HomeMy WebLinkAboutR-19-0222City of Miami Resolution R-19-0222 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 5879 Final Action Date: 6/13/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY MANAGER TO ACCEPT A CONTRIBUTION OF FUNDS IN AN AMOUNT NOT TO EXCEED FIFTY THOUSAND DOLLARS ($50,000.00) FROM THE MIAMI DOWNTOWN DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI, FLORIDA ("DDA") FOR THE INTERSTATE 395 ("1-395") HERITAGE TRAIL PROJECT AND APPROPRIATING SAID FUNDS TO THE OFFICE OF CAPITAL IMPROVEMENTS ("OCI") PROJECT NO. 40-B193621 ("PROJECT"); FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN INTERLOCAL AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE DDA, AS WELL AS ANY AND ALL OTHER NECESSARY DOCUMENTS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") in coordination with the Florida Department of Transportation ("FDOT") and other stakeholders is working on the Interstate 395 ("1-395") Heritage Trail Project, Office of Capital Improvements ("OCI") Project No. 40-B193621, between Northwest 3rd Avenue and Biscayne Bay, Miami, Florida ("Project"), which will provide an active and welcoming open space and shared -use trail that reconnects historical neighborhoods in a pedestrian friendly environment and also solves longstanding mobility challenges; and WHEREAS, the Miami Downtown Development Authority of the City of Miami, Florida ("DDA") is a stakeholder of the Project and a member of the Design Advisory Group that has provided advice and support consistent with the DDA's goals; and WHEREAS, the City and the DDA have determined that the Project is in the best interest of visitors and residents of the City and the DDA desires to contribute funds towards the Project in an amount not to exceed Fifty Thousand Dollars ("$50,000.00") ("Contributed Funds"), pursuant to DDA Resolution No. 036/2018 adopted on December 14, 2018; and WHEREAS, the City and the DDA wish to execute an Interlocal Agreement ("Agreement"), in a form acceptable to the City Attorney, to accept the Contributed Funds for completion of the Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Manager is authorized' to accept the Contributed Funds from the DDA for the Project and to appropriate said funds to OCI Project No. 40-B193621. Section 3. The City Manager is further authorized to negotiate and execute an Agreement, in a form acceptable to the City Attorney, with the DDA, as well as any and all other necessary documents, all in a form acceptable to the City Attorney, for said purpose. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: _ndez, ity Attor ey 6/4/2019 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provis ions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
