HomeMy WebLinkAboutR-19-0202City of Miami Resolution R-19-0202 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 5748 Final Action Date: 5/23/2019 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE ANTI -POVERTY INITIATIVE GUIDELINES, FUNDING REQUEST FORM, TEMPLATE AGREEMENT, AND EXHIBITS, IN SUBSTANTIALLY THE FORMS ATTACHED AS COMPOSITE EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO UPDATE, FROM TIME TO TIME, SAID FORMS, PROCESSES, AND AGREEMENT(S), TO ENSURE THE PROPER UTILIZATION OF PUBLIC FUNDS, WITHOUT THE NEED FOR FURTHER CITY COMMISSION APPROVAL; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ANY AND ALL NECESSARY DOCUMENTS, ALL IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 14-0362 adopted on September 23, 2014, the City Commission established the Anti -Poverty Initiative Program ("API") to address poverty, through a strategy of focusing the provision of support towards the goal of having City of Miami ("City") residents achieve self-sufficiency; and WHEREAS, pursuant to Resolution No. 15-0106 adopted on March 12, 2015, the City determined that the most effective means of allocating API funding among the City districts should be based on the level of poverty within that district; and WHEREAS, pursuant to Resolution No. 16-0044 adopted January 28, 2016, all API funding recipients are required to execute an agreement with the City that addresses the scope of services, performance measures, invoicing, conflicts of interest, and other material terms that may be applicable for the use of any funds; and WHEREAS, the City desires to ensure API funds are utilized in accordance with its allocated purpose, in a transparent manner that provides accountability; and WHEREAS, on January 10, 2019, the City Commission directed the City's Administration to provide a report and suggestions on practices and processes to expedite the API funding allocation and approval process; and WHEREAS, as part of the API process improvement recommendations, the City's Administration is proposing the implementation of standardized API Program Guidelines and aFunding Request Form, along with the use of an API template agreement and insurance parameters, in substantially the forms attached as Composite Exhibit "A"; and WHEREAS, the City Manager is requesting authority from the City Commission to implement the above described process; to update, from time to time, said forms, processes, and agreements to ensure the proper utilization of public funds, without the need for further City Commission approval; and to execute any and all documents necessary, all in a form acceptable to the City Attorney, for said purpose; City of Miami Page 1 of 2 File ID: 5748 (Revision:) Printed On: 4/18/2025 File ID: 5748 Enactment Number: R-19-0202 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The API process improvement recommendations, including Standardized Anti -Poverty Initiative Program Guidelines and Funding Request Form and the utilization of a streamlined API template agreement and insurance parameters, in substantially the forms attached as Composite Exhibit "A," are adopted. Section 3. The City Manager is further authorized' to update, from time to time, said forms, processes, and agreement(s) to ensure the proper utilization of public funds, without the need for further City Commission action. Section 4. The City Manager is further authorized to execute any and all necessary documents, all in a form acceptable to the City Attorney, for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: Barnaby I_. Min, Deputy City Attorney 4/29/2019 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to, those prescribed by applicable City Charter and City Code provisions. 2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
