A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO SUBMIT A BOATING
INFRASTRUCTURE GRANT PROGRAM ("BIGP") APPLICATION, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR REIMBURSEMENT GRANT
FUNDING TO THE FLORIDA FISH AND WILDLIFE CONSERVATION
COMMISSION FOR A MAXIMUM ALLOWED APPLICATION AMOUNT NOT TO
EXCEED ONE MILLION, FIVE HUNDRED THOUSAND DOLLARS
($1,500,000.00) ("GRANT FUNDS") FOR THE RENOVATIONS AND
IMPROVEMENTS OF THE DINNER KEY MARINA ("PROJECT"); FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY
AND ALL NECESSARY DOCUMENTS, ALL IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, IN CONNECTION WITH THE SUBMISSION OF SAID
APPLICATION; FURTHER AUTHORIZING THE CITY MANAGER TO ACCEPT
GRANT FUNDS, IF AWARDED, AND TO NEGOTIATE AND EXECUTE, ALL IN
A FORM ACCEPTABLE TO THE CITY ATTORNEY, INCLUDING BUT NOT
LIMITED TO, GRANT AGREEMENTS, AMENDMENTS, MODIFICATIONS,
RENEWALS, AND EXTENSIONS THERETO.
WHEREAS, the Florida Fish and Wildlife Conservation Commission ("FWCC") is
authorized by the United States Fish and Wildlife Service pursuant to 50 Code of Federal
Regulations ("C.F.R.") Part 86 to apply for, receive, and administer grants from the Boating
Infrastructure Grant Program ("BIGP") to develop, renovate, and maintain public boating
facilities for recreational boats that are at least twenty-six feet (26') long and remain in the
facilities for fifteen (15) days or less; and
WHEREAS, the City of Miami ("City") wishes to renovate and improve the Dinner Key
Marina ("Project"); and
WHEREAS, grant funding in an amount not to exceed One Million, Five Hundred
Thousand Dollars ($1,500,000.00) is potentially available from BIGP; and
WHEREAS, the City wishes to apply for BIGP reimbursement grant funding in the
amount not to exceed One Million, Five Hundred Thousand Dollars ($1,500,000.00) ("Grant
Fund"); and
WHEREAS, the City is willing to enter into a twenty (20) year Agreement with FWCC
for the City's maintenance and operation of these new grant funded Dinner Key Marina
facilities and agrees to maintain these facilities in Dinner Key Marina with public access that
is designated for use by transient recreational boaters for the term of the grant agreement,
and designates the City's Office of Capital Improvement ("OCI") as the project manager; and

WHEREAS, in the event of the award, funds for project costs, including any match
funding, shall be appropriated by separate Resolution from funds available under OCI Project
No. B-18342646801 or other legally available funding sources;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to submit a BIGP application, in a form
acceptable to the City Attorney, for reimbursement grant funding for an amount not to exceed
One Million, Five Hundred Thousand Dollars ($1,500,000.00) for the Project and to execute any
and all necessary documents, all in a form acceptable to the City Attorney, in connection with
the submission of said grant application.
Section 3. The City Manager is further authorized' to accept, allocate, and appropriate
the Grant Funds in the event of award of the grant and to the execute, all in a form acceptable
to the City Attorney, any and all grant agreement(s), amendments, modifications, renewals, and
extensions thereto in order to implement this Resolution.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all requirements that may be imposed by
the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
