HomeMy WebLinkAboutR-19-0217City of Miami Resolution R-19-0217 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 5977 Final Action Date: 6/13/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"), BY A FOUR FIFTHS (4/STHS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDINGS, ATTACHED AND INCORPORATED AS EXHIBIT "A," THAT COMPETITIVE NEGOTIATION METHODS AND PROCEDURES ARE NOT PRACTICABLE OR ADVANTAGEOUS FOR THE CITY OF MIAMI ("CITY") AND WAIVING THE REQUIREMENTS FOR SAID PROCEDURES; AUTHORIZING THE ALLOCATION OF ADDITIONAL GRANT FUNDS FROM THE DISTRICT 1 COMMISSIONER'S SHARE OF THE CITY'S ANTI -POVERTY INITIATIVE ("API") IN A TOTAL AMOUNT NOT TO EXCEED FIFTY THOUSAND DOLLARS ($50,000.00), IN ADDITION TO THE PREVIOUSLY APPROVED ALLOCATION OF FIFTY THOUSAND DOLLARS ($50,000.00) PURSUANT TO RESOLUTION NO. R-19-0211 ADOPTED ON MAY 23, 2019 FOR A TOTAL ALLOCATION OF ONE HUNDRED THOUSAND DOLLARS ($100,000.00) OF ASSISTANCE TO THE ELDERLY, INC., A FLORIDA NOT FOR PROFIT CORPORATION ("ASSISTANCE TO THE ELDERLY"), FOR THE PURPOSE OF PURCHASING AND INSTALLING A GENERATOR AT RESIDENTIAL PLAZA AT BLUE LAGOON LOCATED AT 5617 NORTHWEST 7 STREET, MIAMI, FLORIDA; AUTHORIZING AN AMENDMENT OF THE API AGREEMENT WITH ASSISTANCE TO THE ELDERLY, AS PREVIOUSLY APPROVED BY RESOLUTION NO. R-19-0211, TO INCLUDE THE ADDITIONAL FUNDS ALLOCATED PURSUANT TO THIS RESOLUTION; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY AND ALL DOCUMENTS NECESSARY, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. SPONSOR(S): Commissioner Wifredo (Willy) Gort WHEREAS, the City of Miami ("City") created the Anti -Poverty Initiative ("API") to address poverty based on a strategy of focusing the provision of support towards the City's residents achieving self-sufficiency; and WHEREAS, Assistance to the Elderly, Inc., a Florida not for profit corporation ("Assistance to the Elderly"), is seeking funds to assist the organization in purchasing and installing a generator that would meet the requirements under Rule 58A-5.036, Florida Administrative Code, for cooling the Residential Plaza at Blue Lagoon located at 5617 Northwest 7 Street, Miami, Florida ("Property") in the event of a power outage ("Project"); and WHEREAS, pursuant to Resolution No. 19-0211 adopted on May 23, 2019, the City Commission allocated Fifty Thousand Dollars ($50,000.00) to Assistance to the Elderly for the City of Miami Page 1 of 3 File ID: 5977 (Revision:) Printed On: 4/18/2025 File ID: 5977 Enactment Number: R-19-0217 Project; and WHEREAS, the City's District 1 Commissioner ("Commissioner") wishes to provide additional grant funds from the Commissioner's share of the City's API in an amount not to exceed Fifty Thousand Dollars ($50,000.00) ("Funds") to further assist with the Project; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, Florida, as amended ("City Code"), the City Manager has made written findings, attached and incorporated as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds for the Project; and WHEREAS, the Anti -Poverty Agreement related to the allocation of funds pursuant to Resolution No. R-19-0211 will be amended to reflect the additional funds being allocated and in accordance with this Resolution; and WHEREAS, the City Manager is requesting authority from the City Commission to negotiate and execute any and all other documents necessary, all in a form acceptable to the City Attorney, for said allocation of Funds for the Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 18-85(a) of the City Code, by a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's written findings, attached and incorporated as Exhibit "A," that competitive negotiation methods and procedures are not practicable or advantageous for the City's provision of said Funds for the Project at the Property and waiving the requirements for said procedures are hereby ratified, approved, and confirmed. Section 3. The City Manager is authorized' to allocate additional Funds from the Commissioner's share of the City's API to Assistance to the Elderly, in an amount not to exceed Fifty Thousand Dollars ($50,000.00) in addition to the previously approved allocation of Fifty Thousand Dollars ($50,000.00), pursuant to Resolution No. R-19-0211 for a total allocation of One Hundred Thousand Dollars ($100,000.00) for the Project at the Property. Section 4. The City Manager is further authorized' to execute an amendment of the API Agreement with Assistance to the Elderly previously approved pursuant to Resolution No. 19- 0211 to include the additional Funds allocated pursuant to this Resolution. Section 5. The City Manager is further authorized) to execute any and all other documents necessary, all in a form acceptable to the City Attorney, for said purpose. Section 6.
