners of locally designated historic properties within the City of Miami ("City") under
specified conditions, and for a period of up to ten (10) years; and
WHEREAS, Joel and Courtney Denaro ("Owners") own the individually historically
designated property located at 3518 South Moorings Way, Miami, Florida and known as the
Fisher Residence ("Property"), inclusive of the structure on the Property, with a legal description
as set forth in Exhibit "A," attached and incorporated, has submitted an application for a tax
exemption pursuant to the City's Historic Tax Exemption Ordinance; and
WHEREAS, the City's preservation officer, upon review of the application materials, has
determined that the Property complies with the requirements in the City's Historic Tax
Exemption Ordinance, and has recommended that the application be granted; and
WHEREAS, on April 01, 2014, the Miami Historic and Environmental Preservation Board
("HEPB") adopted resolution HEPB-R-14-017, attached and incorporated as Exhibit "C," which
approved an application for an ad valorem tax exemption for the Property; and
WHEREAS, on May 01, 2018, the HEPB adopted resolution HEPB-R-18-36, attached
and incorporated as Exhibit "D," recommending approval of the application for an ad valorem
tax exemption (Part II, Request for Review of Completed Work) for the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby approves the Property for an ad valorem tax
exemption pursuant to the City's Historic Tax Exemption Ordinance.
Section 3. This approval is conditioned on the execution by the Owners of a Historic
Preservation Property Tax Exemption Covenant, in substantially the form attached as Exhibit
"B," which, after execution, shall be recorded by the City's preservation officer in the Official
Records of Miami -Dade County.
Section 4. The tax exemption granted herein shall remain in effect for ten (10) years.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.

1 If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from
the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City.
